The Reference of the Supreme Court of Canada Re Secession of Quebec was the first time a tribunal directly addressed unilateral secession. Many international lawyers intervened in the proceedings, helping the Canadian Supreme Court to craft a very clear judgement on this issue. Since 1998, the Reference Re Secession of Quebec has become a classic of international legal literature. Few domestic decisions are quoted so often by international lawyers, and, in fact, the 1998 Canadian Reference played a major role in the written briefs submitted by the states that intervened in the proceedings of the 2010 Advisory Opinion of the International Court of Justice on Kosovo. However, unlike to the Supreme Court of Canada, the ICJ decided not to touch the most significant issues regarding unilateral secession and international law. The last section of the chapter reflects on the legacy of these two important decisions in the light of the many contemporary requests for unilateral secession, including on grounds not foreseen either in Ottawa or at The Hague, such as the so-called right to decide , the principle of stability, and the duty to negotiate between opposing factions.

A first attempt at politicizing the European elections occurred in 2014. Its main pillar was the selection and indication of party candidates to the post of Commission president by the main European political parties and groups. If the Parliament obtains that the first nomination be given to the party candidate of the group with the most seats in the EP, namely Jean-Claude Juncker, it would probably also rally behind that candidate and ensure his election. This would have long-lasting short-, medium- and long-term effects on inter- institutional relations and European integration that need to be considered. The nomination of the next Commission President is thus a fateful choice. It will not only have very significant political and institutional consequences, but will also set up or prevent a social and political dynamics towards the democratization of the EU.

The paper endorses a dynamic rather than a static analysis of the EU at supersystemic level of analysis. It sketches a toolkit to analyse the actors and contents of constitutional politics, exploiting the insights of the main grand theories, based on the interpretative scheme of crisis-initiative-leadership, and the distinction between unification, integration and construction. Applying this toolkit, a trend towards an increase of the EU federal features can be discerned. Eventually, to overcome the current crisis more steps in this direction are needed.

The 2019 European elections are characterised by many novelties and paradoxes: for the first time they have acquired a high political salience, also thanks to the cleavage between nationalist and pro-EU parties. And there is a wider public debate than in the past. However, not all political parties are presenting their Spitzenkandidaten and few have taken a clear position with regards to the struggle between the Parliament and the European Council on which institution really decides the next Commission President. Pro-European and nationalists are much divided and often some forces in one camp have paradoxical positions on some specific issues.
The European elections may have opened a window of opportunity for the re-launch of European integration. This is also due to a specific constellation of national politics in the three largest countries of the EU. But it will not last long.

In launching a new journal we feel the need to explain the reasons why the Centre for Studies on Federalism takes this initiative, characterised by a range of specific features. Several interesting scientific journals in English devoted to federalism are already issued all over the world. They are generally focused on one geographic area in particular, on certain levels of government or on specific academic disciplines. Therefore we believe there is room for a new interdisciplinary journal to consider federalism - federal institutional arrangements as well as potentially federalising processes - at all levels of government. The very name Perspectives on Federalism stresses that the journal will consider federalism from different disciplinary, geographic and theoretical perspectives.
