Action in United States District Court for the Northern District of California. Darling vs, Douglas was a federal lawsuit brought by Disability Rights, to prevent the State of California from cutting Adult Day Health Care (ADHC) services. This document is a  Declaration in Support of Plaintiffs’ Motion for Enforcement of Stipulated Judgment and for Appointment of Special Master.

The Declaration critiqued the “quality assurance” efforts made by the State and compared them to federal quality assurance procedures in home and community-based programs.  The Declaration proffered two opinions:

1) Whether and to what extent the State of California’s quality assurance reviews comport with standards in the field for quality assurance activities, and

2) Whether the State properly overturned findings of eligibility for Community Based Adult Services (CBAS) based on such “QA reviews.”
