Chapter V of the Elections Act, 2017, is the central procedural chapter that details the conduct
of general elections. It outlines the entire election lifecycle, from the announcement of the
election schedule to the final declaration of results.
Key Provisions
● Election Program and Notification: The chapter grants the Election Commission of
Pakistan (ECP) the power to announce the election program. This includes the date of the
general election, the last date for filing nomination papers, the dates for scrutiny, and the
last date for withdrawing candidacy.
● Nomination and Scrutiny: This section lays out the process for candidates to file their
nomination papers. A key reform is the requirement for candidates to declare their assets,
liabilities, and any outstanding bank loans or government dues. The Act also specifies the
procedure for the Returning Officer to scrutinize these papers and for any person to file
objections to a candidate's eligibility.
● Polling Stations and Staff: The Act provides rules for the establishment of polling
stations and the appointment of election officials, including Presiding Officers, Assistant
Presiding Officers, and Polling Officers. It also states that the distance between a polling
station and voters' residences should ideally not exceed one kilometer.
● Voting and Counting Process: The chapter details the procedure for casting votes,
including the use of ballot papers. A significant provision is the requirement for
gender-disaggregated voter turnout to be recorded on Form-45 (Result of the Count),
which helps identify any attempt to disenfranchise female voters. The law also gives
candidates or their agents the right to observe the counting process at the polling station.
● Consolidation and Declaration of Results: This section outlines the process for the
Returning Officer to consolidate the results from all polling stations in a constituency. It
includes a provision for a recount of votes if the margin of victory between the winner
and the runner-up is less than 5% of the total votes or 10,000 votes, whichever is less.
The chapter concludes with the official procedure for the Returning Officer to declare the
winning candidate and submit the results to the ECP.
Chapter V is essentially the practical guide for the ECP and all parties involved in the election,
providing a detailed roadmap to ensure the polling process is conducted in a structured,
transparent, and legally sound manner.
