The paper focuses on Symmachus’ Relatio XXVII, that, on the one hand, constitutes a central witness of the destiny of the laws enacted by Valentinian I in the field of public health care and, on the other hand, allows us to reflect on broader issues such as, for example, the relationship between the emperor and his officials or the value of the imperial provisions in late antiquity, particularly towards the end of the fourth century.

Within the complex issue of the relationship between culture and political power in late antiquity, through the analysis of the legislation of the emperor Constantine – who granted immunities and privileges to doctors and professors – and the edictum de professoribus of the emperor Julian, which represent two decisive moments for the fortunes of the school in late antiquity, the paper illustrates similarities and differences between the legislative policies of Constantine and Julian, both extremely attentive to the world of culture and education, that only since Julian’s edict begins to take shape as a real munus publicum.

Starting from the observation of a fact, the absence in the Theodosian Code and the presence only in the Justinian’s Code of a considerable number of constitutions enacted during the time between the empire of Constantine and the date of publication of the Theodosian Code, the paper submits to the attention of scholars the thesis, advanced by Arnaldo Biscardi, of the existence of two versions of the Theodosian Code – an Eastern version, which would be used by Justinian’s compilers to their Code, and a Western version, very different probably because of the interventions of the praxis and the barbarians legislators – and points out at the same time the need for a new survey which privileges the aspects of the textual criticism and the systematics of the codification in order to contribute to rediscover at least partially the original contents of the Theodosian Code.

Through the reconsideration of the few ancient sources that we can have and the analysis of the historiographical positions relating to the Christian character of the Theodosian Code, the paper shows how the thesis that the first official codification would certainly inspired by the Christian ideology has gone through over the centuries, sometimes uncritically, the historiographical reflection and it should therefore be subjected to more stringent checks.
