QUESTION

The relationship between the bank and customer is one that creates obligations by the bank to the

customer and vice versa as stated by Lord Atkin L.J in the case of Joachimson v Swiss Bank

Corporation (1921) 3 KB 110. Discuss the accuracy of the above statement and in addition,

discuss the manner in which the principles laid in the said Joachim v Swiss Bank Corporation

case fit or fail to fit in the principles stated in the case of the People v George Wello Mpombo

SSN/09/2010.
