Luís Roberto Cardoso de Oliveira
BA in Social Sciences at University of Brasilia (1977), Master's degree in Social Anthropology at Federal University of Rio de Janeiro (1981), Master of Arts (in Anthropology) at Harvard University (1984), and Ph.D. in Anthropology also at Harvard University (1989). Former president of the Brazilian Association of Anthropology (2006-2008) and currently full Professor of Anthropology in the Department of Anthropology and in the Graduate School of Law at the University of Brasilia. He is currently the Director of the Institute of Social Sciences (ICS) in the same University. Was a visiting researcher at Université de Montréal, in Canada (1995-1996), at Maison des Sciences de l'Homme, in France (2006) and also visiting professor at Université Diderot Paris 7, Sorbonne Paris Cité (Feb-March 2012). He is also the Deputy chair of the Institute of Comparative Studies on Institutional Administration of Conflicts (INCT-InEAC), based in Rio de Janeiro. Co-editor of Anuário Antropológico from 2002 to 2015. Main research interests are citizenship rights, conflicts, democracy, and the politics of recognition. Has done fieldwork in Brazil, the United States, Canada (Quebec) and France.

ste livro é produto de três anos de debates no grupo Sociologia e Antropologia da Moral, primeiramente na forma de Seminário Temático, posteriormente como Grupo de Trabalho, no âmbito dos encontros anuais da Associação Nacional de Pós-Graduação e Pesquisa em Ciências Sociais (Anpocs). Tínhamos como objetivo nesses encontros estimular pesquisas e discussões sobre as possibilidades de tomar a moral e a moralidade como focos privilegiados de estudo pelas ciências sociais. Ao longo desse período, consolidou-se toda uma nova agenda de debates sobre como diferentes dimensões da vida social podem ser lidas sob a ótica da questão da moral ou de questões de ordem moral, no sentido amplo do termo, e de maneira dissociada de perspectivas moralistas ou normativistas, orientadas por parâmetros predefinidos sobre o dever ser.

This dossier is a product of ethnographic research efforts focused on our institutions of Justice during the last three decades. Most of these were made from an interdisciplinary perspective, putting together Anthropologists, Sociologists and Legal Scholars. The emphasis on empirical research, characteristic of the social sciences, and strange to the teaching of Law in Brazil, brings to the fore a highly reflexive look at the functioning of the judiciary broadly speaking, aiming to reach a deeper understanding of meaningful questions for the field.
The text discusses the place of ethical-moral rights in processes of conflict management and in demands for citizenship rights from a comparative perspective. Drawing on cases brought to small claims courts in the US, demands for recognition in Quebec, and patterns of inequality of treatment in Brazil, the text reflects upon the importance of these rights and the respective difficulties to redress them adequately.
O texto discute o lugar dos direitos ético-morais em processos de administração de conflitos e em demandas por direitos de cidadania em perspectiva comparada. Tendo como referência casos acionados em juizado de pequenas causas nos EUA, demandas de reconhecimento no Quebec, e padrões de desigualdade de tratamento no Brasil, o texto reflete sobre a importância dos direitos ético-morais, e respectivas dificuldades para viabilizar a reparação satisfatória destes direitos.
This article aims to examine the perceptions of lawyers about the production of evidence in rural retirement lawsuits that are being processed by the Federal Special Courts (JEFs), in Sobral, Brazil. We found, from the observation of hearings and interviews with lawyers who work at the JEFs, that the procedural practices in this context have markedly inquisitorial traits, and we also identified that three forms of evidence production structure the rural retirement lawsuits, engendering a flexible probationary tripod, which is articulated and meant in different ways by lawyers and judges. Through this tripod, these procedural actors prepare a judicial biography of the peasants, in order to determine who should be recognized - or not - the right to rural retirement.

This article develops the concept of civic sensibility to discuss the idea of citizen equality with a focus on Brazil. Referring to demands for respect and consideration or recognition, the text proposes that citizen equality, wherever it takes place, is always modulated by the relation between rights, status and dignity, shaping local civic sensibilities, characterized by a certain sense of dignified treatment, which does not make the interlocutor inferior in his or her dignity.
