Regulatory Impact Analysis

La regulación, junto a la política fiscal y monetaria, constituye una herramienta clave mediante la cual los gobiernos fomentan objetivos de política pública —como el desarrollo económico y el bienestar social— que por deber han de diligenciar atendiendo a múltiples variables y propiciando un escenario que procure ser eficiente para todos. Así, al establecer las denominadas “reglas de juego”, los gobiernos buscan impulsar el adecuado funcionamiento de los mercados, proteger los derechos y la seguridad de los ciudadanos, y garantizar la prestación de bienes y servicios esenciales. Por ello, una regulación mal diseñada trae consigo el descrédito y enormes costos sociales para las empresas y los ciudadanos.

En el presente ensayo se abordará, de forma breve y en el orden a continuación, (i) los desafíos que surgen frente a la mejora regulatoria en un contexto de integración regional, (ii) los mecanismos estándar de cooperación regulatoria internacional y su importancia, (iii) breves comentarios respecto a la cooperación regulatoria internacional en el Perú, y (iv) algunas recomendaciones en torno al desarrollo de un marco regulatorio que incluya una cooperación regulatoria internacional.

Regulatory reforms in Europe and the OECD in the last decade have focused on efforts to improve regulatory quality. As part of that development, political and administrative decision-makers have been encouraged to consider fiscal, socio-economic and other effects of proposed legislation when making policy choices. The Central and Eastern European EU member states adopted such regulatory impact analysis (RIA) mechanisms in the early 2000s but, so far, there has been little analysis of the implementation of RIAs conducted in these countries. This article compares, first, the manner in which RIA has been institutionalised in the Czech Republic, Estonia, Hungary, Slovakia and Slovenia. Second, it explores how differences in institutionalisation have affected RIA performance. The paper argues that there are marked differences in the RIA quality across Central and Eastern Europe, notably as a consequence of differences in institutional and administrative contexts and capacities.

O artigo inicialmente exemplifica como a Análise de Impacto Regulatório (AIR) já se tornou um ponto de consternação para as pessoas sujeitas à regulação, em razão dos muitos efeitos que as decisões dos reguladores têm na vida cotidiana e econômica da população. Do que está na pauta de discussão atual o estudo regride para o histórico da AIR na OCDE, apresentando dados que demonstram em quais áreas do direito, e com que intensidade, essa técnica tem sido utilizada. O ítem seguinte é dedicado ao desenvolvimento teórico da AIR, explorando-se as suas características principais e as premissas conceituais utilizadas em análises de impacto. Ao final, trata-se do desenvolvimento da AIR no Brasil, com um breve relato sobre o histórico legislativo, uma visão da doutrina nacional e o exame de iniciativas já tomadas e em curso no âmbito de agências reguladoras nacionais. Abstract: The article initially exemplifies how Regulatory Impact Analysis (RIA) has become a major concern to individuals who are subject to regulation, considering the multiple effects regulators' decisions have on daily and economic life. Henceforth, the author goes on to examine data gathered by the OECD displaying in which fields of law, and how intensely, RIA is used. After that, he brings forth theoretical developments of RIA, exploring its main features and some conceptual premises used in impact analysis. Following that, the author examines RIA in Brazil, briefly describes its legislative background and provides an overview of Brazilian scholarship and an inquiry of ongoing initiatives taken by national regulatory agencies.

RESUMEN La Evaluación de Impacto Regulatorio (EIR) ha sido considerada como una de las herramientas más idóneas en materia de regulación administrativa en pos de analizar el costo y beneficio que conlleva la puesta en marcha de nuevas normativas. No siendo aún regulada en el derecho nacional, se hace necesario indagar en su idoneidad para el caso chileno, centrando el análisis en cómo se puede hacer parte en ella la participación ciudadana.
ABSTRACT The Regulatory Impact Evaluation (EIR) has been considered as one of the most suitable tools in terms of administrative regulation in order to analyze the cost and benefit of the implementation of new regulations.
