It has been observed that the existing systems of penalties have not been sufficient, and the availability of criminal penalties was required, to achieve complete compliance with the laws for the protection of the environment. As a result, the European environmental criminal law has gone through a remarkable development over the past decades at both EU and Member State levels. This paper suggests that, although the Directive 2008/99/EC, which is the main legal instrument of the EU environmental criminal law, was an important step forward in the protection of environment through criminal law, it may be criticised for its administrative dependence and lack of autonomous or independent approach both in terms of offences and their sanctions.

Esasen burada, gerçek olan hususlardan bahisle başkalarına karşı küçültücü, incitici davranışlarda bulunulabilip bulunulamayacağı sorunu söz konusudur. Türk ceza hukukunda hakaret suçunun konusunu oluşturan isnatlar bakımından kural olarak ispat yasaktır ve hakaret suçunu oluşturan isnatların gerçeği yansıtması, fiilin cezalandırılmasını etkilemez. Bununla beraber TCK m.127'de öngörülen koşulların bulunması halinde sanığa isnadını ispat imkânı tanınabilir ve eğer ispat ederse sanık bu fiilinden ötürü cezalandırılmaz. İsnadın ispatı Anayasa m.39'da da düzenlenmektedir. Ancak TCK m.127'nin Anayasa m.39 hükmü ile tam olarak örtüşmediği görülmektedir. Anayasa'da kamu görevi ve hizmeti yürütenlere yönelik isnatlar bakımından isnadın ispatı herhangi bir koşula bağlanmayarak mutlak bir hak olarak tanınmıştır. Oysa TCK m.127'de kamu görevi ve hizmeti yürütenlere yönelik böyle açık bir düzenlemeye yer verilmemiştir.

Bunlar ceza hukuku müeyyidesi olmamakla beraber, kimi zaman ceza hukuku anlamındaki cezalar kadar ağır sonuçlar doğurabilir. Yükseköğretim kurumu öğrencileri hakkında verilebilecek cezalar, bu durumun en iyi örneklerindendir. Örneğin yükseköğretim kurumundan çıkarma cezası, temel bir hak olan eğitim hakkının önemli ölçüde sınırlandırılması sonucunu doğurmaktadır. Dolayısıyla bu alanda da kanunilik ve hukuki güvenlik ilkelerinin gereklerine uygun düzenlemeler yapılmalıdır. 2547 sayılı Yükseköğretim Kanunu ve Yükseköğretim Kurumları Öğrenci Disiplin Yönetmeliği bu açıdan incelendiğinde, bazı hükümlerinin eleştiriye açık olduğu ve değiştirilmesinin uygun olacağı görülmektedir.
The role of the European Union's (EU) criminal law enforcement agencies in the fight against cros... more The role of the European Union's (EU) criminal law enforcement agencies in the fight against cross-border crimes have progressively increased over the past few decades. Thus, the traditional viewpoint that law enforcement in the EU is an exclusive matter for national authorities has almost been abandoned. Although the EU's criminal law enforcement agencies represent an important step forward in the path of an increasing integration, their main shortcoming stems from the lack of EU-wide rules of substantive and procedural criminal law. Such lack makes their activities dependent on, and constrained by, national laws. This paper suggests that the increasing role of the EU's law enforcement agencies should proceed hand in hand with the efforts for approximation of the national criminal laws of the Member States. Furthermore, additional mechanisms that offer the European law enforcement agencies adequate guidance at the European Convention on Human Rights standards are needed to allow EU citizens to truly enjoy their rights to free movement.

ABSTRACT The crimes of manipulation are among the examples of market abuse. Article 107 of the Capital Market Law No. 6362 regulates two types of manipulation crimes, namely the transaction-based and the information-based manipulation crimes. Information-based manipulation crime is committed by giving, sharing, making, preparing or spreading false, incorrect or misleading information, comments or reports and by making a benefit through such actions. In this context, “false, incorrect or misleading” constitutes a part of the material element of the crime and refers to the deception.

and c... more ABSTRACT Information is the most critical factor affecting the market value of securities, and constitutes the basis of the capital market activities. Making right decisions in conducting such activities depends on the realisation of the public disclosure and transparency principles as well as the equal access to information. One of the reasons which prevent the functioning of the capital markets based on trust, honesty, transparency and equality, and cause unfair benefits for investors is the crime of information abuse. The crime of information abuse is regulated in Article 106 of the Capital Market Law. Information abuse is a term of art that refers to unlawful trading in securities by a person who possesses non-publicly available information about a company whose shares are traded or the market, which may affect the value of securities. The subject of the information abuse prohibition can be analysed under four categories, namely a) the managers of the issuers and their controlling parents and subsidiaries as well as the persons who possess information due to their shareholding in such companies; b) persons who possess information due to the performance of a job, profession or duty; c) persons who acquire information by committing a crime; d) persons who know (or must know, if proven) that the information in their possession is in the nature described in the relevant provision. The Capital Market Law’s regulation on this matter, which is generally in line with the EU acquis, extended the categories of persons who can commit the crime of information abuse. ÖZET Sermaye piyasası araçlarının piyasa değerini etkileyen en önemli unsur bilgidir ve sermaye piyasasında gerçekleştirilen faaliyetlerin temelinde de bilgi yatar. Bu faaliyetlerin yürütülmeleri esnasında isabetli kararların verilebilmesi, kamuyu aydınlatma ve şeffaflık ilkeleri ile bilgide eşitliğin hayata geçirilmesine bağlıdır. Sermaye piyasalarının güven, dürüstlük, şeffaflık ve eşitlik içinde işlemesini engelleyen ve yatırımcılar aleyhine haksız kazançlar sağlayan bir neden de bilgi suistimali suçudur. Bilgi suistimali suçu, SerPK m. 106’da düzenlenmektedir. Bilgi suistimali, hisseleri işlem gören bir şirkete veya piyasaya ilişkin olarak kamuya açıklanmamış ve piyasa araçlarının değerini etkileyebilecek nitelikteki bilgilere sahip bir kişi tarafından piyasa araçlarına ilişkin hukuka aykırı işlem yapılmasını ifade eden teknik bir terimdir. Bilgi suistimali yasağının muhatabı dört kategori altında ele alınabilir. Bunlar: a) İhraççıların veya bunların bağlı veya hakim ortaklıklarının yöneticileri ve bu ortaklıklarda pay sahibi olmaları nedeniyle bilgiye sahip olan kişiler; b) İş, meslek ve görevlerinin icrası nedeniyle bilgiye sahip olan kişiler; c) Bilgiyi suç işlemek suretiyle elde eden kişiler; d) Sahip oldukları bilginin söz konusu düzenlemede belirtilen nitelikte bulunduğunu bilen veya ispat edilmesi halinde bilmesi gereken kişilerdir. Genel olarak SerPK konuyu AB müktesebatı ile paralel biçimde düzenlemiş ve bilgi suistimali suçunu işleyebilecekler kategorisini genişletmiştir.

SONUÇ Her ne kadar genel olarak şiddetin onaylanmayan bir davranış olduğu söylense ve hukuk düzenleri bu tür davranışları yasaklasa da yine de şiddetin önüne geçilememektedir. Evrensel bir sorun olan kadına yönelik şiddet ise, şiddetin son zamanlarda en çok üzerinde durulan türlerinden biri olarak hem uluslararası kamuoyunun hem de ulusal kamuoyunun gündeminden düşmemektedir. Her gün kadına yönelik şiddet haberleri gündemi sarsmakta, ancak bir sonraki gün yenileri öncekilerin etkisini azaltmaktadır. Öldürme, yaralama gibi en ağır suçlar şeklinde ortaya çıkan kadına yönelik şiddet fiillerinde dahi azalma görülmemektedir. Bu da sorunun yalnızca kanunla ve cezayla çözülemeyeceğinin en önemli kanıtı olsa gerektir. Erkeğin kadın karşısında daha değerli ve üst bir notaya konumlandırıldığı, kadının varlığı ve hayatı üzerinde hak sahibi olarak görüldüğü, hayatını ve duygularını onaylamadığında kadını uygun bulduğu biçimde cezalandırmasının meşru sayıldığı bir toplumda, kadına yönelik şiddet sorunu çözülemez. Dolayısıyla patriarkal toplum yapısı değişmeden, kadına yönelik şiddet sorununun önüne geçilemez. Kadına yönelik şiddet fiillerinin ortaya çıkış biçimlerinden biri de kötü muameledir ve TCK m. 232/1’deki suçu oluşturur. Kötü muamele teşkil eden davranışların pek çoğu yaralama, tehdit, hakaret, eziyet, cinsel dokunulmazlığa karşı suçlar gibi daha ağır suçlara da vücut verir. Mevcut suç tanımı, kötü muamele suçunun çakıştığı diğer suçlardan ayrılmasına elverişli değildir. Bu nedenle, olması gereken hukuk açısından, suçun kapsamını ve sınırlarını açıklığa kavuşturacak unsurların yanı sıra, “kanunda tanımlanan başka suç tiplerinden birini oluşturmadığı takdirde” bu gibi fiillerin kötü muamele suçunu oluşturacağına dair bir ibarenin de madde metnine eklenmesi şarttır. Bu yönde bir ibare kanun maddesine eklenene kadar söz konusu çakışmanın fikri içtima hükümleri çerçevesinde ele alınmasından başka çare görünmemektedir ve fikri içtima hükümleri gereği fail daha ağır olan suçtan cezalandırılır. Öte yandan esas itibariyle psikolojik şiddet niteliğinde olan fiillerin bir kısmı hakaret, tehdit, eziyet gibi suçların tanımına uymaz ve genellikle kötü muamele suçu kapsamında kalır. Bu nedenle kötü muamele suçu, psikolojik şiddet bakımından ayrıca ve özellikle önemlidir.

delicate issues in the area... more Cooperation in criminal matters in the EU is probably one of the most delicate issues in the area of harmonisation as it deals with two very sensitive matters, namely, the sovereignty of Member States and the protection of human rights. Despite such delicacy, the police and judicial cooperation in criminal matters has been one of the fastest-growing areas of the EU law especially after the Treaty of Lisbon where certain competences in criminal matters were conferred to the EU. This paper concentrates on the main areas for police and judicial cooperation and the types of available legal instruments. This paper suggests that increasing the cooperation in an effective and sustainable manner would require a balanced approach between the security and the protection of fundamental rights.

Müsadereye ilişkin en problemli konulardan birisi TCK m. 54/1'in 2. cümlesinde düzenlenen suçta kullanılmak üzere hazırlanan eşyanın müsadere-sidir. Bu çalışmada önce genel olarak müsaderenin hukuki niteliği ve uygulanma koşulları kısaca ele alınmış; ardından da suçta kulla-nılmak üzere hazırlanan eşyanın müsaderesi ile ilgili sorunlar ortaya konulmaya çalışılmıştır. Son olarak sorunun çözümü mahiyetinde, söz konusu hükmün temel hak ve özgürlükler ile ceza hukuku ilkeleri açısından sahip olduğu sakıncalar nedeniyle ilga edilmesi önerisinde bulunulmuştur. Abstract: The confiscation, which is regulated in the Turkish Penal Code under two categories, namely the confiscation of goods and earnings, has been subject of discussions and criticism for long time. One of the most problematic issues regarding the confiscation relates to the confiscation of goods which is regulated under the second sentence of Article 54/1of the Turkish Penal Code. In this paper, firstly the legal nature and the implementation conditions of confiscation are briefly dealt with, and then the problematic areas regarding the confiscation of goods which are prepared for being used in a crime are analysed. Lastly, as a proposed solution to the problem, the relevant provision is recommended to be repealed because of the concerns raised by its contradiction to the fundamental rights and freedoms and the general principles of criminal law.
The crime of fraud is regulated in article 157 of the tenth chapter titled Crimes Against Propert... more The crime of fraud is regulated in article 157 of the tenth chapter titled Crimes Against Property of the Turkish Penal Code numbered 5237. According to this clause, fraud refers to "deceiving a person with fraudulent behavior and gaining a benefit to oneself or another, to the detriment of such person or another." It is controversial whether or not silence could constitute a fraudulent behavior for the purposes of the crime of fraud. In the legal literature, there are scholars who think it is not possible as much as those who argue that this is possible. Even if not all silence, the silence, which appears in the form of omission of a legal obligation to disclose, may constitute a fraudulent behavior for the purposes of the crime of fraud. This obligation may stem from law, contract or a non-contractual trust relationship, or the good faith principles. It should be noted that all contractual relationships, trust or good faith principles should not be interpreted as rules providing such a general obligation to disclose. Here, a balance must be established between the freedom of contract, practices stemming from commercial customs and daily life relations, on one hand, and the requirement that such principles and practices should not be considered as a ground for a freedom to deceive others or an open check to deceive others, on the other hand.

delicate issues in the area... more Cooperation in criminal matters in the EU is probably one of the most delicate issues in the area of harmonisation as it deals with two very sensitive matters, namely, the sovereignty of Member States and the protection of human rights. Despite such delicacy, the police and judicial cooperation in criminal matters has been one of the fastest-growing areas of the EU law especially after the Treaty of Lisbon where certain competences in criminal matters were conferred to the EU. This paper concentrates on the main areas for police and judicial cooperation and the types of available legal instruments. This paper suggests that increasing the cooperation in an effective and sustainable manner would require a balanced approach between the security and the protection of fundamental rights.

Müsadereye ilişkin en problemli konulardan birisi TCK m. 54/1'in 2. cümlesinde düzenlenen suçta kullanılmak üzere hazırlanan eşyanın müsadere-sidir. Bu çalışmada önce genel olarak müsaderenin hukuki niteliği ve uygulanma koşulları kısaca ele alınmış; ardından da suçta kulla-nılmak üzere hazırlanan eşyanın müsaderesi ile ilgili sorunlar ortaya konulmaya çalışılmıştır. Son olarak sorunun çözümü mahiyetinde, söz konusu hükmün temel hak ve özgürlükler ile ceza hukuku ilkeleri açısından sahip olduğu sakıncalar nedeniyle ilga edilmesi önerisinde bulunulmuştur. Abstract: The confiscation, which is regulated in the Turkish Penal Code under two categories, namely the confiscation of goods and earnings, has been subject of discussions and criticism for long time. One of the most problematic issues regarding the confiscation relates to the confiscation of goods which is regulated under the second sentence of Article 54/1of the Turkish Penal Code. In this paper, firstly the legal nature and the implementation conditions of confiscation are briefly dealt with, and then the problematic areas regarding the confiscation of goods which are prepared for being used in a crime are analysed. Lastly, as a proposed solution to the problem, the relevant provision is recommended to be repealed because of the concerns raised by its contradiction to the fundamental rights and freedoms and the general principles of criminal law.
The crime of fraud is regulated in article 157 of the tenth chapter titled Crimes Against Propert... more The crime of fraud is regulated in article 157 of the tenth chapter titled Crimes Against Property of the Turkish Penal Code numbered 5237. According to this clause, fraud refers to "deceiving a person with fraudulent behavior and gaining a benefit to oneself or another, to the detriment of such person or another." It is controversial whether or not silence could constitute a fraudulent behavior for the purposes of the crime of fraud. In the legal literature, there are scholars who think it is not possible as much as those who argue that this is possible. Even if not all silence, the silence, which appears in the form of omission of a legal obligation to disclose, may constitute a fraudulent behavior for the purposes of the crime of fraud. This obligation may stem from law, contract or a non-contractual trust relationship, or the good faith principles. It should be noted that all contractual relationships, trust or good faith principles should not be interpreted as rules providing such a general obligation to disclose. Here, a balance must be established between the freedom of contract, practices stemming from commercial customs and daily life relations, on one hand, and the requirement that such principles and practices should not be considered as a ground for a freedom to deceive others or an open check to deceive others, on the other hand.

ABSTRACT
The crimes of manipulation are among the examples of market abuse. Article 107 of the Capital
Market Law No. 6362 regulates two types of manipulation crimes, namely the transaction-based and the
information-based manipulation crimes. Information-based manipulation crime is committed by giving,
sharing, making, preparing or spreading false, incorrect or misleading information, comments or reports
and by making a benefit through such actions. In this context, “false, incorrect or misleading” constitutes a
part of the material element of the crime and refers to the deception.
Information is the most critical factor affecting the market value of securities,
and constitutes the basis of the capital market activities. Making right decisions in conducting such activities depends on the realisation of the public disclosure
and transparency principles as well as the equal access to information. One of the
reasons which prevent the functioning of the capital markets based on trust, honesty,
transparency and equality, and cause unfair benefits for investors is the crime of
information abuse.
The crime of information abuse is regulated in Article 106 of the Capital Market
Law. Information abuse is a term of art that refers to unlawful trading in securities by
a person who possesses non-publicly available information about a company whose
shares are traded or the market, which may affect the value of securities.
The subject of the information abuse prohibition can be analysed under four
categories, namely a) the managers of the issuers and their controlling parents and
subsidiaries as well as the persons who possess information due to their shareholding
in such companies; b) persons who possess information due to the performance of a
job, profession or duty; c) persons who acquire information by committing a crime; d)
persons who know (or must know, if proven) that the information in their possession is
in the nature described in the relevant provision. The Capital Market Law’s regulation
on this matter, which is generally in line with the EU acquis, extended the categories
of persons who can commit the crime of information abuse.

Sermaye piyasası araçlarının piyasa değerini etkileyen en önemli unsur
bilgidir ve sermaye piyasasında gerçekleştirilen faaliyetlerin temelinde de bilgi
yatar. Bu faaliyetlerin yürütülmeleri esnasında isabetli kararların verilebilmesi,
kamuyu aydınlatma ve şeffaflık ilkeleri ile bilgide eşitliğin hayata geçirilmesine
bağlıdır. Sermaye piyasalarının güven, dürüstlük, şeffaflık ve eşitlik içinde işlemesini
engelleyen ve yatırımcılar aleyhine haksız kazançlar sağlayan bir neden de bilgi
suistimali suçudur.
Bilgi suistimali suçu, SerPK m. 106’da düzenlenmektedir. Bilgi suistimali,
hisseleri işlem gören bir şirkete veya piyasaya ilişkin olarak kamuya açıklanmamış
ve piyasa araçlarının değerini etkileyebilecek nitelikteki bilgilere sahip bir kişi
tarafından piyasa araçlarına ilişkin hukuka aykırı işlem yapılmasını ifade eden teknik
bir terimdir.
Bilgi suistimali yasağının muhatabı dört kategori altında ele alınabilir. Bunlar:
a) İhraççıların veya bunların bağlı veya hakim ortaklıklarının yöneticileri ve bu
ortaklıklarda pay sahibi olmaları nedeniyle bilgiye sahip olan kişiler; b) İş, meslek ve

Evrensel bir sorun olan kadına yönelik şiddet ise, şiddetin son zamanlarda en çok üzerinde durulan türlerinden biri olarak hem uluslararası kamuoyunun hem de ulusal kamuoyunun gündeminden düşmemektedir. Her gün kadına yönelik şiddet haberleri gündemi sarsmakta, ancak bir sonraki gün yenileri öncekilerin etkisini azaltmaktadır. Öldürme, yaralama gibi en ağır suçlar şeklinde ortaya çıkan kadına yönelik şiddet fiillerinde dahi azalma görülmemektedir. Bu da sorunun yalnızca kanunla ve cezayla çözülemeyeceğinin en önemli kanıtı olsa gerektir. Erkeğin kadın karşısında daha değerli ve üst bir notaya konumlandırıldığı, kadının varlığı ve hayatı üzerinde hak sahibi olarak görüldüğü, hayatını ve duygularını onaylamadığında kadını uygun bulduğu biçimde cezalandırmasının meşru sayıldığı bir toplumda, kadına yönelik şiddet sorunu çözülemez. Dolayısıyla patriarkal toplum yapısı değişmeden, kadına yönelik şiddet sorununun önüne geçilemez.
