Question 1

Part I

The rules of evidence in Zambia are to a large extent governed by ossified common
law. The common law rules of evidence were tailor fitted for trial by jury and are not
suitable for the justice system in Zambia today.

Discuss the extent to which you agree with the above statement in reference to:

A) The rules governing admissibility of evidence (20 marks)


B) The rules governing confessions (20 marks)
C) The rules governing corroboration and identification evidence. (20 marks)
