Abstract

A system and method for accessing and managing information relating to lands under forced sale includes a Host comprising a database and a user interface, a realtor computer for interfacing with the Host and for inputting into the Host database information relating to lands under forced sale, a data consumer computer for interfacing with the Host to obtain information relating to lands under forced sale, and an electronic communication network connecting, at least intermittently, the Host realtor computer, and data consumer computer. In addition, a method is provided of generating and saving a query in an on-line database wherein contact between a user computer and a Host database is established via an electronic communication network through a Host user interface, a query is entered by the user computer against the Host database, the Host database stores the query as a record in the database, and wherein the Host automatically notifies, through an electronic communication network such as the Internet, the user computer when the conditions of the query are satisfied by data within the Host database. The system and method provide a data consumer with the ability to remotely request data relating to lands for sale under forced sale, and have that query stored as a record in an on-line database. The method and system further provide realtors including mortgagees and insurance companies with the ability to populate a remote database for storing and managing information relating to lands for sale by forced sale, and further obtaining statistics related to such lands for sale.

Description

System and method for remote access and management of information relating to lands under forced sale.
FIELD OF INVENTION
This invention relates to the on-line access and management of information relating to lands being sold under forced sale, and more specifically to systems and methods which include a database and applications allowing users to be notified when database query conditions are met, together with additional applications for intelligently managing and editing the information contained within such a database.
BACKGROUND OF THE INVENTION
It is desirable to have the ability to remotely access data relating to lands for sale under forced sale. It is further desirable to have the ability to remotely enter information relating to lands under forced sale into a remote database for display to the public at large, such that new data can be quickly accessed through an electronic communication network such as the Internet. It is further desirable to manage such data so that inputting agents such as realtors or mortgagees can edit the data ad hoc, and are further prompted by a remote Host to edit the data at specified intervals. Statistics are extremely useful to realtors and practitioners such as lawyers, bailiffs, mortgage brokers, receivers, and trustees who want to know the status of lands for sale listed and accordingly it is desirable to provide statistics to such realtors or practitioners either on demand, or automatically upon initial request for same.
It is further desirable to permit a data consumer, such as a member of the public or a practitioner to enter a query against a database for data relating to lands for sale, and save that query as a record in the database, such that the database Host can notify the data consumer when the query conditions are met by existing or new data entered into the database.
Prior art systems have been devised to address some of the issues of remote access and management of certain information, however, each of these prior art systems fails to overcome the problems noted above and further has limitations and drawbacks which preclude their widespread use. For example, systems are known in the art which permit a data consumer to access information contained in a remote database relating to lands for sale.
However, prior art systems do not permit access or input of data relating to lands that are restricted to lands under forced sale. Furthermore, none of the prior art systems permit inputting realtors to manipulate the data relating to specified lands under forced sale, nor do they automatically notify realtors with information regarding statistics relating to particular lands under forced sale.

Furthermore, in prior art systems, data consumers wishing to identify lands under forced sale were required to individually contact individual lending institutions, which would then refer the enquirer to multiple land realtors who acted as the listing agents for such lands.
Other systems in the prior art include systems which permit data consumers to enter queries against a remote database via on-line Internet connection. Such systems typically require the data consumer to enter a query and then that query is run against a remote database. If the query conditions are not met, then the database responds to the data consumer that there is no data which fits the specified query conditions. The data consumer is then left to make subsequent additional queries, using the same query conditions, to determine if the database has been populated with data that satisfies the query conditions at a later date. The limitation of such art is that it requires the data consumer to make multiple identical queries to find information which may be entered into the database at any time. When time is of the essence, for example in a situation where lands are listed for sale, it is important to have the ability to be notified exactly when query conditions respecting lands for sale are met.
SUMMARY OF THE INVENTION
The object of the present invention is to provide an improved system and method for remote access and management of information relating to lands under forced sale. In accordance with an aspect of the present invention there is provided a system comprising a Host, which includes a Host database and Host user interface as well as a Host server, at least one realtor including a mortgagee for populating the Host database with data, at least one data consumer or practitioner for accessing the data in the Host database, and an electronic communication network connecting the Host to the realtor and the Host to the data consumer or practitioner. The electronic communication network may include a wired or wireless connection via the Internet, world wide web, local area network (LAN) or other electronic network connection. The Host user interface may include a Host website posted on the Internet, and such websites may include applications which help to manage the information stored in the Host database. A
practitioner may include bailiffs, lawyers, mortgagees, receivers, trustees, or other individuals or corporations which require access to information relating to lands which are for sale under forced sale. Data consumers may be defined as purchasers, individuals interested in purchasing such lands, or practitioners. Realtors include individual realtors, brokers, mortgagees, lenders, and the like.

Forced sale may be defined as a sale which is not voluntary, and is by way of a creditor's action, such as a sale to satisfy a debt, whether a mortgage, a judgment, tax lien, or other debt. A forced sale may include a sale by way of power of sale or by foreclosure.
The advantages of a system and method for remote access and management of information relating to lands under forced sale include the broader exposure to potential purchasers than such sales traditionally had. With such an exposure, listing agents and vendors of lands under forced sale may be able to more easily defend actions based on improvident sale.
Furthermore, the system includes means by which a data consumer may enter a query, which query is saved as a record in the database. Once the query conditions are met by data which is existing or subsequently added to the database, the Host automatically notifies the data consumer that the query conditions are met, and that the particular conditions of the lands the data consumer is searching for are now available.
In accordance with an aspect of the present invention, users will have the ability to search listings of lands under forced sale, and make inquiries against land listings that they may have interest in. The system provides a number of different search modes including a text based search, a map based search which will permit users to zoom in on specific lands that they are interested in without having to click through several pages, and a menu based navigation where the user chooses a province from a list, is then taken to a page showing cities, and then a further list of choices listing neighbourhoods within a selected city. At each step within the above three example modes of navigation, random or featured listings within that area can be shown to the user on the Host user interface.
A further advantage in accordance with an aspect of the present invention includes the ability for users to enter search criteria as a record into the Host database. Such users may choose to be notified via an electronic communication network message handling system, such as e-mail, by the Host when lands meeting the query conditions become available and are entered into the Host database. Conditions that may be entered by data consumers include property type, building type, zoning, postal code, price range, and other conditions relevant to the purchase of lands.
In accordance with a further aspect of the present invention, realtors and practitioners may have access to particulars respecting specific data consumers, as data consumers are required to log on to access Host database information. Inputting agents may also view statistics respecting specified lands under forced sale, for example the number of views or click throughs, number of times the land listing appears in the user search results, number of times the land listing is viewed in details, number of inquiries sent to a specified realtor regarding the land listing, and other information taken in relation to such specified lands. Inputting agents may be permitted to post advertisements on the Host user interface.
The Host will notify the realtor via e-mail when a new land listing relating to that realtor is placed on the Host database. Realtor access may be restricted to specified levels which may include countrywide, by province, or by individual listing, or more specified levels of access.
Realtors are able to enter data relating to lands under forced sale into the Host database. The realtor has the option to define the data relating to the lands that are for sale in a number of ways, for example, by filling in fields including neighbourhood, province, acreage, price, and the like.
The realtor can set automatic discounts of the price of the lands by pre-determined time interval.
For example, if the land remains unpurchased for 'x' number of days, the offer price will be reduced by 'y' % or by 'z' dollars every 'n' days, and this function is performed by the Host at the request of the realtor. Realtors are also able to update and modify the data in the Host database.
Realtors will create a customer account before entering data into the Host database respecting lands under forced sale. Various levels of account may be created including a national account or a province-wide account. Furthermore, accounts may be created primarily for statistical viewing only, rather than entry of database information. A national account, for example, can view statistics for all listings that a realtor is involved with including the number of current listings, the number of new listings, number of inactive listings, number of listings sold, a table of information showing statistics regarding the user traffic entered against a particular listing on a listing by listing basis, and the like.
The Host may send a weekly summary by way of e-mail, or other electronic communication device to realtors including an overview of account activity including the statistics shown by example above. The Host can create accounts for individual users, together with group users, each with individualized access characteristics to the Host user interface and Host database. The Host monitors data entry into the Host database and approves information submitted to the Host user interface by realtors.
Therefore, this invention seeks to provide a system for accessing and managing information relating to lands under forced sale comprising:

a. a Host for storing and managing information relating to lands for sale by forced sale comprising a database and a user interface;
b. at least one realtor computer for interfacing with said Host and inputting into said Host database information relating to lands under forced sale;
c. at least one data consumer computer for interfacing with said Host to obtain information from said Host database relating to lands under forced sale;
d. an electronic communication network connecting, at least intermittently, said Host, data consumer computer, and realtor computer.
This invention further seeks to provide a method of generating and saving a query in an on-line database comprising the steps of a. establishing contact between a user computer and a Host, said Host comprising a database and a user interface, via an electronic communication network;
b. said user computer entering a query against said database;
c. said Host storing said query as a record in said database;
d. said Host automatically notifying, through said electronic communication network, said user computer when the conditions of said query are satisfied by data within said database.
This invention further seeks to provide a method of accessing and managing information relating to lands under forced sale comprising the steps of a. establishing contact between realtor computer and a Host, said Host comprising a Host database and a Host user interface, via an electronic communication network;
b. said realtor computer populating said Host database with data relating to lands under forced sale;
c. establishing contact between a data consumer computer and said Host via an electronic communication network;
d. said data consumer computer accessing said Host database by querying said Host database for data relating to lands under forced sale wherein said Host returns information to said data consumer computer relating to said query.
BRIEF DESCRIPTION OF THE DRAWINGS
The invention will further be described with reference to the attached drawings showing an embodiment thereof - Figure I is a block diagram showing the system employed in the system for remote access and management of information relating to lands under forced sale in accordance with an embodiment of the present invention.
- Figure 2 is a flowchart illustrating a system and method for generating a query by a data consumer against a Host database in accordance with an embodiment of the present invention.
- Figure 3 is a flowchart illustrating a system and method for populating and viewing data within the Host database in accordance with an embodiment of the present invention.
- Figure 4 is a schematic diagram illustrating the various functions available to four levels of users of the Host database in accordance with an embodiment of the present invention.
DETAILED DESCRIPTION OF THE PREFERRED EMBODIMENT
Referring to Figs. 1 through 4, there is provided in accordance with an aspect of the present invention a system comprising a Host, which includes a Host database and Host user interface as well as a Host server, at least one realtor including a mortgagee for populating the Host database with data, at least one data consumer or practitioner for accessing the data in the Host database, and an electronic communication network connecting the Host to the realtor and the Host to the data consumer or practitioner. The electronic communication network may include a wired or wireless connection via the Internet, world wide web, local area network (LAN) or other electronic network connection. The Host user interface may include a Host website posted on the Internet, and such websites may include applications which help to manage the information stored in the Host database. A practitioner may include bailiffs, lawyers, mortgagees, receivers, trustees, or other individuals or corporations which require access to information relating to lands which are for sale under forced sale. Data consumers may be defined as purchasers, individuals interested in purchasing such lands, or practitioners. Realtors include individual realtors, brokers, mortgagees, lenders, and the like.

Forced sale may be defined as a sale which is not voluntary, and is by way of a creditor's action, such as a sale to satisfy a debt, whether a mortgage, a judgment, tax lien, or other debt. A forced sale may include a sale by way of power of sale or by foreclosure.
The advantages of a system and method for remote access and management of information relating to lands under forced sale include the broader exposure to potential purchasers than such sales traditionally had. In accordance with an aspect of the present invention, users will have the ability to search listings of lands under forced sale, and make inquiries against land listings that they may have interest in. In accordance with a further aspect of the present invention, realtors and practitioners may have access to particulars respecting specific data consumers, as data consumers are required to log on to access Host database information. The Host may send a weekly summary by way of e-mail, or other electronic communication device to realtors including an overview of account activity including the statistics shown by example above. The Host can create accounts for individual users, together with group users, each with individualized access characteristics to the Host user interface and Host database. The Host monitors data entry into the Host database and approves information submitted to the Host user interface by realtors.
The many features and advantages of the invention are apparent from these specifications, and thus, it is intended by the appended claims to cover all such features and advantages of the invention which fall within the true spirit and scope of the invention.
Further, since numerous modifications and variations will readily occur to those skilled in the art, it is not desired to limit the invention to the exact construction and operation illustrated and described, and accordingly, all suitable modifications and equivalence may be resorted to falling within the scope of the invention.

Claims (14)

1. A system for accessing and managing information relating to lands under forced sale comprising:
a. a Host for storing and managing information relating to lands for sale by forced sale comprising a database and a user interface;
b. at least one realtor computer for interfacing with said Host and inputting into said Host database information relating to lands under forced sale;
c. at least one data consumer computer for interfacing with said Host to obtain information from said Host database relating to lands under forced sale;
d. an electronic communication network connecting, at least intermittently, said Host, data consumer computer, and realtor computer.
2. A system for accessing and managing information relating to lands under forced sale as claimed in Claim 1 wherein said electronic communication network is the Internet.
3. A system for accessing and managing information relating to lands under forced sale as claimed in Claim 1 wherein said Host automatically reviews records within said Host database relating to lands under forced sale and automatically forwards electronic communications to said at least realtor computer showing information relating to lands under forced sale.
4. A system for accessing and managing information relating to lands under forced sale as claimed in Claim 3 wherein said information relating to lands under forced sale forwarded to said realtor computer includes statistics respecting the number of times a specified record in relation to a parcel of land in said Host database is accessed.
5. A system for accessing and managing information relating to lands under forced sale as in Claim 1 wherein said realtor computer may instruct said Host to reduce the sale price of specified lands under forced sale by specified amounts and over specified intervals of time.
6. A system for accessing and managing information relating to lands under forced sale as claimed in Claim 1 wherein said Host automatically notifies said realtor computer that specified records entered into said Host database by said realtor computer have not been edited over a specified period of time.
7. A method of generating and saving a query in an on-line database comprising the steps of:

a. establishing contact between a user computer and a Host, said Host comprising a database and a user interface, via an electronic communication network;
b. said user computer entering a query against said database;
c. said Host storing said query as a record in said database;
d. said Host automatically notifying, through said electronic communication network, said user computer when the conditions of said query are satisfied by data within said database.
8. A method of generating and saving a query in a on-line database as claimed in Claim 7 wherein said Host prompts said user computer to enter said query as a record within said database when said query initially fails to retrieve data satisfying said query conditions.
9. A method of generating and saving a query in a on-line database as claimed in Claim 7 wherein said electronic communication network is the Internet.
10. A method of generating and saving a query in a on-line database as claimed in Claim 7 wherein said Host notifies said user computer when the conditions of said query are met by electronic mail.
11. A method of generating and saving a query in a on-line database as claimed in Claim 7 wherein said database is populated with data relating to lands for sale.
12. A method of generating and saving a query in a on-line database as claimed in Claim 7 wherein said database is populated with data relating to lands for sale under forced sale.
13. A system for accessing and managing information relating to lands under forced sale as claimed in Claim 1 wherein said Host database stores said query from said data consumer computer as a record in said Host database and notifies, via said electronic communication network, said data consumer computer when the conditions of said query are satisfied by the data within said Host database.
14. A method of accessing and managing information relating to lands under forced sale comprising the steps of:

a. establishing contact between realtor computer and a Host, said Host comprising a Host database and a Host user interface, via an electronic communication network;
b. said realtor computer populating said Host database with data relating to lands under forced sale;
c. establishing contact between a data consumer computer and said Host via an electronic communication network;
d. said data consumer computer accessing said Host database by querying said Host database for data relating to lands under forced sale wherein said Host returns information to said data consumer computer relating to said query.
