Ottaviano Cacherano d’Osasco, ... more Taking a cue from a decision of the Senate of Piedmont reported by Ottaviano Cacherano d’Osasco, a legal doctrine is examined, dating back primarily to Pietro d’Ancarano, according to which even in partnerships the liability of partners to third-party creditors should be joint and several, but limited to the share conferred in the share capital. This was contrary to what commercial law and medieval doctrine had always held, namely that partners in partnerships had joint and unlimited liability. The uncertainty generated by this differing opinion created considerable confusion in the modern era, both because of the end of the exclusive jurisdiction over commerce on the part of the corporate courts and the emergence of the new societates per viam accomanditae.

du XIXème siècle ... more L’histoire de la législation mise en place par la France dans la seconde moitié du XIXème siècle pour faire face à la propagation soudaine et dévastatrice d’un parasite de la vigne, le phylloxéra (Daktulosphaira vitifoliae), constitue un cas intéressant d’étude pour évaluer dans quels délais la politique du droit menée par le gouvernement et le parlement était ou non dictée, à l’époque, par les conseils de comités d’experts qui raisonnaient sur des données scientifiques et pour comprendre donc si les conclusions actuelles des Science&-Technology Studies – selon lequel le législateur a toujours en dernier ressort le pouvoir de décision et que les comités scientifiques consultatifs raisonnent souvent non seulement en termes purement techniques, mais aussi en termes politiques – soient également applicables au moins au XIXème siècle, selon l’opinion de l’historien de la science Dominic Pestre.
The history of legislation put in place by France in the second half of the nineteenth century to address the sudden and devastating spread of a vine parasite, the so-called phylloxera (Daktulosphaira vitifoliae), is an interesting case study to assess whether the policy of law conducted by the Government and Parliament was dictated or not, at the time, by the advice of committees of experts who reasoned on scientific data and therefore to understand whether the current conclusions of the Science&Technology Studies, according to which the legislator always has the ultimate decision-making power and the scientific advisory committees often reason not only in purely technical, but also in political terms, are also applicable at least to the 19th century, according to the opinion held by historian of science Dominic Pestre.

Les idées nouvelles remontent de la Péninsule à la faveur des Guerres d’Italie et se diffusent dans les cercles lettrés. La percée de l’hellénisme se fait sentir, non sans susciter de vives réactions de l’Église. L’historiographie française connaît des mutations décisives, avec Thomas Basin et Philippe de Commynes, même si la tendance dominante reste aux grandes chroniques et histoires nationales. In 1865 Italy abandoned the Legal Aid model inherited from the Kingdom of Sardinia, which mixed a... more In 1865 Italy abandoned the Legal Aid model inherited from the Kingdom of Sardinia, which mixed a salaried staff with a pro bono model and switched to an exclusively pro bono model, justifying this change with economic and financial reasons. The new system, however, appeared from his very beginning very lacking, especially since the poor had no chance of being granted a legal advice until a Commission of lawyers and judges decided that his claims were not only reasonable, but also well grounded. Another problem was that every lawyer was obliged by the law to work entirely free of charge for the poor and this undermined frequently his commitment to the clients and their lawsuits. For these reasons, in the beginning of the XX century, some lawyers with a sensitivity for social problems tried to organize associations of motivated professionals, searching for private funding to solve many critical aspects encountered by the legislative model. This paper focused on the history of one of these associations, started in Milan with the help of the Humanitarian Society, a philanthropic institution which aim was to help the poor rising on his own, by programs of education and trainings for employment.

Il volume ripercorre lo sviluppo di una particolare istituzione volta alla difesa processuale deg... more Il volume ripercorre lo sviluppo di una particolare istituzione volta alla difesa processuale degli indigenti, organizzata dal potere pubblico e da questo stipendiata, che potrebbe genericamente essere definita «avvocatura dei poveri». Sebbene le radici lontane di quest’istituto affondino nel diritto canonico e statutario del basso medioevo, finendo per essere recepite dall’imperatore e re di Sicilia Federico II nel «Liber Augustalis» del 1231, la sua continuità nel tempo venne assicurata quasi esclusivamente dai domini sabaudi, nei quali vennero creati, presso ogni tribunale superiore (o Senato), un avvocato e un procuratore dei poveri, più avanti coadiuvati da sostituti, per assicurare la difesa in campo penale, civile e commerciale a chi non fosse stato in grado di pagarsi un avvocato. Tale ufficio, regolamentato con precisione soprattutto dalle «Costituzioni di Sua Maestà» a partire dall'edizione del 1723, sopravvisse fino all’unificazione nazionale, quando, sia per ragioni di praticità e di bilancio, sia per l’opposizione del ceto forense, che ne metteva in dubbio l’imparzialità, soprattutto in campo penale, venne abrogato a favore del patrocinio gratuito, affidato alla buona volontà dei singoli professionisti.
