MUNICIPAL ORDINANCE NO. 2008-8 AN ORDINANCE CREATING THE MUNICIPAL INDIGENOUS PEOPLES DEVELOPMENT AND ADVISORY COUNCIL (MIPDAC) DEFINING ITS COMPOSITION, PURPOSES AND FUNCTIONS AND APPROPRIATING FUNDS THEREFORE
WHEREAS, the Mangyans, the Indigenous People of Oriental Mindoro. Constitute more or less 10% of the total population of the province, most of whom are inhabiting the mountains; WHEREAS, the Mangyans in Oriental Mindoro are classified into seven (7) different ethno linguistic groups: the Irayas from Puerto Galera, San Teodoro and Baco; the Alangans from San Teodoro, Baco Naujan and Victoria; the Tadyawans from Naujan, Victoria, Socorro, Pola, Gloria and Bansud, Taubuids of Pinamalayan and Gloria; Buhid from Bansud, Bongabong and Roxas; the Bangons from Victoria, Pinamalayan, Bongabong and the Hanunuos from Roxas, Mansalay and Bulalacao; WHEREAS, the Mangyans are the most marginalized sector in the province, mainly surviving on swidden agriculture, their life is characterized by extreme poverty, lack of formal education and lack of basic health services; WHEREAS, the Municipal Government recognizes and promotes the rights of indigenous peoples specifically the Manyans, within the framework of national unity and development pursuant to the Indigenous Peoples Rights Act of 1997; NOW, THEREFORE on motion of Councilor Graciela M. Magbuhos BE IT ORDAINED BY THE SANGGUNIANG BAYAN OF PUERTO GALERA, ORIENTAL MINDORO THE FOLLOWING: SECTION 1. CREATION There is hereby created the Municipal Indigenous Peoples Development and Advisory Council (MIPDAC).

SECTION 2.

DEFINITION OF TERMS For the purpose of this Ordinance the following terms shall mean:

Indigenous peoples refer to a group of people or homogenous societies identified by the self-ascription, ascription by others, who have continuously lived as organized community and communally bounded and defined territory, and who have, under claims traditions and other distinctive cultural traits, or who have through resistance to political, social and cultural inroads of colonization, non-indigenous religions and cultures; became historically differentiated from the majority of Filipinos; Mangyans refer to the collective name used for the indigenous peoples of Mindoro Island who are classified into seven (7) ethno-linguistic group; namely: Iraya, Alangan, Tadyawan, Tau-Buid, Buhid, Hanunuo and Bangon; Indigenous Peoples Right Act of 1997 refers to the Republic Act No. 8371 of an Act Recognizes, Protects and Promotes the Rights of Indigenous Peoples, Establishing, Implementing Mechanism, Appropriating Funds Therefor, and for other Purposes; Mangyan Organization, Manyan Federation Mangyan organization refers to a grouping of a particular Manyan Community within ethno-linguistic group, while Mangyan federation refers to a grouping of Mangyan organization within a particular tribe or grouping of tribal organizations of all Mangyan tribes; The Council refers to the Municipal Indigenous Peoples Development and Advisory Council. COMPOSITION The Council shall be composed of the following: The Municipal Mayor as Chairman The Chairman of the Committee on Tribal Minority of the Sangguniang Bayan shall be the Vice Chairman of the Council who shall act as the Chairman in the absence or temporary incapacity of the latter; The Chairman, Committee on Ways and Means and the Chairman, Committee on Finance, Budget and Appropriations of the Sangguniang Bayan The Municipal Planning and Development Coordinator or his duly designated representative; One representative from Iraya Mangyan tribes; Representative from religious sector; Two representatives from the private sector to be nominated by the different nongovernment organizations or people working from the Mangyans and other indigenous people; The Provincial Officer of the National Commission on Indigenous Peoples (NCIP) or his duly designated representative; District Supervisor, NFE, District of Puerto Galera; Municipal Environment and Natural Resources Officer, Municipal Social Welfare and Development Officer and Municipal Health Officer; PURPOSE AND FUNCTIONS The Council shall formulate program and policy recommendations on Mangyan affairs which shall be forwarded to the Office of the Mayor, the Sangguniang Bayan and other concerned agencies, non-government agencies and institutions; The Council shall, from time to time, coordinate with the Iraya tribes and other indigenous people organizations and federations to constantly monitor the problems being encountered by the Mangyan communities; The Council shall coordinate with government as well as private agencies to solicit support to help implement projects and programs for the Mangyan and other indigenous people; The Council shall encourage the participation of the indigenous people specifically the Mangyans in all levels of decision-making and matters that affect in the rights, lives and destinies; The Council shall formulate plans and programs with the end view of transforming the Mangyans to be an independent, educated and self-reliant sector of the municipality while preserving their unique culture and tradition;

The Council shall assist the Municipal Government for the issuance of executive orders of the Sangguniang Bayan for the enactment of ordinances and approval of resolutions pertaining to Mangyans and other indigenous peoples concern; MEETINGS/QUORUM

SECTION 5.

The regular meeting of the Council shall be done once in every quarter of the year, which shall be on every first Tuesday of every quarter. If in case the regular meeting of the Council falls on a Holiday, the regular meeting shall be held on the next day following the scheduled date of meeting. In case of emergency or where there are urgent needs when the action of the Council is necessary, the Chairman or upon request of the majority of members may call for a special meeting, with notice to the member not less than two (2) days before the designated date specifying the date, place, time and purpose of the meeting. To constitute a quorum, majority of all members of the Council shall be present in all of its meetings. The decision of the majority of all members present shall constitute official act of the Council. SECTION 6. THE CHAIRMAN The Municipal Mayor shall be the Chairman of the Council. SECTION 7. THE SECREATARIAT

The Council shall have a Secretariat, which shall be the Mangyan Affairs Representative of the Local Government Unit. SECTION 8. FUNCTIONS OF THE CHAIRMAN The Chairman shall: Preside over the meeting of the Council Sign all the official communications, recommendations and resolutions of the Council; Make periodic representation of the Office of the Mayor and the Sangguniang Bayan With the help of the Secretariat, submit quarterly accomplishment reports of the Council of the Municipal and Sangguniang Bayan, Perform other functions as may be necessary for the effective performance of the Council. FUNCTIONS OF THE SECRETARY/SECRETARIAT The Secretariat shall: Record all the proceeding of the meetings and all other activities of the Council. Keep all the records and documents of the Council. Prepare all the official communication, resolution and recommendation documents of the Council, and forward the same to the Office of the Mayor, Sangguniang Bayan and other government agencies and non-government agencies and institutions. Prepare all quarterly accomplished reports of the Council. Prepare all documents necessary to the disbursement of funds of the Council. Send notices of meetings to the member of the Council. The Chairman of the Council, Secretary/ Secretariat and those from the government shall not receive remuneration in rendering services to the Council. Non-government members of the council shall be entitled to honoraria/incentives for every council meeting they will attend ay Calapan City in the amount of P 500.00.

SECTION 11.

FUNDING

For the first fiscal year operation of the Council, the amount of Fifty Thousand Pesos (P50,000.00) is hereby appropriated out of the Mangyan Development Fund of the Municipal Government for the year 2009. Thereafter, the amount of One Hundred Thousand Pesos (P100,000.00) shall be regularly appropriated in the shall cover the travelling expenses and per diems of all members of the council entitled to it and for administrative and other expenses of the Council. SECTION 12. EFFECTIVITY and ORGANIZATION OF THE COUNCIL

This Ordinance shall take effect immediately upon the approval by the Municipal Mayor. The Chairman shall take within 15 days from approval of the same shall organize the Council. Within five (5) days from its organization, the Council shall hold its first regular meeting. Thereafter, the regular and special meeting of the Council shall be held as provided in this Ordinance.
