Guillermo Palao obtained his PhD (with honours) at the University of Valencia (Spain) and he is currently full Professor of Private International Law at that University, where he teaches Private International Law and International Commercial Law and where he is actively involved in several R+D groups.
Former adviser of the Study Group on a European Civil Code, he is a Fellow of the European Law Institute (ELI), correspondent Academic of the Spanish Royal Academy of Jurisprudence and Law, associate member of the International Academy of Comparative Law (AIDC/ IACL), and member of the American Association of Private International Law (ASADIP). Also affiliated to the Centre for Private International Law, University of Aberdeen (United Kingdom), Prof. Palao has been appointed as distinguished professor at the Faculty of Law of the University of Havana (Cuba). Besides he is an active member of several researching networks and projects (American, European and Spanish), co-founder of Ibero-american academic networks -Red Iberoamericana de Derecho: Familia, Migraciones y Solución de Conflictos (Red FaMiSol), Red de Derecho Procesal Civil Internacional (Rede PCI) and Red Iberoamericana de Propiedad Intelectual (RIAPI)- as well as professional associations such us the Spanish Teachers Association of International Law and International Relations (AEPDIRI), or the Deutsch-Spanische Juristenvereinigung (DSJV). A non-practicing Lawyer at the Valencia Law Society -Ilustre Colegio de Abogados de Valencia (ICAV)-, he is a member of the Arbitration and Mediation Centers of the World Intellectual Property Organization (WIPO) and of the Chamber of Commerce and Navigation of Valencia.
Porf. Palao has enjoyed different researching periods at several academic institutions, like Harvard Law School (Cambridge, MA), Università La Sapienza (Roma), Max-Planck Institute for International and Comparative Private Law (Hamburg), Max-Planck Institute for Innovation and Competition (Munich), Swiss Institute of Comparative Law (Lausanne), or the Peace Palace Library (The Hague). He has published extensively in Spanish, English, French, German, Italian and Portuguese, having published 6 books (as a sole author), edited more than 20 books, and published more than 100 chapters and articles. His research has been devoted to several areas, like International Contracts and Tort Law, International Company Law, International Labor Law, International Family and Succession Law, International Civil and Commercial Litigation and ADR as well as International Intellectual Property and IT Law. Besides, Prof. Palao has a long teaching experience (at graduate and postgraduate levels) in both European and Latin-American Universities.

This article analyzes the relevant issues concerning the localization of the place of arbitration in the current highly globalized trade and technology, referring to the legal developments that have taken place in this field in Spain and Latin America. Thus, on the one hand, phenomena like “online arbitration” (linked to the use of Online Dispute Resolution —ODR— systems) or “mobile arbitration” are analyzed. And, on the other hand, the trend towards “de-localization” of international commercial arbitration is underlined; turning it into a “non-national” arbitration, in which the determination of the seat is used simply to choose appropriate arbitration rules or even to meet the convenience either of the arbitral process or of the arbitrators.

Liability for defective products meets a modern legal framework applicable to cases which have an international nature in the European Union. However, the new regulatory developments have not solved the existing coordination problems and offer an unjustified complexity, so there is a certain risk that the objectives pursued by the European legislator in this strategic sector for the EU internal market are not going to be fulfilled. The objective of this study is to analyze the solutions contained in Regulation (EC) 442001, relating to jurisdiction, the recognition and enforcement of judgments in civil and commercial matters and Regulation (EC) 8642007, concerning the law applicable to non-contractual obligations («Rome II»), aswell as their interrelationship with other conventional instruments.

Resumen: El consumidor europeo cuenta con una desigual atención, por parte del legislador de la Unión Europea, a la hora de tutelar su acceso a la justicia en relación a las controversias transfronterizas en las que pudiera verse involucrado. Una protección que, aunque atendida de cara a su acceso a la justicia al respecto de las situaciones conectadas con el mercado interior UE, no es tan evidente en relación con los casos extra-europeos, que además se han visto multiplicados tras la irrupción de la Sociedad de la Información. El Reglamento europeo de sucesiones (plenamente aplicable desde agosto 2015) otorga un papel significativo a la autonomía de la voluntad, permitiendo al causante elegir la ley aplicable a su sucesión en supuestos transfronterizos. Aunque novedosa para los ordenamientos de algunos Estados miembros de la Unión Europea, la elección de la ley aplicable a la sucesión internacional cuenta con importantes precedentes convencionales y estatales en Europa, además de encontrarse alineada con una constante tendencia favorecedora de la electio iuris en los instrumentos europeos.
