Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement El presente informe se realiza sobre la solicitud de patente ES201331016 que consta de 12 reivindicaciones. El objeto de la invención es un precinto higiénico para envases. En el Estado de la Técnica hallamos numerosos documentos que divulgan precintos higiénicos para envases, que comprenden una tapa superior y un anillo inferior acoplados de forma articulada que presentan ciertas características entre las citadas en la solicitud, como por ejemplo: medios de posicionamiento y apriete, precintos de garantía, bisagras con agujero pasante y mecanismos de bloqueo y materiales plásticos. Ninguno de ellos muestran unos medios de posicionamiento comprendidos por al menos un rebaje en el reborde superior del anillo inferior complementario con un resalte que sobresale interiormente de la cara interior de la extensión, la cual además presenta unos medios de apriete capaces de estar en contacto con el anillo inferior en una condición de cierre del envase cuando el resalte y el rebaje están en contacto entre sí. El documento D01 muestra la divulgación de la invención en internet en la que se aprecian los rebajes del anillo, pero no cita más información sobre el cierre. El documento D02 (resumen, párrafos 4, 63 a 66 y figuras 8 y 9) muestra un cierre compuesto por un medio de posicionamiento comprendido por un resalte en el anillo complementario con un resalte que sobresale interiormente de la cara interior de la extensión, la cual además presenta unos medios de apriete capaces de estar en contacto con el anillo inferior en una condición de cierre del envase cuando los resaltes están en contacto entre sí. Los documentos D03 y D4 (reivindicaciones y figuras) del mismo solicitante, muestran sendos precintos higiénicos, detallando el primero el precinto de garantía y el segundo el sistema de bloqueo reivindicado. Los documentos D05 a D7 divulgan otros tipos de precintos higiénicos. El primero dispone de unos medios de apriete bajo el borde inferior del anillo, el segundo sobre el borde superior y el tercero muestra un sistema que emplea medios de posicionamiento y apriete complementarios directamente aplicados sobre la lata. Ninguno de los documentos citados muestra una disposición como la descrita en la reivindicación 1, en consecuencia no pueden ser considerados como anterioridades. Por otra parte no resulta obvio que, a partir de dichos documentos, un experto en la materia pudiera concebir una disposición similar, por tanto se puede considerar que es nueva, implica actividad inventiva y tiene aplicación industrial de acuerdo con los artículos 6, 8 y 9 de las ley 11/1986 de 20 de marzo. In the State of the Art we find numerous documents that disclose hygienic seals for containers, which comprise an upper lid and an articulated-coupled lower ring that have certain characteristics among those mentioned in the application, such as: positioning and tightening means, warranty seals, hinges with through hole and locking mechanisms and plastic materials. None of them show positioning means comprised of at least one recess in the upper flange of the complementary lower ring with a projection protruding internally from the inner face of the extension, which also has a clamping means capable of being in contact with the lower ring in a closed condition of the container when the projection and the recess are in contact with each other. Document D01 shows the disclosure of the invention on the internet in which the recesses of the ring are appreciated, but does not cite more information about the closure. Document D02 (summary, paragraphs 4, 63 to 66 and figures 8 and 9) shows a closure consisting of a positioning means comprised of a shoulder in the complementary ring with a shoulder protruding internally from the inner face of the extension, the which also has tightening means capable of being in contact with the lower ring in a closed condition of the container when the projections are in contact with each other. Documents D03 and D4 (claims and figures) of the same applicant, show separate hygienic seals, the first detailing the warranty seal and the second the claimed locking system. Documents D05 to D7 disclose other types of hygienic seals. The first has a means of tightening under the lower edge of the ring, the second on the upper edge and the third shows a system that employs complementary positioning and tightening means directly applied on the can. None of the documents cited shows an arrangement as described in claim 1, therefore they cannot be considered as prior. On the other hand, it is not obvious that, from these documents, a person skilled in the art could conceive a similar provision, therefore it can be considered that it is new, implies inventive activity and has industrial application in accordance with articles 6, 8 and 9 of Law 11/1986 of March 20.
