CLAUSE 6

NOTICE OF READINESS (NOR) SHALL BE TENDERED ON VESSEL'S ARRIVED AT PILOT


STATION OF LOADING/ DISCHARGING PORT THROUGH EMAIL/TELEX/FAX AS BELOW:
BY SHIP'S CAPTAIN ON ANY TIME DAY OR NIGHT SUNDAY HOLIDAY INCLUDING, WWWW.
LAYTIME SHALL COMMENCE FROM 12 HOURS AFTER NOTICE OF READINESS HAS BEEN
GIVEN, UNLESS SOONER COMMENCED WHICH CASE THE ACTUAL TIME USED TO BE
COUNTED AS LAYTIME. BREAKDOWNS OF SHORE CRANE IN DISCHARGING PORT
FACILITIES SHALL BE COUNTED AS LAYTIME, TIME FOR DRAFT SURVEY SHOULD NOT
COUNT AS LAYTIME. LAYTIME CEASE TO COUNT UPON FINAL DRAFT SURVEY.

UPON NOR TENDERING, VSL HOLDS TB CLEAN SWEPT/WASHED DOWN BY FRESH WATER
AND DRIED UP SO AS TO RECEIVE CHRS INTENDED CGO IN ALL RESPECTS. FREE OF SALT,
RUST SCALE AND PREVIOUS CARGO RESIDUE TO THE SATISFACTION OF THE
CHTRS/SHPRS SURVEYOR AND IF INSPECTION FAIL, OWNER/MASTER MUST RECTIFIED
HOLD AS SOON AS POSSIBLE, AND TIME NOT TO COUNT AS LAYTIME FROM THE TIME OF
REJECTION UNTIL ALL HOLDS READY FOR REINSPECTION. IN CASE OF DISAGREEMENT,
AN INDE-PENDENT SURVEYOR APPROVED BY BOTH PARTIES TO BE NOMINATED AND HIS
OPINION TO BE FINAL.COST / EXPENSES/ TIME FOR THE SAME TO BE SHARE EQUALLY
ACCT.

CLAUSE 7

LIGHTERAGE / LIGHTENING / SHIFTING CHARGES IF ANY SHALL BE FOR CHRTS'S


ARRANGEMENTS AND ACCOUNT BENDS. IF MORE THAN ONE BERTH OF LOADING AND
DISCHARGING HAS BEEN AGREED AND USED, COST OF SHIFTING INCLUDING COST OF
BUNKERS USED, SHALL BE ON CHARTERERS ACCOUNT

CLAUSE 8

FREIGHT RATE : .. PER METRIC TON ON FIOST BASIS 1/1

FREIGHT PAYMENT : FULL FREIGHT TO BE PAID INTO OWNER NOMINATED BANK


ACCOUNT ABOVE WITHIN FIVE (05) BANKING DAYS AFTER CHARTERER RECEIVE THE
INVOICE. RELEASING B/L MARKED "FREIGHT PAYABLE AS PER C/P" AND ALWAYS BEFORE
BREAKING BULK.

FREIGHT SHALL BE DEEMED EARNED, DISCOUNT LESS AND NON-RETURNABLE WHETHER


VESSEL AND/OR CARGO LOST OR NOT LOST. CARGO NOT ALLOW TO BE DISCHARGED
BEFORE OWNER RECEIVE PAYMENT IN FULL AMOUNT AND CONFIRMED BY THE OWNER
BANK.

CLAUSE 9

DEMURRAGE/DESPATCH: USD 25.000 PDPR/HALF DESPATCH.


DEMURRAGE / DESPATCH AT LOADING PORT SETTLED AND REMITTED TOGETHER WITH
FREIGHT. DEMURRAGE / DESPATCH AT DISCHARGING PORT TO BE SETTLED WITHIN
FIFTY (15) DAYS AFTER DISCHARGING IS COMPLETED
DEMURRAGE / DESPATCH ALWAYS BE CHARGED, NO DISCOUNT WILL APPLIED.

CLAUSE 10

IF CHARTERER NOT SETTLE PAYMENT OBLIGATION WITHIN THE SPECIFIED TIME LIMIT
(DUE DATE), THE CHARTERER LIABLE TO PAID PENALTY TO OWNER AND THE OWNER
WILL BE ENTITLED TO RECEIVE PENALTY OF 1% (ONE PERCENT) PER MONTH FROM THE
TOTAL OUTSTANDING OF PAYMENT.

CLAUSE 11
VESSEL DERICKS / CRANE / GRAB TB BE USED FREELY FOR LOADING AND DISCHARGING
AT LOADING PORT AND DISCHARGING PORT. IN CASE SHIP’S CRANE IS OUT OF ORDER,
OWNER MUST HIRE SHORE CRANE AND COST FOR OWNER’S A/C SHORE CRANE OR
FLOATING CRANE IF ANY ,USED FOR LOADING AT LOADING PORT AND DISCHARGING AT
DISCHARGING PORT SHOULD BE ARRANGED BY CHARTERERS AND ON CHARTERERS
ACCOUNT.

CLAUSE 12

CHRTS’ AGENT AT BENDS. PORT CHARGE AT BEND TO BE FOR OWNER’S A/C


WITH REASONABLE PDA AND OWS APPROVAL

CLAUSE 13

OWNER / MASTER / OWNER'S AGENT SHALL ADVICE 7/5/3/2/1 DAYS BEFORE ARRIVAL AT
LOADING / DISCHARGING PORT. 7/5/3/2/1

CLAUSE 14

ANY TAX / DUES ON CARGO AT LOADING / DISCHARGING PORTS SHALL BE FOR


CHARTERERS ACCOUNT
ANY TAX / DUE ON VESSEL SHALL BE ON OWNER ACCOUNT
ANY TAX / DUE ON FREIGHT SHALL BE ON OWS’S ACCOUNT

CLAUSE 15

OVERAGE PREMIUM IF ANY TO BE ON CHRT’S ACCOUNT

CLAUSE 16

IN ABSENCE OF ORIGINAL B/L AT DISCHARGING PORT, MASTER / OWNER / OWNER'S


AGENT SHALL ALLOW CARGO TO BE DISCHARGED AGAINST CHARTERER'S LETTER OF
INDEMNITY (LOI) IN OWNER'S STANDARD P&I CLUB WORDING WITHOUT BANK
GUARANTEE OR ENDORSEMENT

CLAUSE 17
AT L/D PORT, DFT SURVEY TB CARRIED OUT BY AN INDEPENDENT SURVEY-OR AT CHRS’
ACCOUNT AND ARRANGEMENT WITH ACCOMPANY BY MASTER OR C/O OF VSL AT THE
OWS’ SIDE. MATTER WITH STABILITY BOOKLET ON BOARD,IF THE EQUIPMENTS OF THE
DRAFT SURVEY IS DAMAGED AND THE DRAFT SURVEY CAN’T BE DONE PROPERLY,ALL
LOSS AT LOAD/DISCH PORT SHALL BE FOR OWNR’S ACCOUNT.
LOADING AND DISCHARGING QUANTITY SHALL BE ASCERTAINED BY JOINT DRAFT
SURVEY BETWEEN SHIPPER / CONSIGNEE / CHARTERERS SURVEYORS RESPECTIVELY
AND ACCOUNT

CLAUSE 18

ANY DISPUTES OUT OF THIS FIXTURE NOTE TO BE REFERRED TO ARBITRATION IN A


SINGAPORE INTERNATIONAL ARBITRATION CENTRE ACCORDING TO ENGLISH LAW AND
THE ARBITRATION SHALL BE CONDUCTED IN ACCORDANCE WITH THE SMALL CLAIMS
PROCEDURE OF THE SINGAPORE INTERNATIONAL ARBITRATION CENTRE. THE DECISION
SHALL BE FINAL
CLAUSE 19

AFTER AND SIGNING THE CONTRACT AND FAILING TO LOAD, CHARTERERS WILL BE
RESPONSIBLE TO PERFORM THE SHIPMENT AND COVER THE DEADFREIGHT IF ANY.

CLAUSE 20

COMM: 2.5% TTL ON F/D/D PAYMENT BY OWS. OTHER TERMS AS PER GENCON 1994

CLAUSE 21

CONGEN B/L TO BE USED, CARGO QTY ON B/L TO BE FINALIZED AND DETERMINED BY


SHIPPERS / CHARTERERS, OWNERS ARE NOT RESPONSIBLE FOR ANY DISCREPANCY IN
CARGO QUANTITY AND QUALITY ON DELIVERY

THE ABOVE CONTRACT WILL BE SIGNED BY FAX/SCAN EMAIL AND HAS THE SAME FORCE
AND EFFECT AS ORIGINAL CONTRACT.
