Celem tej książki jest przedstawienie szerokiej koncepcji sporów teoretycznych w prawoznawstwie, która obejmowałaby nie tylko wyjaśnienie prawniczej natury tych sporów, lecz także ich filozoficznych podstaw. Znany amerykański teoretyk prawa Ronald Dworkin argumentował, że zjawisko sporów teoretycznych, rozumianych jako spory o „podstawy prawa”, stanowi centralne zjawisko praktyki prawniczej. Jednak znaczenie tego typu sporów jest tradycyjnie kwestionowane przez pozytywistów prawniczych, którzy twierdzą, że duża część kontrowersji pojawiających się w sądach nie dotyczy „podstaw prawa”, gdyż są one przez sędziów powszechnie, konwencjonalnie akceptowane. Autor niniejszej monografii udowadnia, że sytuacja wygląda inaczej, a problematyka sporów teoretycznych w pełni zasługuje na analizę naukową. Nie tylko omawia pewne współczesne teorie pozytywistyczne, które próbują rozpoznać znaczenie tego rodzaju sporów, ale też przedstawia dogłębne, filozoficzne wyjaśnienie natury owych sporów, odwołujące się do metodologii holistycznego pragmatyzmu.

Analyses of the concept of law rely on certain self-evident truths: truisms (platitudes) about law that people generally share and which reflect their common understanding of this important social concept. General legal theories are products of such analyses. In this paper I argue that every reference to truisms in the context of legal theory building should also take into account inferential processes by which truisms themselves are coined, namely different types of heuristics about law and related phenomena. Since both truisms and heuristics are unstructured, often inconsistent, and even fallible, conceptual analyses are the main means of transforming such “raw” evidence into rationally structured legal theories.

(English) American legal realism is commonly treated as a theory-pariah. The article exposes certain reasons explaining such a treatment. Generally, it seems that such an attitude is a result of many misunderstandings of realist aims and ambitions, some of which pertain to the theoretical status of legal realism and its relation to so called general jurisprudential theories, such as legal positivism. In the first part of the article I explain generally what these aims were and how one should see these relations. In the second part I briefly analyze B. Leiter's famous claim that legal realism is conceptually dependent on hard legal positivism (as a general theory of law). The critique of this claim opens the possibility for some alternative understanding of legal realism.

The term " ratio legis " is an important term of legal practice. Thus, reflection over the general conceptual content of " ratio legis " may be a window through which practitioners could see the relevance of philosophizing about terms and arguments applied generally in legal practice. However, the primary question with regard to " ratio legis " is not conceptual, but existential: Is there any real ratio legis that can be discovered and described? The positive answer opens the door for further investigation over the term's real conceptual content. I will argue, however, that the answer to this question cannot be positive and every qualification of something as the " law's reason " is a creative activity. If it is so, then every instance of such a labelling (in which one says " The ratio legis of this legislative act is X ") is in need of further justification. The example of " ratio legis " shows that legal theorizing is profoundly a normative study of how we should, rather than of how we do, use legal terms (concepts).

W fundamentalnych sporach prawniczych ścierają się rozmaite założenia filozoficzne dotyczące natury prawa. Dlatego spory prawnicze stanowią zasadniczo pod-typ sporów filozoficznych. Dlatego teoretyczna odpowiedź na pytanie o to, kto ma rację nie jest wcale oczywista. W artykule argumentuję, że spory te są teoretcznie nirozstrzygalne (żadne zasady teoretycznej racjonalności epistemicznej nie pozwalają nam orzec czy rację mają pozytywiści czy raczej ich przeciwnicy). Niemniej, inny typ racjonalności, tj. racjonalność praktyczna, pozwal nam przezwyciężyć sceptycyzm. Na końcu artykułu przywołuję kilka epistemicznych argumentów dlaczego przekonanie o słuszności jednej teorii prawa może być w oczach tak wielu filozofów prawa uzasadnione.

What is the general task of (legal) argumentation? Does is help to establish the truth (about the discussed matter)? The question is not so easy to answer, for it surely depends on some metaphysical assumption over the nature of our institutions (eg. on what are the “grounds of law”). However, answer to this question can be approached from a slightly different, epistemological perspective. One of the most recent “hot-topics” in contemporary epistemology is the question over what to do in case of genuine, reasonable peer disagreement. In the first part of the paper I sketch, thanks to some of the developments of that debate, my own understanding of reasonable peer disagreements, and explain why suspension of judgment is a theoretically required (reasonable) solution to such disagreements, even though there are many additional, pragmatic factors that may make a peer to stay steadfast. In the second part of the paper (starting from the section 4) I argue that the main function of argumentation is to make a particular dispute resolvable, even if there are theoretical grounds for the suspension of judgment. Such a contention requires, however, a broader epistemic background-theory. The epistemic circumstances in which agents (peers) have to act are not transparent and one’s epistemic position can be only “iteratively” (and in this, A. Goldman’s sense, objectively) justified. In result, no legal arguments, especially in hard, theoretical cases, are more truthful than others, but some of them appears to be more pragmatically useful. Thus, the main task of argumentation is to convince the other side (the practical function of testing others' beliefs), not to reveal the truth (theoretical function), which is best seen in case of theoretical disagreements in law. Thus, the argumentative schemes accepted in our culture are merely our best choice.

The paper focuses on the apparent inconsistency in Dworkin's thouhgt, arising from putting altogether two widely discussed arguments: argument from theoretical disagreement and the right answer thesis. From the epistemolological point of view the theoretical resolution of any peer disagreement which arises in hard cases is a suspension of judgment. If Dworkin want to criticize positivism by pointing to theoretical disagreements in legal practice, he can't consistently hold the one right answer thesis...unless he admits that any solution of theoretical disagreements is de facto a practical one. In that case, however, his basic idea of recognizing "true propositions of law" appears to be just a sham.

In 2014 we celebrate the 20th anniversary of publishing H.L.A. Hart’s ‘Postscript to The Concept of Law’, where Hart answers most thoroughly all of the important doubts raised against his theory by R. Dworkin. ‘Postscript’, however, did not cut off the discussions, but inspired new lines of arguments and critique. The article focuses on the main issues of the Hart-Dworkin debate that were discussed by their followers and critics, mainly after the publication of ‘Postscript’. Special attention is paid to methodological issues and the problem of theoretical disagreements. In this context some of the main arguments of such legal philosophers as J. Raz, A. Marmor, G. Postema, and J. Coleman are presented. In the end, a few misinterpretations (including the argument that legal positivism is a stagnant research programme in the sense of I. Lakatos) of legal positivists’ ideas are elucidated.

Some legal thinkers (R. Dworkin amongst them) suppose that the concept of law is an essentially contested concept. This article firstly introduces the idea of essentially contested concepts, developed by W.B. Gallie. Secondly, it is argued that the concept of law cannot be perceived as an essentially contested concept, though some related concepts (such as “the rule of law”, according to J. Waldron’s analysis) can. Finally, I propose some arguments, in which I partly follow K. Ehrenberg’s recent analysis, showing that in Dworkinean terms, calling law an essentially contested concept may raise doubts and controversy.

When discussing O. W. Holmes’s answer to the question "What constitutes the law?" Morton White underlines the fact that Holmes’s inquiry didn’t focus on developing the concept of law. White states: “Holmes said little in The Path of the Law about the notion of legal authority, perhaps because he was interested not in what he called a ‘useless quintessence of all legal systems’ but in ‘an accurate anatomy of one’” (White 2002: 130). Such ambition (or lack of ambition) is characteristic of many pragmatic enterprises in the field of jurisprudence. However, sometimes the opposition between legal pragmatism and other legal theories is built upon a reference to the notion of the “nature” or “essence” of law. Many legal philosophers who aim to reveal the very “nature of law” (or “the concept of law” as H. L. A. Hart did) try to interpret Holmes and other pragmatists as offering a competitive view to their own. In this paper I will follow White’s early intuition that such a construal of the controversy is simply wrong. Afterwards I will sketch a portrait of legal pragmatism in the context of White’s own inquiry and his version of “holistic pragmatism”; thirdly, I will present in brief the main reasons for exploring the concept of law in the contemporary analytic philosophy of law. Then I will show that traditionally “pragmatic” and “analytic” efforts in legal theory are situated on different levels of generality and conceptuality. However, these efforts can be, at least to some extent, reordered under the aegis of holistic pragmatism.

The fundamental reasons for officials to apply the criteria of validity available within the system’s rule of recognition, according to a basic reading of The Concept of Law, could be of various provenience (moral,conventional, traditional, other). However, to think of these criteria as genuine reasons it must be supposed thatthey are internal reasons that refer to agents’ motivational set. In this paper, the idea of the internal point of viewis juxtaposed with the notion of “internal reason” as introduced by B. Williams. It is argued that if fundamentallegal reasons are to be normative (authoritative) – at least in a conceptual sense – they must be internal reasons,which are moral in character. It is just another way to build an argument that Hart simply presented an “over-weak” theory of the internal point of view.

Topical Collection Description: The concept of evidence is a major epistemological notion in jurisprudential literature. The case is similar in practical ethics, in particular in relation to the evaluation of clinical decisions or research practice, where the concept of evidence has recently been acquiring more attention as one focal concepts. However, there is no consensus as to what counts as proper evidence in these domains, nor has the general concept of evidence been given a clear explication. Historically, some technical notions related to evidence (e.g. proof, doubt, testimony, witness, expert) have been developed in the domain of law, to some extent drawing on ideas developed within the philosophy of science. Concepts such as evidential threshold, burden of proof, probative value, criminal profiling, and evidential restrictions or exclusions (such as unfair prejudice, confusing the issues, misleading the jury, undue delay, wasting time, or needlessly presenting cumulative evidence) constitute an important part of legal thinking. Philosophical inquiries obviously supply new insights into this old theme of legal investigations, e.g. the conflicts between different types of evidence, on how to evaluate their hierarchy and strength (in abstract terms), as well as on making decisions based on the evidence (in particular circumstances). Thus the idea arose to provide an interdisciplinary platform for a thorough discussion of evidence related themes as they are used by both legal scholars, ethicists, epistemologists, and philosophers of science. This issue will focus on new and insightful philosophical inquiries into concepts and theories of evidence that have a legal pedigree or find a particular application in legal contexts. The issue will comprise contributions on the concept of evidence and how problems in law and ethics may force us to carefully rethink it, rather than papers primarily on ethics or law that consider the issue of evidence. In particular, we want to focus on the problem of statistical evidence that has been discussed by lawyers for many years, and has recently attracted the attention of philosophers.

Najpoważniejszymi obecnie problemami szpitali jednoimiennych są niejasna przyszłość i masowe odejścia personelu. W konsekwencji pod znakiem zapytania stoi powrót tych jednostek do normalnej pracy po epidemii – piszą lekarz i prawnik.

Działania władz nakazują uznać per facta concludentia, że trwa nienazwany i niedookreślony stan nadzwyczajny. Skoro pojawiły się istotne ograniczenia praw i wolności obywatelskich, władza ma obowiązek je usankcjonować. W takich warunkach przeprowadzać wyborów prezydenckich nie wolno, a niewprowadzenie stanu nadzwyczajnego naraża władzę na odpowiedzialność za delikt konstytucyjny.
