Ius Ecclesiae

The Franciscan ideal of poverty did not last but a century: from the confirmation of the Regula given by pope Honorius III (1223) until the allegation of heresy that pope John XXII (1323) launched towards anyone affirming that Christ and the Apostles had never had properties nor the possession of anything. Along the hundred years that separated the two papal provisions, the legal vocabulary annexed to the conceptualization of poverty had to face the evolution of the vocabulary of the ius commune and made the attempt to add its own definition of poverty, based on the refusal of the possession of things in the complex medieval legal system. La parabola ecclesiale dell’ideale francescano di povertà è durata un secolo, dalla conferma della Regola da parte di papa Onorio III (1223) alla condanna per eresia, sancita da papa Giovanni XXII (1323), per chiunque affermasse che Cristo e gli Apostoli non avessero mai avuto sulle cose né proprietà né diritto d’uso. Nell’arco di questo secolo il lessico giuridico della povertà ha dovuto misurarsi con il vocabolario dello ius commune, nel tentativo d’inscrivere anche il proprio codice, fondato sul rifiuto del dominium rerum, nel complesso sistema giuridico medievale.

The article analyzes the role of advice within any act governed by the virtue of prudence. In a second step, the paper examines the value of expert advice in determining what is right. The requirements of a jurist's advice are studied: it must be free and confined to the legal dimension of the problem. Finally, current canonical norms in which the advice of a jurist is required are examined.

The article’s aim is to study the regulatory framework established by the const. ap. Anglicanorum coetibus for the pastoral attention of the groups of faithful coming from Anglicanism and, more particularly, the nature of the personal ordinariates provided for this purpose. It starts by reviewing some of the problematic formal profiles of the const. ap. and Complementary Norms issued by the Congregation for the Doctrine of the Faith. Then it examines the figure of personal ordinariates, comparing them with other personal ecclesiastical circumscriptions already existing. It focuses on the extent of the Ordinary’s jurisdiction, to determine if it is cumulative with that of the diocesan bishops, or exclusive, trying to understand the meaning to be given to the provision that the ordinary exercises its power “jointly” with that of the bishops, and comparing this solution with that of sui iuris Churches. It also explores what the legal position of the personal of the faithful in the dioceses where they live. Along with other specific issues, this article examines the consequences of the voluntary way of membership in these ordinariates
