2. Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement

The object of the invention is a tool conveyor device applicable to a mixed backhoe or Similary.

The mixed backhoe machines have two articulated arms, one of them usually incorporates a spoon and the Another, another tool. When these machines move from one place to another, the tool is usually disassembled and transported inside the spoon.

The inventor proposes a tool-spoon clamping device, in order to prevent the fall of said tool during transportation

The request consists of 7 claims, the 1st being independent and the rest dependent. The first claim describes the essential technical characteristics of the invention. The second claim specifies a type of articulated fixing means between spoon and device. The third claim, refers to an alternative fixing means, by additional bar joined by welding to spoon. The 4th claim refers to the articulated means of attachment of the device to the tool. The 5th claim refers to an articulated joint alternative between device and tool. The 6th claim relates to a device-spoon fixing system, when it is not being used. The 7th claim describes the elements of said system.

Of the documents cited in the State of the Art Report, it is considered the closest to the invention, the US4790084 (DO1).

DO1 discloses a tool conveyor device (40), comprising a central body (44) at whose ends it is contemplate means (46,60), to be fixed articulated, on the one hand to a spoon (14), coupled to a mixed machine backhoe, and on the contrary, to another tool (16). (See Fig. 6)

The difference between the 1st claim and DO1 is that DO1 does not disclose that the device is metallic. However the constituent material of the device, is the result of its design, function among others of the breakage limit, elastic, etc.

As for claim 2, DO1 discloses an alternative of articulated joint to a clamp holder bar (46), equivalent to claimed.

The third claim is not disclosed in DO1.

As for the 4th and 5th claims, DO1 discloses alternative joint articulation equivalent to both, valid with both removable and fixed bolt.

The 6th and 7th claims are not disclosed in DO1.

Thus:

- Claims 1, 2, 4 and 5 are new but lack inventive activity. (Art. 6 and 8 of Patent Law 11/1986)

- Claims 3, 6 and 7 are new and have inventive activity. (Art. 6 and 8 of Patent Law 11/1986)
