PEN AND PENCIL HOLDER.
Application filed October 9, 1928. Serial No. 311,358.
This invention relates to a holder for pens and pencils and has for its object to provide,
in a manner as hereinafter set forth a holder of such class including means for detachably securing it in the pocket of a garment and further having means for detachably clamping pens and pencils therewith whereby these latter are retained close to a persons body and further whereby the pen and pencil points are protected when secured to the holder.
A further object of the invention is to provide, in a manner as hereinafter set forth, a holder for detachably securing a pen or pencil with a garment in a manner to prevent the soiling of the latter.
A further object of the invention is to provide, in a manner as hereinafter set forth, a holder for detachably securing a pen or pencil within the pocket of a garment and in a manner to prevent injury to a person from the pen or pencil point.
A further object of the invention is to provide, in a manner as hereinafter set forth a holder for detachably securing a pen and pen 2 oil to a garment in a convenient position to be disconnected when desired for use and with the pen or pencil points enclosed to protect the same.
Further objects of the invention are to provide, in a manner as hereinafter set forth, a holder for the purpose referred to which is simple in its construction and arrangement, strong, durable, compact, thoroughly efiicient in its use, conveniently installed within the pocket of a garment, having means to prov de for expeditiously and removably'connectmg a pen or pencil therewith and inexpenslve to manufacture.
' With the foregoing and other objects in view the invention consists of the novel construction, combination and arrangement of parts as hereinafter more specifically described, and illustrated in the accompanying drawings, wherein is shown an embodiment of the invention, but it is to be understood that changes, variations and modifications can be resorted to which fall within the scope of the claims hereunto appended.

The holder includes an open top tapered receiver formed of any suitable material, light in Weight and possessing the desired rigidity. The recelver comprises a pair of end walls 1, 2, a pair of side Walls 3, 4;, and a bottom 5.
The receiver is formed preferably from a single piece of material. The receiver is of greater length thanwidth and is formed preferably with rounded corners. The receiver is adapted to be positioned in the pocket of a garment and is of a size as to, snugly fit the Walls thereof. The height of the receiver is materially less than the depth of the pocket in which it is mounted.'
Each of the end walls is slitted as at 6, 7 and 8. The slit 7 is arranged below and spaced from the slit 6 and the slit 8 is arranged below and spaced from the slit 7. The material of the end wall between the slits 6 and 7 is forced outwardly to provide a retainer as indicated at 9. The end wall below theslit 8 is also forced outwardly to provide a retainer as indicated at 10.
Connected to each end wall of the receiver, as well as projecting a substantial distance from the top thereof is a securing member referred to generally at 11. The end walls 1, 2
extend from the bottom to the top thereof at an outward inclination and the securing members 11 are disposed in a like manner. Each securing member consists of a flat spring 12 of strap-like form and of the desired length and each spring. has its upper. end fixed to a rubber tip 13 having a flat bottom and the remaining portion rounded. The top projects from and in a lateral direction from the upper end of the spring. The rubber tips are indicated at 13. The spring extends down through the retainer 6 and against the inner face of the retainer 10. When the receiver is positioned in the pocket the securing members coact with opposed wallsof the latter for retaining the receiver within the pocket. The slits formed in the end walls and in connection with the retainers 9, 1O bind the members 11 to the end walls of the receiver.
Mounted on the top of the receiver is a clamping element formed from resilient material and possessing" the necessary elasticity to pie-rise when; in engegementitith a or pencil to detachably clamp the latter to the receiver. The clamping element is referred to generally at 14 and is preferably formed of a strip of rubber. The clamping element is flanged at each side as at 15. The side flanges of the element 14 depend and are secured to the outer face of the side walls of the receiver. The ends of the element 14 are flush with the end walls of the receiver. The element 14 is also secured upon the top edges of the sides and end walls of the receiver. The element 14 is provided with a spaced row of openings 16 substantially ovalin contour and said element 14 is furthermore provided with a lengthwise extending slit 17 which intersects the openings 16. The slit 17 projects from the outer openings of the row of openings 16. The slit 17 forms the wall of each opening into a pair of clamping jaws.
The pen or pencil is adapted to be forced through an opening 16 and the jaws formed by the wall of the opening will grip the pen or pencil and retain it inthe dotted position shown. The pen points or the pointed ends of the pencils are positioned within the receiver, under the element 14 whereby they are protected thereby so thatthey cannot be damaged. By detachably securing the pens or pencils in the manner as illustrated in dotted lines the points thereof are enclosed within the receiver, under such conditions cannot injure anyone, as would be the case if the pointed ends were in a reverse position with respect to that as shown, or rather projected from the pocket in which the holder is arranged. The members 11 function as anchors to retain the holder within the pocket of the garment and this function is had by thetips 13 coactingwith the material of the opposed walls of the pocket, which prevents the withdrawal of the holder when one attempts to remove a pen or pencil therefrom. The members 11 are of a length to be concealed in the pocket.
It is thought the many advantages of a holder for the purpose referred to and in accordance with this invention, can be readily understood, and although the preferred embodiment of the invention is as illustrated and described, yet it is to be understood that changes in the details of construction can be had which fall within the scope of the invention as claimed.
What I claim is:
1. A pen and pencil holder comprising an open top receiver, a flat clamping element secured across the open top of the receiver and being formed with means for detachably clamping a pen or pencil extending therethrough into the receiver, and means at the ends of the receiver for anchoring it within the pocket of a garment.
2. A pen and pencil holder comprising an open top receiver, a flat clamping element secured across the open top of the receiver and being formed with means for detachably clamping a pen or pencil extending therethrough into the receiver, and means at the ends of the receiver for anchoring it within the pocket of a garment, said means consisting of thewalls of spaced openings intersected by slits formed lengthwise of said element. 3. A pen and pencil holder comprising an open top receiver, a fiat, resilient clamping element secured across the open top of the receiver and being formed with means for detachably clamping a pen or pencil extending therethrough into the receiver, and means at the ends of the receiver for anchoring it within the pocket of a garment, said receiver being of tapered cross section and having the ends thereof extending outwardly at an inclination from the bottom to the top. 4. A pen and pencil holder comprising an open top receiver, a clamping element secured upon the top of the latter and being formed with means for detachably clamping pen or pencil extending therethrough with the receiver, said receiver having the ends thereof slitted, and means extending through the slits at the ends of the receiver for anchoring the latter within the pocket of a garment.
5. A pen and pencil holder comprising an open top receiver, a clamping element secured upon the top of the latter and being formed with means for detachably clamping a pen or pencil extending therethrough with the receiver, said receiver having the ends thereof slitted, and means extending through the slits at the ends of the receiver for anchoring the latter within the pocket of a garment, said clamping element formed throughout of elastic material and said means consisting of the walls of a plurality of spaced openings intersected by a slit disposed lengthwise of the element.
6. A pen and pencil holder comprising an open top receiver, a clamping element secured upon the top of the latter and being formed with means for detachably clamping a pen or pencil extending therethrough with the receiver, said receiver having the ends thereof slitted, means extending through the slits at the ends of the receiver for anchoring the latter within the pocket of a garment, and said receiver being of tapered cross section and having the end walls thereof disposed at an inclination from bottom to top whereby the anchoring means will be disposed at an inclination with respect to the receiver.
7. A'pen and pencil holder comprising an open top receiver, a resilient clamping element secured across the top of the latter and being formed with means for detachably clamping a pen or pencil extending there through into the receiver, and means secured to the ends of the receiver and projecting upwardly therefrom for anchoring the receiver within thepocket of a garment.
8. A pen and pencil holdercomprising an open top receiver, a resilient clamping element secured across the top of the receiver and being formed with means for detachably clamping a pen or pencil extending therethrough with the receiver, and upstanding means secured to the ends of the receiver and projecting upwardly therefrom for anchoring the receiver within the pocket of a garment, said anchoring means being resilient and provided at the top with tips.
9. A pen and pencil holder comprising an open top receiver, a flat, resilient clamping element secured upon the top of the latter and being formed with openings and slits to provide opposed clamping jaws for detachably clamping a pen or pencil extending there through into the receiver, and means extended upwardly from each end of the receiver for anchoring it within the pocket of a garment.
10. A pen and pencil holder comprising an open top receiver, and aflat, resilient clamping element mounted upon the top edges of and secured to the sides of the receiver, said element formed with a row of spaced openings and a lengthwise extending slit intersected by said openings, said slit and openings coacting to provide clamping means for the pens and pencils when extended through said element.
11. A pen and pencil holder comprising an open top receiver, a flat, resilient clamping element mounted on the top edges of and secured to the sides of the receiver, said element formed with a row of spaced openings and a lengthwise extending slit intersected by said openings, to provide clamping means for the pens and pencils when extended through said element, and means connected with the receiver for anchoring it within the pocket of a garment.
12. A pen and pencil holder comprising an open top receiver, a clamping element mounted on the top edges of and secured to the sides of the receiver, said element formed with a row of spaced openings and a lengthwise extending slit intersected by said openings to provide clamping means for pens and pencils when extended through said element, and means connected with the receiver for anchoring it within the pocket of a garment, said means being resilient.
13. A pen and pencil holder comprising an Open top receiver having side and end walls and a bottom, resilient clamping means for pens and pencils secured to said sides of the receiver, said receiver having the ends thereof slitted, and means extending through the slits at said ends of the receiver for anchoring the latter within the pocket of a garment.

A pen and pencil holder comprising an open top receiver having side and end walls and a bottom, resilient clamping means for pens and pencils secured to said sides of the receiver, said receiver having the ends thereof slitted, and means extending through the slits at said ends of the receiver for anchoring the latter within the pocket of a garment, said anchoring means projecting above said receiver, being resilient and provided at the upper ends thereof with tips.
