Vallejo files for review before the Supreme Court of California based on the fact Judges in California had interests in real estate and mortgage backed securities ( MBS ) which should have recused themselves and did not. This created a real conflict of interest prohibited by the Judicial Ethics Commission of California rending the ruling null and void and a rehearing scheduled as soon as possible. Title is still in Vallejo as Quiet Title Action proceeds.

• The term jurisdiction has been derived from two Latin terms – ‘juris’ meaning law and ‘dicta’ meaning speech. So the term basically means “I speak by the law”.

• Jurisdiction has not been defined under the Code of Civil Procedure (hereinafter CPC or the Code). Black’s Law dictionary defines the term as “A court's power to decide a case or issue a decree.”

• If a case has been decided by a court which does not have jurisdiction to decide that matter, such lack of jurisdiction will go back to the root of matter and authority of court to decide that matter can be challenged.

RULE 1.120. PLEADING SPECIAL MATTERS
(a) Capacity. It is not necessary to aver the capacity of a party to sue or be sued, the authority of a party to sue or be sued in a representative capacity, or the legal existence of an organized association of persons that is made a party, except to the extent required to show the jurisdiction of the court. The initial pleading served on behalf of a minor party shall specifically aver the age of the minor party. When a party desires to raise an issue as to the legal existence of any party, the capacity of any party to sue or be sued, or the authority of a party to sue or be sued in a representative capacity, that party shall do so by specific negative averment which shall include such supporting particulars as are peculiarly within the pleader’s knowledge.

A multitude of crises have ravaged Greece during the past six years. The ensuing austerity policies, imposed as antidotes, appear to have impacted people's lives gravely. The collapse of a failing social and political system led to the establishment of social solidarity initiatives. One of these initiatives is the Somateio Allilovoithias Ofeileton Rethymnou (SAOR-Network for the Mutual Assistance of Rethymno's Debtors). SAOR offers comradeship by activating citizens to build collective strength and to resist foreclosures actively. In this paper, we present the results of a qualitative study focusing on the lives of the people who are members of the network and are involved in deterring foreclosures. Eleven interviews and a focus group discussion provided by coalition members were analyzed using phenomenologically informed thematic analysis. Three superordinate themes were identified: 1) Living on the precipice: Shocked, hoodwinked and debt-ridden; 2) Mutual anger against the 'betrayers' and the need for resistance; and 3) The national bankruptcy and unending deliberations regarding country's and the coalition's fate. These themes comprise a story entitled: The neoliberal myth of austerity: Indebted personhood in a bankrupt nation. Indebted citizens described the emotional collapse, the alienation, the feelings of solidarity they experienced and their anger toward politicians.

The opposed motion for an extension of time to file a petition for rehearing was granted.

They were puzzled, though, when a foreclosure notice came early in 2011 from Wells Fargo because they hadn’t done business with that bank.

This motion is supported by the following. On 3/3/2022 this court filed its order (DktEntry: 47 "Order") which denied Ms. Cox's petition for rehearing en banc or panel rehearing (DktEntry: 45 "Petition") of its previous memorandum decision (DktEntry: 39-1 "Memorandum"). The Order also denied Ms. Cox's motion for judicial notice in support (DktEntry: 46 "RJN") of her Petition; motion to strike (DktEntry: 32) and request for judicial notice in support thereof (DktEntry: 33).

Late last month, banking services company US Bank agreed to repay the government a staggering $200 million amid allegations it misrepresented residential home loans as suitable for insurance when, in fact, the borrowers either did not meet standard underwriting requirements or were not checked for creditworthiness at all. The settlement comes on the heels of several other settlements between private mortgage lenders and the federal government-many of which stem from the 2008 housing crisis.
