DATA PRIVACY CONSENT STATEMENT

INTRODUCTION

___ and ____ (albeit two separate and distinct entities), including its
affiliates and subsidiaries (herein jointly referred to as the “Organizations”)
value the confidentiality of personal data. This document details how the
Organizations uses and protects personal data for the purpose of obtaining
the consent of data subjects, in accordance with the Data Privacy Act of 2012
(DPA), its Implementing Rules and Regulations (IRR), other issuances of the
National Privacy Commission (NPC) and other relevant laws of the
Philippines.

As a nominee of the ____, you are considered a data subject. Please


read this document carefully to ensure informed consent.

A. What is Personal Data?

Personal data refers to all types of:

1. Personal information – “any information, whether recorded in a material


form or not, from which the identity of an individual is apparent or can
be reasonably and directly ascertained by the entity holding the
information, or when put together with other information would directly
and certainly identify an individual;”

2. Sensitive personal information – “personal information about an


individual’s race, ethnic origin, marital status, age, color,
religious/philosophical/political affiliations, health, education genetic or
sexual life, legal proceedings, government issued identifiers and other
information specifically established by an executive order or an act of
congress to be kept classified;” and

3. Privileged information – “any and all forms of information which, under


the Rules of Court and other pertinent laws, constitute privileged
communication, such as, but not limited to, information which a person
authorized to practice medicine, surgery or obstetrics may have
acquired in attending to a patient in a professional capacity.”

B. Why do the Organizations collect personal data?

The Organizations collect, use, process, store, and retain personal


data when reasonable and necessary to perform its review processes
effectively, safely and efficiently and in accordance with the qualifications to
determine the awardees.
In particular, the Organizations will collect your data in order determine
as to your qualifications to be considered as an awardee.

C. What type of personal data do the Organizations collect and


generate?

The Organizations will collect the following personal data:

Name
Birthdate
Civil Status
Citizenship
Affiliations
Residential and Office Address
Email address
Mobile number
Telephone number

D. How do the Organizations collect, acquire, or generate personal data?

The Organizations will collect the personal data when you accomplish
and transmit your nomination form together with your documents detailing
your personal circumstances, and will generate personal data to the
Screening and Awards Committee to determine your qualifications for the
award.

E. How do the Organizations ensure that personal data is accurate and


up-to-date?

Data subjects are primarily responsible for ensuring that all personal
data submitted are accurate, complete and up-to-date. From time to time, the
Organizations request updated data; it is important that subjects cooperate
and provide the same.

The Organizations take reasonable steps to make sure that the


personal data it collects, generates, uses or discloses are accurate, complete,
and up-to-date.

F. With whom may the Organizations share personal data?

As a general rule, the Organizations do not and will not share personal
data with third parties except as necessary for the proper execution of
processes related to a declared purpose, or the use or disclosure is
reasonable necessary, required or authorized by or under law.

For purposes of the Screening and Awarding of Nominees, the


Organizations will share your personal data with ____.
However, _____ may only use personal data for the purpose disclosed in this
document, and may not use it for any other purpose.

G. What are the rights of data subjects under the Data Privacy Act?

Data subjects have the following rights:

▪ Right to be informed;
▪ Right to object;
▪ Right to access;
▪ Right to rectify or correct erroneous data;
▪ Right to erase or block;
▪ Right to secure data portability;
▪ Right to indemnified for damages; and
▪ Right to file a complaint.

The Organization’s decision to provide access, consider requests for


correction or erasure, and address objection to process personal data as it
appears in the Organization’s official records, are always subject to applicable
and relevant laws and/or the DPA, its IRR and other issuances of the NPC.

H. Who should you contact in case of inquiry, feedback or complaints?

Should you have any inquiries, feedback, and/or complaints, you may
reach the Data Protection Officer (DPO) through the following contact details:

CONSENT

By submitting the Reply Form, you consent to the collection,


generation, use, processing, storage and retention of your personal data by
the Organizations for the purpose(s) described in this document. Please
ensure that you have completely read and understood the terms above before
signing.

You authorize the Organizations to disclose your information to


accredited/affiliated third parties or independent/non-affiliated third parties,
whether local or foreign, in the following circumstances:

1. As necessary for the proper execution of processes related to the


declared purpose; and

2. The use or disclosure is reasonably necessary, required or authorized


by or under law.

You authorize the Organizations to conduct a validation of your


credentials which could include checking of previous, pending, and completed
litigation/cases ( including but not limited to court records, National Bureau of
Investigation, Philippine National Police among others), civil registry records
validation, and credit investigation. Such conduct to validate your credentials
would solely and exclusively be used for purposes of screening your
qualifications for this current nomination.

From time to time, it may be necessary for the Organizations to revise


this document. Any revision made to this document shall be communicated
via posting in the Organizations website or via email. Any change will not be
applied and will not alter how the Organizations handle previously collected
personal data without obtaining your consent, unless required by law.
