The American Convention On Human Rights

Qisas and Diyyah are concepts in Islamic law related to crimes involving harm or death, where Qisas refers to retaliation ('an eye for an eye') and Diyyah refers to financial compensation (blood money). The victim's family has three options: demand retaliation, accept compensation, or forgive the offender, with forgiveness being highly encouraged. Qisas applies to intentional and unintentional killings and bodily injuries, while Diyyah serves as an alternative to retaliation, providing compensation to the victim's family.

Qisas and Diyyah Crimes

1- Definition of Qisas and Diyyah

Qisas and Diyyah crimes are related to cases where someone is harmed or
killed. Qisas refers to retaliation, which is often explained as "an eye for an
eye." This means that if a person is killed, the family of the victim can
demand that the killer be punished in the same way. Diyyah, on the other
hand, refers to blood money, where the offender can pay financial
compensation to the victim’s family instead of facing the same punishment.
2- Choices for the Victim’s Family
In cases of Qisas and Diyyah, the victim's family has three options:

1. They can demand retaliation (Qisas) – this means the same punishment as
the crime committed, such as death for murder.
2. They can accept compensation (Diyyah) – this is financial compensation
instead of the punishment.
3. They can forgive the offender – forgiveness is highly encouraged in Islam
and is considered virtuous.

3- Examples of Qisas Crimes

Qisas crimes include:

 Intentional murder – deliberately killing someone.

 Unintentional killing – causing someone's death without intending to (like
in an accident).
 Bodily injuries – causing physical harm such as broken bones, scars, or
wounds.

Islam allows the victim's family to choose how to proceed in these cases, and
forgiveness is often seen as an act of great virtue in the eyes of Allah.
