Turkish Grand National Assembly

24 July is the ninety-seventh anniversary of the signing of the Peace Treaty of Lausanne (shortly Lausanne Treaty) on 24 July 1923 which legally abolished and superseded the Treaty of Sèvres of 10 August 1920 that was designed by the Allies of the World War I for the liquidation of the Ottoman Empire and virtually abolishing the Turkish sovereignty. Thanks to the Turkish War of Liberation conducted under the supervision of the Turkish Grand National Assembly in Ankara and under the able command of Mustafa Kemal a new state was born. The Grand National Assembly of Turkey abolished the Sultanate on 1 November 1922. Last Sultan of the Ottoman Empire left İstanbul aboard the British warship on 17 November 1922. The Turkish Nation acquired its sovereignty and shaped its destiny through the Turkish Grand National Assembly. The Peace Treaty of Lausanne  confirmed the sovereign independence of Turkey on an international plane. It is the founding document of the Turkish state. The Republic of Turkey was proclaimed  on 29 October 1923, three months after the signing of the Lausanne Treaty. Mustafa Kemal Atatürk’s motto of “Sovereignty unconditionally belongs to the Nation” is written on the wall of the General Assembly Hall behind the Speaker of the Parliament in the Grand National Assembly of Turkey as the basic and founding principle of the Republic of Turkey.

In the Ottoman State, the Muslim public’s first acquaintance with
the election took place in 1840 through the Councils of Taxation,
which were formed in the sanjaks. The Ottoman public, which voted
in the general elections for the first time –required by the 1876
Constitution-, realized this right to elect and be elected in appropriate
with the regulations in the Elections of 1908. The two-stage election
system of the Ottoman period, in which only the male population
held right to elect and be elected, had been implemented in the
Turkish Republic for long years. In almost all elections during the
Republican Period, different method was implemented, initially the
age of right to be elected was declined to 18, and later on it was increased
to 22 –with female population’s recognition of right to elect
and to be elected. So as to allow different views in the general elections
leading up to the 1946 Elections, in which only one party participated,
different practices were implemented. In certain places,
not presenting the Republican People’s Party as candidate, forming
an independent group within the party, presenting also the minorities
as candidate, were some of these practices. By the 1946 Elections,
one-stage election system was put into practice, and for the first time
multi-party system begun, whereby in accordance with the election
regulations, open voting and secret census was implemented.
Voting by ballot, elections’ supervision by adjudication and carrying
on one-level election system, were part of the system that was implemented
by the 1950 Election. In this election, the political power
passed from the Republican People’s Party to the Democratic Party.
In this study, the elections in the Ottoman period and the election
system have been depicted and the elections –including the 1950
Elections- as well as the election system that were practiced in the
Turkish Republic, have been dwelled on.

Osmanlı Devleti’nde Müslüman halkın seçimle ilk tanışması 1840
yılında sancaklarda kurulan Muhassıllık Meclisleri ile olmuştur.
1876 Anayasası gereği ilk defa genel seçimlere katılan Osmanlı toplumu
bu seçme ve seçilme hakkını kurallara uygun olarak 1908 seçimlerinde
yapmıştır. İki dereceli olarak yapılan ve sadece erkeklerin
seçme ve seçilme hakkına sahip olduğu Osmanlı dönemi seçim
sistemi Türkiye Cumhuriyeti’nde de uzun yıllar uygulanmıştır. Cumhuriyet
döneminde neredeyse her seçimde ayrı bir yöntem kullanılmış,
seçim yaşı önce 18’e indirilmiş, sonra kadınlara da seçme ve seçilme
hakkı tanınmasıyla 22’ye çıkartılmıştır. 1946 seçimlerine kadar
tek partinin katıldığı genel seçimlerde değişik seslere yer vermek
amacıyla farklı uygulamalara gidilmiştir. Belli yörelerde Cumhuriyet
Halk Partisi’nin aday göstermemesi, parti içinden müstakil grup
kurulması, azınlıkların da aday gösterilip seçilmesi bu tür uygulamalardan
bazılarıdır.
1946 seçimleri ile tek dereceli seçim sistemine geçilmiş, ilk defa
çok partili hayatın başladığı bu seçimlerde seçim kanunu gereği açık
oy gizli sayım yapılmıştır. Gizli oy açık sayım, seçimlerin yargı denetiminde
olması, tek dereceli seçime devam edilmesi 1950 seçimleriyle
uygulanan bir sistemdir. Bu seçimlerde Türkiye’de iktidar
CHP’den Demokrat Partiye geçmiştir. Bu çalışmada Osmanlı dönemi
seçimleri ve seçim sistemi hakkında bilgi verilmiş, 1950 seçimleri
de dahil olmak üzere Türkiye Cumhuriyeti’nde yapılan seçimler
ve seçim sistemleri üzerinde durulmuştur.

Türkiye'de 2000'li yılların ilk yarısı kadın hakları açısından önemli yasal reformlara tanıklık etmiştir. 2001 yılında 4721 sayılı yeni Medeni Kanun, 2004 yılında 5237 sayılı yeni Türk Ceza Kanunu kabul edilmiş, her iki yasada da daha önce bu kanunlarda yer alan cinsiyetçi düzenleme ve ifadeler kaldırılarak kadın hakları açısından önemli hukuki adımlar atılmıştır. Yine bu dönemde 2001 ve 2004 yıllarında Avrupa Birliği'ne uyum süreci kapsamında Anayasa'da yapılan değişikliklerle, anayasaya ilk defa kadın-erkek eşitliğine ilişkin ifadeler ve devlete de bu konuda pozitif ayrımcılık yapma yükümlülüğü getirilmiştir. Böylelikle bu dönem hem Türkiye Büyük Millet Meclisi'nde (TBMM) hem de yasal düzenlemelerin kadınlar lehine gerçekleşmesi amacıyla aktif bir kampanya yürüten kadın örgütlerinde kadın haklarına ilişkin canlı bir tartışmaya tanıklık etmiştir. Bu çalışmada kadın örgütlerinin kampanyalarında ve TBMM tartışmalarında şekillenen kadın hakları söylemi, Cumhuriyetin ilk yıllarında şekillenen Kemalist kadın hakları söylemiyle olan ilişkisi açısından analiz edilmeye çalışılmıştır. Çalışmada sonuç olarak, Kemalist kadın hakları söyleminin hem kadın örgütlerinin hem de milletvekillerinin söyleminde çeşitli şekillerde varlığını sürdürdüğü ancak feminist kadın hakları söyleminin de kendisine önemli bir alan açtığı görülmüştür. Kemalist söylem ağırlıklı olarak kadının çağdaş uygarlığın ve laikliğin simgesi olarak görülmesi ve " Türk kadınının " Kurtuluş Savaşı sırasındaki kahramanlıklarına yapılan atıflarla karşımıza çıkmaktadır. Bununla birlikte feminist kadın hakları söyleminin uluslararası anlaşmalara atıf yapan, pozitif ayrımcılığı vurgulayan ve kadını kendi varoluş serüveninin öznesi olarak gören boyutları da hem kadın hakları örgütlerinin kampanyalarında hem de TBMM tartışmalarında dile getirilmiştir. Bugünden geriye bakıldığında, yasa yapıcının ve hükümetlerin söylemindeki bu feminist açılımın bir istisna olduğu ve geçtiğimiz on yılda önemli bir daralma yaşadığı söylenebilir. Türkiye tarihinin en büyük boyutlarına ulaşan kadın hakları ihlalleri etrafında önemli bir söylemsel mücadele yaşanmaktadır. Bu durum, feminist kadın örgütleri, iktidar temsilcileri ve TBMM tartışmalarının bu söylemsel mücadelenin incelenebileceği ve yeni çalışmaların yapılabileceği alanlar olmaya devam ettiğini göstermektedir. From the “Symbol of Civilization and Virtuous Mother of
Nation” to “Liberate Subject of on her Own Life”: Discourse
of Women’s Rights in TBMM Minutes and Feminist
Campaigns in the first half of the 2000s in Turkey

Abstract

The first half of the2000s witnessed a number of legal reforms on women’s rights
in Turkey. In 2001 the new Turkish Civil Code passed by the Turkish Grand National
Assembly (TGNA) on November 22, 2001. On September 26th, 2004, the Turkish Penal
Code Law was enacted in the TGNA. Both of the codes repealed the sexist expressions
on the old articles and brought some very important gains for women’s rights. Also in
2001 and 2004 as part of the Turkey’s EU harmonization process two constitutional
amendment packages were passed by TGNA both of which stresses the gender equality
and positive discrimination for women for the first time. During these legislative
processes, there began a lively debate on women’s rights both in TGNA and within
the women’s rights organizations who launched nationwide campaigns to affect the
assembly on gender equality and the protection of sexual and bodily rights of women.
This study analyzes the discourse of women’s rights in women’s NGOs campaigns and
in TGNA minutes through a comparision with Kemalist discourse on women’s right of
the early Turkish republic.

The results of the study indicate that, Kemalist discourse remained both in women’s
campaigns and in TGNA debates but at the same time a rather different feminist
discourse also had important space in both parts’ discourse. The elements of Kemalist
discourse which give importance to women’s rights as a symbol of modern civilizations
and secularism and amphasisez the heroism of women during the Turkish war of
independence was repeated in the debates while the feminist discourse which refers
to human rights and international conventions, claims positive discrimination for
women and defines women as a liberate subjects of their own lives, is also used within
the debates.

Looking back from today, this feminist expansion of the discourse seems as an exception,
as the discourse on women in the governments and TGNA has get more and more
conservative since then. Today, in a conjuncture of important women rights violations
in Turkey, the struggle over women’s rights discourse is continues to be an important
issue to be analyzed to which this study can be a starting point.

The article aims at presenting information from unpublished and unexplored until now Bulgarian archival documents about the Soviet-Turkish relations. It follows their development in the period 1921-1923, based on the reports of the Bulgarian diplomats residing in Istanbul-Todor K. Pavlov, Todor Markov and Ivan Altanov. Among the topics concerned were the status of the Soviet-Turkish relations; the Soviet military and financial support for the Ankara Government; the Soviet-Turkish rivalry for the influence over Muslim peoples in the Middle East and Asia; international conferences; internal politics and developments within the Grand National Assembly; important Turkish personages that influenced directly or indirectly the Soviet-Turkish relations, etc. The presented documents reveal not only some important nuances of already known facts and events, but open new unexplored topics in the historiography, related to the Soviet-Turkish relations during the period under consideration.

Milli Mücadele'nin savaş aşamasının ardından 1922 yılı Kasımında İsviçre'nin Lausanne şehrinde İtilaf Devletleri ile Türkiye Büyük Millet Meclisi Hükümeti temsilcileri barış müzakerelerine başlamışlar, ancak görüşmelerden kesin bir netice çıkmamıştı. Barış görüşmelerinin ikinci dönemi (Nisan 1923) başlamadan hemen önce TBMM seçime gitme kararı alır ve Mayıs-Ağustos aylarında II. TBMM için seçimler yapılır. I. TBMM'den M. Kemal Paşa'ya muhalif görünen mebusların tamamının Meclis dışında kalacağı bu seçim süreci sonunda hemen tamamı Mustafa Kemal Paşa'nın belirlediği mebuslardan oluşan yeni TBMM bir bakıma M. Kemal Paşa'nın Atatürk olma sürecinin de en önemli aşamasını oluşturmuştur. Bu bağlamda Mustafa Kemal Paşa'nın tartışmasız liderlik süreci Lausanne tartışmaları gölgesi altında ve Mustafa Kemal'in gazetesi Hakimiyet-i Milliye gazetesi temelinde ele alınmış ve değerlendirmelerde bulunulmuştur.

This report has been drawn up for the TGNA (The Grand National Assembly of Turkey) as part of the “Strengthen the Role of Turkish Parliament for the Improvement of National Climate Change Policy Project”. Being executed by the Global Balance Association, other stakeholders of the project include the Association for the Protection of Consumers and Climate and the Legislation Association. The primary objective of the project is to raise awareness within the Turkish Parliament with regard to policies and practices for combating climate change and to draw attention to the issue.

6th INCSOS Congress, titled “The Turkish National Anthem and Mehmet Akif Ersoy in the 100. Anniversary with Its Universal Dimensions” will be held on 27-30 September 2021, under the auspices of Prof. Dr. Mustafa ŞENTOP, Speaker of the Grand National Assembly, with the main cooperation of Ankara Yıldırım Bayazit University and Tarihdaş Nations Society, and with the support from a number of institutions, on the campus of TBMM.

The legislature’s power of the purse is sine qua non condition for democratic governments. The legislature’s power of the purse depends on a number of elements such as institutional and political structure, and traditions, constitutional power of the legislature, legal budgetary process and some country specific factors. The aim of this article is to explain the level of the power of the purse of Grand National Assembly of Turkey (GNAT) and to determine which factors affect this power. In this sense, de jure and de facto power of the GNAT in the budgeting process is analyzed by using several indicators to describe differences in the legal framework and implementation. The subject is also examined in terms of Turkish political structure, international factors, and features of the parliamentary systems.
