Corporate Social Responsibility principles can be difficult to put into practice and companies struggle to justify CSR activities in terms of tangible business benefit. It is with this view that a review of the available frameworks was used to operationalize CSR in Indian context. Four dimensions i.e. Operational, Economic, Environmental and Social comprising of 21 factors were identified. Based on this a survey was conducted and a sample of 100 NSE and BSE listed companies from Primary, Secondary, Tertiary and Quaternary Sectors was completed for the study. The scores were then correlated and regressed with a five year average of Return of Investment (ROI) of each company. The paper discusses the results obtained from the analysis which were statistically not significant but also did not hold negative implications for the companies.

The object of this LLM assignment-based paper was to briefly explore the extent to whether the current voluntary concept of corporate social responsibility (CSR), of pursuing shared social values between business and society is a fair and just system or whether it lacks governmental legitimacy and adequate accountability mechanisms.
Historically corporate social responsibility’s (CSR) is a moot point amidst business entities, governments and academics that are still unable to agree on how the concept should be defined. Nevertheless critics on both sides of the argument do accept CSR by its nature is voluntary. The United Kingdom (UK) government in line with Europe distinguishes CSR as a voluntary exercise business takes above and beyond the minimum legal requirements to enhance and manage their economic, environmental and societal impact.  Therefore by its very nature the definition of the concept of CSR has been precluded from the legislative agenda. This in itself has led to dissention to the effectiveness of corporate voluntarism and self-regulation over governmental mandatory regulation to manage and enhance societal needs. The core divergence is ostensibly whether entrepreneurial corporations in search of corporate self-interest and profit can also embrace morality through a strategic approach to integrate shared values for business and society without government intervention. With India paving the way as the first country to mandate CSR activities and expenditure should the United Kingdom (UK) alter their voluntary position and align their legislation accordingly.

In the aftermath of the global financial crisis apparently little has changed. Financial institutions continue to do “business as usual”. Major players in the financial sector still violate national law, and are complicit in environmental destruction and human rights infringements due to questionable lending practices.
While companies frequently boast themselves in public of being members of certain initiatives or following specific, globally recognised guidelines and principles, in business reality companies often tend to fall short with their aspirations communicated publicly.
This paper claims that corporate social responsibility and sustainability strategies as well as current measures implemented are not effective enough to induce a substantial change with regard to more responsible business behaviour. Voluntary memberships at initiatives, commitments to globally recognised principles and guidelines, as well as internal policies are frequently disregarded when it comes to investment decisions. Therefore, after more than 20 years practice of voluntary measures it is about time for a critical assessment with regard to their effectiveness in changing corporate behaviour to the good.
This paper aims to present a more differentiated and comprehensive picture of the business reality, particularly in the finance sector. For this purpose, publicly communicated corporate responsibility approaches by two major financial institutions are presented and contrasted with the actual business practice.

There are at least two good reasons why linking BEE to CSR and sustainable development is important for companies, as well as for the South African economy as a whole. The first relates to communication with, and perceptions of, international
stakeholders, especially investors. International investors are often apprehensive about BEE. One of their key concerns is the prospect of value dilution in connection with ownership transfer to HDSAs. This was apparent in the case of the mining
charter negotiations and the subsequent road show by government and big business to ameliorate investors‟ concerns. The broader sustainable development discourse,
however, has generally received greater support from institutional investors, in particular. Linking the BEE and sustainable development discussions may hence
help alleviate some of the negative perceptions and reactive approaches to BEE among investors and managers.

Secondly, understanding the inter-relationship between most BEE objectives and the international CSR requirements will also allow for more effective and efficient management systems within companies. In most prominent companies active in
South Africa, management systems have evolved to respond to increasing requirements and expectations for environmental and social performance enhancement. Concurrently, intense pressure for effective BEE responses have in many instances led to the establishment of separate, more high-level management structures. As far as BEE elements other than ownership are concerned, these new structures have often led to duplication and inefficiencies, or even the eclipsing of
existing CSR efforts. There is thus significant benefit to be derived by companies from a strategic approach that sees BEE as an inherent part of the company‟s broader CSR strategy and management. This would allow for the establishment of
more efficient and synchronised management and reporting systems. Corporate reports would more likely satisfy the South African government‟s demands for BEE related information, as well as stakeholders‟ concerns with broader CSR issues.

Sustainability reporting is undoubtedly at a crossroads. Businesses are expected to be voluntarily transparent, yet this has proven to be ineffective. The traditional approach to CSR, which was formulated mainly by the business sector, is beginning to alter its course. In the past, legislative and enforcement agencies have insufficiently examined the social and environmental conduct of corporations. The agencies have viewed this as “beyond compliance” for businesses. Today in the developed world there is a trend of 'return to regulation' and CSR is included in that trend. As Israel aspires to maintain its position as an advanced economy, it is crucial to be prepared for these upcoming changes. Alongside with these developments, we can also see a strengthening of civil society, a redistribution of responsibilities and resources, and a new way of economic thinking (sharing economy, social entrepreneurship, cooperatives etc.).
The law proposal attached to this document intends to find a method for regulating CSR in a more sophisticated manner. The law does not seek to set a harsh standard for corporations to obey 'as is'; rather, it outlines a detailed set of sustainability reporting guidelines. These guidelines shift the enforcing responsibility from state agencies to the public. The public (through specialized NGOs) would now be able to judge and rate each corporation according to its performances. Today, the public and even business managers are eager to have a clear set of expectations in regards to CSR and some even prefer to shift to a model of CSR that is bound by law and under state supervision, where the requirements are clear to all.
