Before the Philippine Supreme Court is a motion for reconsideration filed by the petitioners Silverio Marchan and Philippine Rabbit Bus Co., Inc against the respondents Arsenio Mendoza, Leonarda Ilaya and Zenaida Mendoza, this is to question the correctness of the resolution of Court of Appeals ordering the petitioners to pay exemplary damages.

Topic: libel vis-à-vis the constitutional guarantee of freedom of the press and statements involving public officers in the exercise of their official functions. [Full case title: Raffy T. Tulfo Vs. People of the Philippines and Atty. Carlos T. So/ Allen A. Macasaet and Nicolas V. Quijano, Jr. Vs. Carlos T. So and People of the Philippines] These consolidated criminal cases originated from 14 Informations for libel filed against the writer, publisher, and managing editor of the Abante Tonite column, "Shoot to Kill", which covered stories on the alleged anomalous dealings of Atty. Carlos "Ding" So (Atty. So) of the Bureau of Customs. At issue are the Revised Penal Code provisions on libel vis-à-vis the constitutional guarantee of freedom of the press and statements involving public officers in the exercise of their official functions. FACTS: • On 12 April 1999, after the ninth publication in Abante Tonite about his purportedly dubious activities at the Bureau of Customs, Atty. So filed a Complaint-Affidavit for nine (9) counts of libel against the three accused (Tulfo, Macasaet and Quijano) for their abusive and malicious imputations against him. He later filed more complaint in connection with subsequent issues of Abante Tonite, when Tulfo refused to stop his alleged defamatory statements.

Eduardo and Atty. Palma met sometime in the 70's. Eduardo was a client of well-known law firm and Atty. Palma was the lawyer assigned to handle his cases. Because of his growing business concerns, Eduardo decided to hire Atty. Palma as his personal counsel.

Consequently, Atty. Palma's relationship with Eduardo's family became intimate. He traveled and dined with them abroad. He frequented their house and even tutored Eduardo's 22-year old daughter Lisa, who was then a college student.

On June 22, 1982, without the knowledge of complainant's family, respondent married Lisa in Hongkong.

During the 15th century the Digest has been subjected to previously unparalleled historical and philological scrutiny: humanists analyzed and appraised it not just in an exclusively juridical context, they also managed to grasp its literary value and exploit its linguistic significance for a restoration of the Latin language. A case in point is Maffeo Vegio’s anthology published under the title De verborum significatione in iure, which had a good diffusion in manuscripts, but whose effective use by the humanists of Vegio’s generation has to date never been docu- mented. The preparation of a critical edition of Biondo Flavio’s Roma instau- rata for the Edizione Nazionale delle Opere di Biondo Flavio has brought to the fore remarkable evidence in this respect. First of all, Biondo’s use of Vegio’s work provides new evidence for the reconstruction of Biondo’s personal library; secondly, it sheds new light on his links with the antischolastic culture of his age and his personal and intellectual connections with scholars such as Maffeo Vegio and Lorenzo Valla; thirdly, it helps clarify Biondo’s scholarly methodology, and helps the editor in the constitutio textus of the Roma instaurata.

This is a petition for review on certiorari under Rule 45 of the Rules of Court. The petition challenges the decision of the Court of Appeals finding respondent Martin T. Dy, Jr. (Dy, Jr.) not liable for trademark infringement. The Court of Appeals reversed the decision of the Regional Trial Court (RTC)
