This research seeks to explain that every society in the world has its own customs. All societies in the world revere their customs to the extent of regarding such customs as their law. Zambia has 73 ethnic tribes and all tribes have distinct customs which they regard as their customary laws.
This research seeks to address Article 7(d) of the constitution on what constitutes inconsistency of customary law to statutory law, with reference to the repugnancy clause located in the Local Court Act. An analysis to determine the form of customary law recognized by the constitution and a comparison and contrast between customary law and statutory law will be had for purposes of determine whether customary law is and how it is considered repugnant.
This research will finally make recommendations in accordance with the findings of the research.
