Negli ultimi anni, la consuetudine del giurista a inglobare il discorso letterario nei suoi metod... more Negli ultimi anni, la consuetudine del giurista a inglobare il discorso letterario nei suoi metodi di indagine si è andata rafforzando anche in Italia, dove giuristi teorici e positivi non faticano ormai ad ammettere che l'universo giuridico non si alimenta solo di regole, principi e istituti, ma anche di raffigurazioni narrative e, in particolare, letterarie. A partire da questa consapevolezza, in questo libro le rappresentazioni letterarie offrono l'occasione per una serie di approfondimenti sulla storia costituzionale italiana, che rivelano quanto lo sguardo del giurista intercetti snodi e problemi che spesso sono stati al centro di una letteratura nazionale attenta più di altre all'osservazione politica e sociale: dalla conformazione ristretta della sua opinione pubblica al peso storicamente avuto dal primato della politica, dal persistere irrisolto di fratture territoriali e sociali a un'identità civica segnata da una cronica debolezza. In questa chiave, i saggi contenuti nel volume cercano di esaminare la peculiarità della storia costituzionale italiana alla luce della prospettiva che su di essa hanno offerto scrittori di varie epoche, dagli inizi della vicenda unitaria sino agli anni più recenti.

Si tratta però di un ritorno sulla scena segnato dalla messa in discussione di quelle categorie fondative, in particolare la rilevanza, la non manifesta infondatezza e la pregiudizialità. La presente ricerca, muovendo dall'idea che il giudizio incidentale non sia un modello ma un canone segnato da insopprimibili margini di flessibilità, si interroga sulla logica dell’incidentalità e sulla sua persistente razionalità nell'attuale fase di cambiamenti della giustizia costituzionale.

This paper discusses the transformations of sovereignty since the decline of the nation-state in ... more This paper discusses the transformations of sovereignty since the decline of the nation-state in Europe. Moving from 1989 as a threshold date, the reconstruction investigates the reconceptualization of sovereignty in the context of the Europeanization of national orders, in order to attempt to reconstruct (at the same time, criticizing it) the alternative between nationalism and constitutional pluralism.
Moving from the analysis of the CJEU case law on the scope of application of the Charter of funda... more Moving from the analysis of the CJEU case law on the scope of application of the Charter of fundamental rights, the essay seeks to reconnect the judicial responses of the Italian Constitutional Court (ICC) on dual preliminarity to the principled reaction to the enlargement of the CJEU jurisdiction. In doing this, the ICC relies on the recources of legal pluralism in order to promote a more structured relationship between catalogues of rights, that are called to interact (and to be jointly enforced by national judges) whenever an internal act is not fully determined by EU rules. In this way, a peculiar form of constitutional pluralism is displayed, according to which the loyalty to EU law is not questioned by the necessity to promote its recasting from the inside of domestic legal systems.
In this article, we appraise an idea of human dignity (HD) as pragmatically oriented to support s... more In this article, we appraise an idea of human dignity (HD) as pragmatically oriented to support social rights claims. By analysing the role of dignitarian arguments in the constitutional-like case law of four European jurisdictions (France, the UK, Italy and Germany), we demonstrate that caution prevails about the possibility of using HD in each of these countries as an ultimate yardstick for upholding social policies. Such findings challenge the assumption that one can grasp HD as a legal notion through a foundational approach. In our view, neither HD reflects any natural or social essence of men and women, nor can it consequently be conceived as the source of universal fundamental rights. Instead, (1) we recommend a notion of HD as a status primarily conceived as a political-institutional (conventional) artefact. Thus, (2) we consequently sustain that dignity may pertain to states too, and we can see it as a way of reciprocating the duty to fair cooperation in a just society. In the same vein, (3) HD works best in the social realm when an expressive function, rather than a defining one, is recognised as its proper function. This aspect helps explain why HD is often called to support other principles in judicial argumentation. This notion of HD seems to us coherent with social rights as relying on a complex institutional arrangement centred on political responsibility and a commitment to social justice. Concerning the assessment of the conditions attached by the states to the enjoyment of welfare benefits, HD tells us that disproportionate sanctions, whose objective appears to be more a way of blackmailing welfare recipients than pursuing an ideal of fair reciprocity, do violate both the institutional dignity of public authorities and that of the persons affected.

Despite the weak parliamentary majorities, a long series of deep-ranging legislative provisions are enacted in that period in the field of civil liberties and social rights: workers, women, mentally diseased persons and other neglected minorities enjoy individual entitlements and benefit from the establishment of a more coherent institutional arrangement of public services in many areas. The essay investigates these evolutions moving from the analysis of five different clusters of rights (workers, family, criminal procedure, right to health and sectorial reforms) and tries to highlight both lights and shades of such reform process.

The contribution explores both the premises of this judicial revolution (to be seen in the transformations affecting direct effect doctrine) and its consequences, with regard in particular to the role of the Charter of fundamental rights of the EU in its relationships with the national constitutions.
