The clash between the judiciary and successive governments resulted in acknowledgement of the criminal events that occurred, including convictions for the CIA agents responsible, evidence surfacing of Italian collusion, at the same time as it was unlikely that any of the culprits would serve their punishment.

An analysis of 20 years of official documents (1995–2014) and legislative acts at national and EU... more An analysis of 20 years of official documents (1995–2014) and legislative acts at national and EU levels using Jessop’s Strategic Relational Approach (SRA) offers insights into inherent structural flaws in the Justice and Home Affairs aspects of European and member state migration policies. Focusing on two triptychs (hierarchy, governance and government; state power(s), strategic selectivities and structures) and tracking their development clarifies that this policy field’s purposes stray beyond migration management. In fact, the EU migration policy model was set up to be inherently expansive and is intimately linked to EU institutions and national governments striving to enhance their power(s). Talk in a conference held by the human rights council of the Milan order of lawyers about human r... more Talk in a conference held by the human rights council of the Milan order of lawyers about human rights, the law of the sea and migration policy deployment at sea. The argument made is that many recent events and abuses committed by states that appear to be aberrations -particularly in the central and eastern Mediterranean routes, concerning cooperation with Libya and the Libyan Coast Guard, and steps to criminalise solidarity - fit squarely within the EU policy model in this field developed since the mid-1990s. In 2015, with the European Agenda on Migration, the primacy afforded to strategic migration policy goals led to a forceful institutional drive at the EU level to subordinate human rights and the rule of law in wholesale fashion to such goals. In the case of the law of the sea, even the right to life and the prohibition of torture are being undermined in broad daylight, using the "pull factor" thesis (a feature of Frontex risk analyses) that interprets saving lives at sea or helping people in destitution as connivance with traffickers. Shortly after a submission to the International Maritime Organization (IMO) was filed in late March 2020, calling for it to be scrapped for not fulfilling the relevant requirements, attempted sea crossings from Libya resumed. EU states responded by opportunistically declaring themselves unsafe due to the Covid-19 emergency.

Despite all parties recognising some problematic aspects of cooperation with Libya on several grounds, including migrants' rights, the widespread use of violence and the identity of Libyan counterparts, most of the voices that were heard considered it a price worth paying to secure Italy's borders and assert a prohibitionist migration management model. There was little concern about European and Italian efforts to strengthen the Libyan state's capabilities by promoting discrimination and mistreatment of people whose mobility was not officially authorised.

While Italian political parties (supported by the Commission, Frontex and some governments in the Council) were pointing their finger at NGOs engaged in Search and Rescue operations in the central Mediterranean, accusing them of colluding with traffickers, the Italian state was negotiating with criminal elements to stop departures and manage detention centres. Several journalists reported anomalies and events on the ground, and Nello Scavo of Avvenire newspaper documented the government's "secret treaty" involving a well known trafficker. Beyond the death and mistreatment of migrants, official efforts to impose unlawful practices and cooperation frameworks is resulting in journalists having to be placed under protection. Most importantly, the Libyan SAR zone is a fiction established for the EU's own strategic purposes and cooperation with the Libyan coastguard amounts to violation of the non-refoulement principle.

The contents of the Commission instructions to the Italian government in one of its state of play... more The contents of the Commission instructions to the Italian government in one of its state of play reports in the early phases of the European Agenda on migration and the setting up of the hotspot approach were outrageous for two main reasons. Firstly, Italy was instructed to violate its own laws and constitution with regards to newly arrived migrants and refugees for purposes of effectiveness in fingerprinting. Secondly, what was presented as the EU acting in solidarity merely served to perfect and entrench a system that places Italy in a situation of structural disadvantage to give rise to an emergency that would allow further departures from the law.
On 8 February 2017, the Commission produced its ninth report on relocation and resettlement, cove... more On 8 February 2017, the Commission produced its ninth report on relocation and resettlement, covering a two-month period from 8 December 2016 to 7 February 2017. It basically offers an update on the figures and developments from the previous report, noting the resettlement of 13,968 people overall under the scheme and 3,813 relocations in the reporting period, viewed as maintaining "the overall positive trend" with December recording the record figure to date (1,926) and bringing the total to 11,966, up from 8,162. Commissioner Dimitris Avramopoulos noted "progress" on both schemes although the challenge requires that "more needs to be done, and faster", calling on member states to show "political will, commitment and perseverance". As for the 8 th previous report, isolating these two aspects enables the portrayal of a situation which is improving while turning attention away from its systemic effects in the frontline states and this approach's limits in terms of rationality and sustainability. Much ado about nothing Among other issues, these limits result from the low commitments by member states, in numerical terms, for resettling and relocating people which, even if they were achieved (and they are not, as result of foot-dragging and a lack of political will), would not substantially alter the situation. Taking in 13,986 people registered as refugees from countries in the region of origin [Turkey, Jordan and Lebanon] since June 2015, out of a total commitment of 22,504 does mean achieving the resettlement of "more than half of the agreed number", a fact the Commission's report stresses. The millions of refugees present in the three countries suggests the impact of these measures will not make much of a difference, particularly as some of them are carried out within the framework of the 1:1 scheme laid out in the EU/Turkey Statement which envisages resettlements from Turkey in exchange for deportations from the Greek island hotspots. As with the previous report, the potential impact of the relocations enacted is revealed to be inconsequential by comparing them with the numbers of people who are arriving. In the eight report, the respective figures were 1,406 relocations in a month when 11,278 people arrived; in this one, there were 3,813 relocations in two months (as of 5 December) when there were 19,487 arrivals to Greece (3,873) and Italy (15,614). This is a major problem in the official narrative, as it only considers people whose nationalities make them potential relocation candidates, while assuming that all the others will be tracked down, detained and deported, in application of the Commission's damaging plans to "restore credibility to the EU's returns policy". Questa dunque può essere una grande occasione di cambiamento. Qual è secondo te la necessità di cambiamento più urgente in questo momento e cosa sei disposto a fare in quella direzione? Grazie per avermi rivolto delle domande fondamentali, alle quali è difficile dare una risposta compiuta. Parto schematicamente dalle lezioni che si possono trarre dall'emergenza attuale.

Efectos de las políticas de seguridad sobre derechos y libertades en la Unión Europea, y su expor... more Efectos de las políticas de seguridad sobre derechos y libertades en la Unión Europea, y su exportación más allá de las fronteras comunitarias. This talk sought to highlight some of the main problems linked to the themes of security and immigration at the European level, its implementation in concrete forms within member states through selected examples, and its effects on rights and freedoms, both within the EU and beyond its borders, with increasingly noteworthy effects outside of its territory. Key references include documents by the Futures Group headed by former JHA Commissioner Franco Frattini under the Portuguese Council presidency, which worked to develop the Stockholm Programme.
