Estado da técnica [002] A referida patente apresenta grande distinção quando comparado com qualquer outro produto similar conhecido até o momento, guardando entre si característica distintiva preponderante, singularidade, tecnologia inovadora e original, com princípios diferenciados em relação aos demais. [003] As bainhas encontradas no mercado apresentam o formato e construtividade que de certa forma expõe o usuário, principalmente os cortadores de cana-de-açúcar, em perigo tanto na armazenagem quanto na retirada da ferramenta de corte da bainha. [004] Neste sentido podemos citar o documento de patente US 3,958,330, que revela uma bainha (capa) para facas que exige do usuário o movimento de deslizamento no sentido do fio de corte para introduzir ou retirar a lâmina do alojamento, movimento este que por muitas vezes ocasiona acidentes com as mãos do usuário. [005] Para a bainha objeto da solicitação do pedido de patente, esse tipo de movimento utilizado para acondicionar a lâmina é totalmente eliminado, não expondo o usuário ao referido deslizamento da lâmina, pois, devido a ter o formato de uma carteira, ao invés de introduzir ela acondiciona a lâmina sem expor a mão do usuário no fio de corte. É importante ressaltar ainda que o formato tipo carteira do pedido de patente em questão proporciona que a aba de fechamento da bainha seja utilizada como guia para a lâmina que vai ser acondicionada, eliminando assim qualquer risco de um possível acidente ou possibilidade de alojar a lâmina acidentalmente para o exterior da bainha, o que fatalmente causaria o encontro da lâmina com a mão do usuário. [006] Vantajosamente o pedido de patente ora requerido apresenta uma forma de acondicionamento onde a ferramenta de corte é acondicionada na bainha pelo lado oposto do fio de corte, contribuindo ainda mais para evitar acidentes. [022] Embora sejam apresentadas algumas variantes construtivas ou configurativas do produto reivindicado como patente, as quais são: uso alternativo de velcro e botão de pressão, ou uma combinação deles, bem como uma pequena variação nas medidas dos lados e ângulos do polígono (1) proporcionado uma figura côncava (7) ou convexa (8), vale ressaltar que é mantida a unidade técnico-funcional e corporal do produto. Como pode ser observado, a etapa indicada pela letra A ilustra o posicionamento da ferramenta com o corte no sentido oposto do movimento que será empregado para o acondicionamento na bainha, cujo movimento é indicado pela seta ilustrativa localizada no lado esquerdo da referida figura.
