Мета проведеного дослідження – установити внесок науковців-правників Київського національного університету імені Тараса Шевченка у розвиток доктрини науки цивільного процесуального права в період незалежності України, з 1991 року. Для реалізації цієї мети застосовано наукові методи аналізу основних законодавчих актів, що регулюють цивільні процесуальні відносини, виокремлено й охарактеризовано положення тих досліджень, в яких було запропонова- но нові підходи до вдосконалення механізму реалізації права особи на справедливий суд, забезпечення доступу до право- суддя в цивільних справах, розвиток і вдосконалення цивільного судочинства в умовах забезпечення сучасних міжнарод- них, зокрема європейських, підходів. Результатами проведеного дослідження виявлено більше 40 дисертаційних дослі- джень, що були захищені впродовж обраного періоду в Київському університеті, а також багато наукових досліджень, що істотно вплинули на розвиток національної традиції цивільного процесу. Підбито підсумки проведеного досліджен- ня та визначено напрями подальшого розвитку наукових пошуків у сфері цивільного процесуального права України.

Здійснено загальний аналіз підготовлених у 2020 р. Модельних європейських правил цивільного процесу (далі – Пра- вил), зокрема, охарактеризовано їхню структуру, визначено мету та завдання, основні принципи. Це дало можливість дійти висновків щодо ролі та значення вказаних Правил для подальшого розвитку цивільного процесу і у державах- членах ЄС, і в інших державах, зокрема в Україні. Зазначено важливу роль уніфікації термінології цивільного процесуаль- ного права, яку було використано для підготовки Правил та яка в подальшому поширюватиметься завдяки широкому застосуванню в наукових дослідженнях, під час підготовки законодавчих актів тощо. Зокрема, ідеться про такі специ- фічні інститути цивільного процесуального права, як принцип співробітництва суду та сторін (cooperation between a judge and parties), принцип примирення (settlement), організація розгляду справи (case management) та ін. Обґрунтовано, що визначена сфера дії й основні принципи Правил зумовлюють необхідність переосмислення традиційних підходів до регулювання відносин, що пов'язують сторони й їхніх представників, а також суд під час розгляду справи, нові підходи до стадійності розгляду справи судом і диференціації цивільного судочинства.

Judicial cooperation between EU Member-States and Ukraine is still at a basic level. The EU-Ukraine Association Agreement does not prove an appropriate approach, and their relations are regulated mostly with the bilateral agreements. The Baltic states and Ukraine, which are the focus of this research, are deeply engaged by their close geographical location, common historical issues and friendly relations, and seek further development of their relations. This should be accompanied by mutual judiciary trust and therefore by the corresponding evolution of bilateral relations proper to this trust. The following types of judicial cooperation in civil matters were chosen as objects of this research: recognition of Baltic States’ courts’ judgments in Ukraine, as well as service of documents and taking of evidence in Ukraine. Гармонізація цивільного процесу є однією з найбільш актуальних тенденцій розвитку цивільного процесуального права в європейських країнах, що наразі досліджується та активно обговорюється в наукових колах. У 2020 році завершується спільний проект з розробки Європейських правил цивільного судочинства, який символізує прагнення європейських країн подолати відмінності у національному регулюванні цивільних процесуальних відносин. Ймовірно, що результат цього проекту, з огляду на його еволюційне значення, зміст та обсяг (незважаючи на очікування більшості його учасників, кількість правил сягає більше двохсот п’ятдесяти), стане основою для законодавчих ініціатив у майбутньому
Професор В. Комаров в своїй роботі 2011 року «Цивільний процес у глобальному контексті» слушно зауважив, що у процесуальній доктрині відбито розуміння того, що інститути правосуддя і судочинства повинні модернізуватися відповідно до викликів сучасного суспільства, виходячи не тільки з такого очевидного цивілізаційного факту, як фундаменталізація прав людини у межах національного, а й інтернаціонального правопорядків, тому безперечною є необхідність розробки відповідних концептів, що стосуються спадкоємності, традицій і новацій у цивілістичній процесуальній сфері, які б відображали сучасні теоретико-прикладні проблеми науки цивільного процесуального права . Фундаментальною умовою, яка вже зараз визначає і в найближчій перспективі все більше буде визначатиме розвиток процесуального права, є зближення структур національного цивільного процесуального права у зв’язку з глобалізацією, яка, як зауважив професор В. Комаров, проявляється найбільш яскраво саме на прикладі гармонізації цивільного процесу в Європейському Союзу (далі – ЄС), чому саме і присвячена ця стаття.
Професор В. ABOUT ISSUE 2/2019
This AJEE Issue 2 (3) contains research articles related to current topical reforms in the judiciary and procedural legislation development in Ukraine and Poland, prepared by academics and practitioners. The main goal of these reforms directs to increasing the level of trust to justice, as well as to ensure the efficiency and effectiveness in litigation.
Therefore, this Issue starts with a prominent essay written in cooperation by Grzegorz Borkowski from Poland and Olga Sovgyria from Ukraine, investigating various problems of judicial independence ensuring during the recent reforms in both countries and comparing it with the generally acknowledged international and European standards.
The next article is related to one significant issue of the EU and national procedural legislation of Member-States` interaction, in particular, European Small Claims Procedure and Polish civil procedure, prepared by Joanna May and Malgorzata Malczyk.
European Civil Procedure undoubtedly is a significant and fast-developing area of procedural law due to unique possibilities of cross border litigation for all the claimants in all of the EU Member-States courts according to the same procedure. Nevertheless, partly the procedural issues of national legislation play an important role in access to genuine European justice.
One more article in the current Issue is written by Katarzyna Gajda – Roszczynialska related to the interaction of national civil procedure and European civil procedure, in particular, the abuse of procedural rights in Polish and European civil procedure law within the notion of private and public interest.
Procedural law seems quite formal for participants due to all rules and requirements to documents. Will it violate the right to court and access to justice for humans? Agnieszka Golab has answered this question and shared her research results concerning the inadmissibility of civil proceedings and the so-called absolute procedural prerequisites.
The problem of the counteraction to miscarriage of justice in Ukraine is raised in the essay written by Mykhaylo Shepitko. The author highlighted this problem in three ways: from criminal law, criminal procedure and criminalistics`s area sides.
On behalf of the Editorial and Advisory Boards of the Journal, I would like to share our latest achievements, recognized by the well-known databases and the directory: our Journal has been included in the Directory of Open Access Journals (DOAJ), indexed in ERIH Plus and listed in Hein Online.
This surely happened due to the fruitful cooperation of our team and all our prominent authors and reviewers, who help us to develop. We sincerely hope, that this news inspires all of us greatly and we will continue to work diligently!

This AJEE Issue 3 (4) is a special edition, related to the Alternative Dispute Resolution development in Europe. Undoubtedly, that out-of-court peaceful settlement is more attractive and efficient than long-term and exhausting court buttle between parties and their representatives. The current trend of peaceful agreement settlement agreed by both sides of the conflict is much closer to Eastern Europe – there are initiatives of some types of ombudsmen and negotiations introducing. Despite this, not always these ideas are realized in practice due to certain specific features of East-European traditions and non-ended reforms of the judiciary. Find more information about financial ombudsman implementation in Ukraine in the essay written by Roksolana Khanyk-Popsolitak.

The article is devoted to civil procedure evolution in Ukraine. A few large-scale legislative reforms took place during the period of our independence, from 1991 to 2017. The first Civil Procedural Code of Ukraine was adopted in 2004 in the light of a conceptual changes in common approaches to the implementation of justice and the formation of an independent judiciary. Today, Ukraine is on its way into the European Union, so a comprehensive reform of the judicial system and procedural legislation has been implemented, and the main ideas are to ensure the further development and to improve of the implementation of justice, to implement of world standards and common european standards for the protection of the rights. In particular, we are talking about the principle of proportionality, according to which the time and fees spent on the court procedure should correspond to those claims with which a person applicate to a court. The introduction of a general and simplified procedure for the civil matters should be welcomed as an important step towards the effectiveness of civil proceedings. The article compares the action procedure of the current Ukrainian Civil Procedure Code and the main provisions of the Draftlaw on amendments to the Civil Procedural Code of Ukraine and other legislative acts, March 23, 2017, No. 6232. As a result the main directions for its improvement were made and the process of reforming Ukrainian civil procedural law was determined.

Обгрунтовано необхідність узгодження положень вітчизняного цивільного процесуального законодавства з чинним законодавством ЄС та забезпечення судів України правом на зупинення провадження у справі для вирішення питання про доцільність подальшого розгляду справи.

Annotation The article devoted to the new concept of civil procedure and its determining factors. Current stage of development of civil procedure codification changes with the new paradigm of modern society. The interstate organizations and unions became more powerful and influences on the approval of such human and civilization values as the supremacy of law, access to judicial remedy. Now we need to pass to the next stage – regional rules of civil procedure, which could guaranted effective protection of the rights of the participants of the economic relations.

This papers deals with the historical traditions and features of the national model of civil procedure, which was formed on the territory of Ukrainian lands under significant influence of European sources of law, from the time of Kievan Rus', the Polish-Lithuanian period and Hetmanate to contemporary time. The analysis allows to conclude that there are similarities of European and Ukrainian models of civil procedure that could eventually lead to further approximation and integration of Ukraine into a Genuine European area of Justice.
