Summary

On May 2, 2023, the Marion County School District was notified that a
teacher was alleged to have bullied/harassed a student during the 2022-2023
school year, resulting in the student’s suicide on April 27, 2023. The Alleged
Accused was identified as Legacy Elementary Teacher, Ms. Dawn White. On
May 2, 2023, the District opened an internal administrative investigation. Mr.
Tyson Collins, Special Investigator, was assigned as the District’s
investigator. The student will be identified as Student Victim throughout the
investigation.

On May 2, 2023, Investigator met with Complainants Ms. and


Mr. parents of Student Victim. Investigator asked the
to explain the circumstances surrounding their allegation of
bullying/harassment of Student Victim. reported that they had moved
from Virginia, and this was Student Victim’s first year in a Florida school.
said Student Victim received an “ on first progress report in
White’s class. said when she spoke to White about Student Victim’s
grade, White said Student Victim needed to participate and requested to meet
with them. During the meeting, Tyka said they discussed moving Student
Victim closer to the front of the class, but White continued to say Student
Victim needed to participate during class to pass. After the meeting, said
they would ask Student Victim every day if was participating in class.
explained Student Victim was afraid to raise hand during class because
did not know if had the correct answer.

On October 28, 2022, said Student Victim came home and expressed
no longer wanted to be in White’s class. reported Student Victim said

while was standing in line talking to friend, White said, “I don’t know
why you're talking because you don’t even know anything. You don’t know
nothing in this class. Isn’t that right kids?” said Student Victim reported
several students agreed with White’s comment. said she attempted to
contact the school, but the school day was already over, and she could not get
an answer. On October 31, 2022, said she contacted the school to set up
a meeting. After a week with no response, said she contacted the school
to request a meeting with White and was told they would send a message to
Ms. Murphy (Principal Shameka Murphy). said she was never contacted
by the school and just “let it go.” On January 9, 2023, said she requested
a parent-conference meeting with White after Student Victim said could
not stand being in White’s class because she was mean and because Student
Victim had an “ in the class. On January 12, 2023, said they had a
parent-conference meeting with all three of Student Victim’s teachers, which
included, White, James Oliver, and Tracy Willis. During that meeting,
said she asked White about the comment she made to Student Victim while
was in line. reported White became “defensive,” started to cry, and
suggested they go to her classroom. said White showed the classroom
to them but never addressed the comment she made to Student Victim.
reported White commented during the meeting that Student Victim was not
doing work in class but was talking about going to the beach and going
out to get crab legs with family. On February 21, 2023, said they
received an email from White informing them Student Victim was falling
asleep during class (Attached). said she thanked White and informed her
they would address the issue when got home. When spoke with
Student Victim about falling asleep in class, said Student Victim
demonstrated how was repeatedly blinking eyes, but not falling asleep.
On April 3, 2023, said she received an email from White about Student

email explaining Student Victim had “lost momentum” with the consistent
“ in her class. In the email, said she asked White if she had talked
to Student Victim to see if there was anything she could do differently to
inspire in her class. said she never received a response from White.
reported on April 27, 2023, the day of Student Victim’s death, Student
Victim told him never had these problems or grades when they were in
Virginia. reported Student Victim said White told during class, “It’s
ok, you got an reported Student Victim said students told when
is not in class, White talked about how bad grades are. reported
several weeks ago Student Victim told them another student had complained
that White makes feel like hurting reported Student Victim
said did not want a student to feel that way and was going to report
White. said she told Student Victim to “just mind your business”
because she did not want a target on back.

During the interview, reported Student Victim had confided in older

was also present during the interview. said she had video chatted with
Student Victim and said White was mean and had made feel bad about

reported that Student Victim said White would look at and say,
“So you just don’t know anything. Are you just not smart, you don’t know
nothing?” located a text message she received from Student Victim
on February 12, 2023, which read, “Ms. White is so mean. She laughed at my
grades and she talks about me. She keeps saying I sleep in her class but I
don’t.” On March 1, 2023, Student Victim texted “And I am telling

on Miss White to Deputy Jacobs the officer in my school because I don’t want
no other kid to feel like how I’m feeling in her class. (Texts Attached)”

On May 3, 2023, Investigator interviewed fourteen (14) Student Witnesses


who were in White’s class with Student Victim (Student Interview Log
Attached). Below is a summary of student interviews.

• Student 1 described how White would “get mad” if students had a bad
grade. Student 1 said White embarrassed on one occasion after
she got mad/yelled at for not turning in homework. Student 1
reported witnessed White laughing at a student (unknown) for
having bad grades and not turning in work. Student 1 said witnessed
White make a joke about Student 10, which made cry. Student 1
could not recall what the joke was about.
• Student 2 reported that White gets mad when students get “stuff”
wrong. Student 2 said White likes improvement. Student 2 said
thought White gets “stressed out” all the time. Student 2 said White
has told students their grades during class and tells them ways to
improve. Student 2 reported White got mad at when turned
work in late. Student 2 said White did not yell but spoke to in a
raised voice during class. Student 2 said witnessed students being
embarrassed and almost crying when White got mad at them. Student
2 identified Student 10 as one of the students.
• Student 3 said White yells at the bad students daily because they do
bad things. Student 3 identified Student 10 as a student whom she
witnessed White yell at.
• Student 4 said at times White can be “a little scary.” Student 4 said
when White is happy, she jumps around, but when she is mad, she

shows “her passion.” Student 4 said White wants them to succeed.
Student 4 reported that White yelled at students who had bad grades
but “not in a mean way.” Student 4 said White had told students their
grades during class and told them to fix them. Student 4 said she could
tell some students were embarrassed/uncomfortable because White
addressed their grade during class. Student 4 said if Student Victim
got a question wrong, White would “get mad at and say things
that would embarrass Student 4 explained Student Victim got in
trouble “a lot” because would talk and play around. Student 4 said
she thought White had less patience for Student Victim because she
knew could do better. Student 4 said White singled out several other
students as well. Student 4 said she had witnessed White yell at
students “a lot.”
• Student 5 said White “sometimes” points out students’ bad grades.
Student 5 said White yelled at in front of the class for writing
name big, which embarrassed Student 5 said witnessed White
yell at Student Victim in class after forgot homework.
• Student 6 said White called out students with bad grades during class.
Student 6 said if a student was laying their head down, White would
yell at them saying the reason they had bad grades is they never focus.
Student 6 identified Student Victim and Student 10 as students he
witnessed this occur too. Student 6 said White would “target” Student
Victim more than others. Student 6 said if laid head down to go
to sleep on the desk, White would just yell at to wake up. Student
6 said if Student Victim laid head down, White would shake
desk while yelling in ear and then contact his parents. Student 6
said White had embarrassed after laid head down on
desk. Student 6 described how White yelled at saying this was the

reason had a “ in her class. Student 6 said witnessed Student
10 comment about someone passing gas by saying, “Someone
smells.” Student 6 said White told Student 10, “It was you.”
• Student 7 said White told Student Victim to go get backpack.
When Student Victim left the class, Student 7 said White made a
“rude” comment about Student 7 could not recall what White
said. During recess, Student 7 said told Student Victim what White
said about which made Student Victim mad. Prior to this
incident, Student 7 said Student Victim asked White if would
check grades. Student 7 reported White started laughing at and
making fun of for wanting to check grades. Student 7
explained that White was laughing at because some of Student
Victim’s grades were During recess, Student 7 said Student
Victim was crying and told wanted to kill When
Investigator asked Student 7 why, Student 7 said, “Because Ms. White
has been picking on since the start of the school year.” Student 7
said White calls their class the “worst class.”
• Student 8 said White’s class is fun. Student 8 said witnessed White
yelling at students in class, but the students were “goofing off” and
she was trying to get their attention.
• Student 9 said witnessed White make fun of students’ grades in
front of the class. Student 9 said if Student Victim raised hand and
did not know the answer, White would get mad at Student 9
said White would tell Student Victim that she did not understand how
did not know the material, because they had been over it a lot.
Student 9 said White embarrassed after lost her folder and
White yelled at in front of the class. On another occasion, Student

9 said Student 10 had asked what smelled and White told Student 10,
“It’s you.” Student 9 said White yells at students “every single day.”
• Student 10 reported being nervous to raise hand in class because
if got the answer wrong, everyone would laugh. Student 10 said
White embarrassed when they were going to music class. Student
10 said was holding the door for the class when someone “farted.”
Student 10 said asked what that smell was and White replied,
“You. Now go in the class.” Student 10 said several students laughed
at which made feel sad and mad. Student 10 reported White
normally yells at the entire class.
• Student 11 reported if you do not know the answer to a question,
White will get mad and yell at you. Student 11 said White yelled at
when did not know the answer to a question. At the beginning
of the year, Student 11 said White had bullied Student 11 said
White bullied by pointing out hair, clothes, and
eyesight. Student 11 said White told in the presence of the class
pants did not look good on and needed to stop wearing
them. Student 11 said mother talked to White and told to stop.
Student 11 reported that when Student Victim did not know the
answer to the question, White would yell at Student 11 said
White had yelled at Student 2 for no reason when turned work
in. During class, Student 11 said asked her friend what page they
were on, and White called friend’s grade out saying, “That’s why
has an right now.” Student 11 said if White got angry, she would
say, “I’m about to quit.” Student 11 said White did not like their class
and said their class was the worst class ever.
• Student 12 said White yells at everyone in the class except for a couple
of students. Student 12 explained that if a student has bad grades,

White will call the student out. Student 12 said Student Victim asked
White what grade was and White told him, “ shut up. You
know what your grade is.” Student 12 said White had also done that
to along with several other students and felt like she was trying
to embarrass them. Student 12 said witnessed Student Victim ask
White if there was any make-up work after had missed a day of
school. Student 12 said White told Student Victim not to worry about
it and get in line. Student 12 said Student Victim then asked White if
she could check grades. Student 12 said White told Student Victim,
“No, shut up. Go in the line. You already know that you are

students. Student 12 reported White had yelled at Student Victim
“mostly every single day.” Student 12 said felt like White picked
on Student Victim.
• Student 13 reported White had been “a little bit rude.” Student 13 said
Student 10 was holding a door and asked what the smell was. Student
13 said White told Student 10, “It’s you.” Student 13 said White yells
a little bit. Student 13 reported White has told the class about students’
bad and good grades.
• Student 14 described White as mean/rude towards students when they
do nothing wrong. Student 14 said White yells at students and makes
them cry. Student 14’s mother was present, and she reported on
“several occasions” she had reached out to White about her attitude
towards Student 14. Student 14’s mother explained that she knew
something was wrong when Student 14 repeatedly came home crying
saying was not going back to school. Student 14 said would
come home crying because White always yelled at for no reason.
Student 14 said Student Victim asked White to see grades, and

White started laughing and told his grades were not good. Student
14 said while was reading book stopped and looked up at the
screen and White “screamed” at for looking at the screen. Student
14 said every time Student Victim walked into class, White would yell
at Student 14 said White yells at students every time they go into
class.

On May 3, 2023, twenty-eight (28) other Student Witnesses in White’s other


two (2) classes were interviewed (Student Interview Log Attached). Of the
twenty-eight (28) students interviewed, fifteen (15) students said White had
embarrassed them in class. Eight (8) students reported that they had witnessed
White embarrassing other students in class. Twenty-six (26) students reported
White yells during class. Thirteen (13) students reported White’s conduct to
their parents. Multiple students said White would get mad at them if they did
not know the answer to her questions during class participation. Multiple
students reported White would comment about students’ grades in class.
Listed below is other conduct by White reported by the students.

• Student 15 reported White had humiliated while in small groups


because did not know how to pronounce a certain word. Student 15
said White told should have learned how to pronounce that word
in third grade. Student 15 said White had put in the back of the
classroom and Student 15 said told White that could not see.
Student 15 said White told “Your mom should get you some
glasses then.” After Student 15 had been out sick and returned to
school, Student 15 said White told “Your mom did not come here
to get your work, so it’s not my fault. It’s your fault for not coming to
school.”

• Student 22 reported could not find a paper and White took all the
stuff out of backpack and threw it on the ground. Student 24 said
witnessed White dump Student 22’s backpack out on the floor while
yelling around the class that the backpack was messy.
• Student 26 reported once was sleeping in class and White moved
chair, causing to hit the ground. Student 26 said White started
screaming at telling needed to stop sleeping. Student 26
said hurt head/buttocks and had to go to the clinic. Student 29,
Student 30, Student 36, and Student 39 corroborated witnessing White
pull Student 26’s chair out causing to hit head on the table and
fall to the ground. Students reported White had laughed at Student 26
because she thought it was funny.
• Student 27 said White sat by while yelling at because she
thought was not doing work. Student 27 said this made cry.
• Student 33 said was crying in class because cousin had passed
away. Student 33 said White told while in the presence of the class
that could cry in class and slide down the stairway, but could not
produce work. Student 33 said a few seconds later, White told
thoughts don’t matter to her.
• Student 35 said while was reading White was talking on her phone,
which was distracting to Student 35 said when looked up at
White, White yelled at for looking up that one time. Student 35 said
if a student made a bad grade on an assignment, White would say the
student’s name, say what grade they got, and tell them they should have
been more focused and worked harder.
• Student 36 reported White yelled at during class, making cry.
Student 36 said had witnessed White yell at other students, making
them cry. Student 36 said witnessed White call students stupid.

• Student 38 reported that Student 36 got in trouble in class and White
yelled at and made cry. Student 38 said White told Student 36
that tears do not make her feel bad.
• Student 39 said White told the class only three (3) students in the class
were passing and she had to curve their grades so they would pass.
Student 39 said White has told the paraprofessional that she needs to
hold her back before she goes to jail. Student 39 said she thought White
meant “she wants to hit the student.”
• Student 40 reported feeling embarrassed after White was yelling at the
class and singled out saying should be afraid of her because she
calls dad twice a week.
• Student 42 said did not like being in White’s class because did
not like adults yelling at students.

On May 9, 2023, Investigator spoke with witness Ms. Nicki Williams, a P.E.
Technician at Sunrise Elementary. Williams’s one of White’s students but
did not participate in an interview. Investigator explained White was alleged
to have harassed/bullied a student in her class. Williams reported on March
28, 2023, her child came home from school and informed her was going to
have to report White. When Williams inquired about what was going on, her
child said White had gotten into face and yelled several times. Williams
said her child further reported that White held several students back from their
next class. Williams said when White sent the students to their next class, Mr.
Traci Willis’s class, White told Willis in front of the students, “Mr. Willis I’m
now sending over the students with the bad grades.” On another occasion,
Williams said her child reported sitting in class while White was writing on
the board. Williams said her child had taken the notes and was waiting on
White for the next steps. Williams reported her child said White asked in

the middle of the class what was going to do with that bad grade had.
Williams said her child reported felt “really sad” that White made the
comment to in front of the class. Williams said when her informed
her of what occurred she immediately notified Assistant Principal Marie-
Elena Curty via email (Attached in parent-correspondence). Williams said her
child did not want to stay in White’s class but because it was close to the end
of the school year, stayed in the class. Williams said Curty had her child
write a statement. The statement was written on March 29, 2023 (Attached).
According to the student’s written statement, White calls students out in front
of the class and will yell at them if they do not do the work. Also, the student
wrote that if you have a bad grade, White will call you out. The student wrote
White had called out several students. On another occasion, the student wrote
White had asked what was going to do about grades, which embarrassed
On Monday, March 27, 2023, the student wrote after finished
work, was waiting for White to provide more instruction. The student
reported White called name because she thought was staring into space.
The student reported White yelled at saying was just sitting and doing
nothing in front of the class. Because White was talking to the student
wrote looked at her and she told she did not know why was looking
at her because that was not going to change grade. The student said the
incident made upset.

On May 11, 2023, Investigator spoke with witness, Ms. Sherrie a


was one of White’s students but did not participate in the
interview. Investigator explained that White was alleged to have
bullied/harassed a student in her class. Investigator confirmed with
that her child was in White’s class earlier in the school year but was removed
and went to a different school, and said, “That is correct.”

explained her was enrolled in White’s class from August 10, 2022-
September 6, 2022. said during those three weeks there were
continuous concerns about incidents in White’s class. said after her
informed her of several incidents, she reached out to the assistant principal
(Curty). explained her had attended LES since the first grade and
had done “very well” there. said due to the incidents her
experienced she felt she had no other choice but to take out of LES. On
September 6, 2022, said her was unenrolled from LES and
received a “Hope Scholarship for intimidation.”

explained her was chosen by White on August 9, 2022, to be a


safety patrol. said White was the safety patrol sponsor in charge of the
students in the safety patrol. reported her went to the first and
second safety patrol meetings, but on August 24, 2022, her was not invited
to the third safety patrol meeting, which devastated said she
emailed White that night, inquiring why her was not invited but never
received a response. reported on August 25, 2022, she emailed the
assistant principal requesting a parent conference meeting with her
teachers. During the parent conference meeting, said she asked White
about her safety patrol status. reported White informed her that
her teachers from last year were spoken to, and no longer qualified
for safety patrol. said she was unaware at the time, but on August 25,
2022, her was pulled from “first-period instruction” by White’s co-
teacher (Digiugno) into the hallway. said White asked her why
mother had emailed her about safety patrol. said her informed her
that White told “You know you are bad right? You know you don’t do
your classwork, right?” said her said felt had to answer “yes”
or else would be in more trouble. At that moment, reposted that her

said felt scared, sad, and frustrated, and said had cried. On August
26, 2022, said she went to the school to speak to the principal about
her concerns and was redirected to the assistant principal. said the
assistant principal assured her she would look into her concerns and speak
with the principal. Later the same day, said she spoke with the co-
teacher about the August 25, 2022, incident. said the co-teacher
explained White had asked her to get her from third-period class.
said the co-teacher told her White had asked her questions about
safety patrol, but she could not recall what the questions were. said
the co-teacher confirmed her was upset, had tears, and had given her
three minutes before she sent back into the third period. reported
on the afternoon of August 25, 2022, she received an email from the assistant
principal and principal with a schedule change for her being placed into
White’s homeroom class with a co-teacher. Also, said she received a
phone call from the assistant principal explaining that her would be
reinstated on the safety patrol after speaking with the principal. On August 30,
2022, said she received an email from the assistant principal
requesting a conference. said the assistant principal explained it was
important to hear “the why,” that her was being removed from safety
patrol this quarter. explained the email said her would have the
opportunity to be selected during the next nine weeks. said this was
the second time her was removed from the safety patrol.

On September 1, 2022, said she received an email from White about


an incident in class with another student. This incident was investigated by
the administration and was unfounded. In the email, said White
reiterated the importance of her being present during their upcoming
parent conference. On the morning of September 2, 2022, said she

attended the parent conference with White, her and the assistant principal.
said her wrote several things wanted to share. While
was speaking, said White interrupted and made a comment.
said White requested a copy of the paper her was reading from.
said she declined the inappropriate request. During the meeting,
described White as being “agitated, impulsive, and could not control
her emotions.” said the meeting was stopped and White informed the
assistant principal she was going home. explained her had
described feeling uncomfortable, sad, mad, embarrassed, unhappy, and felt
left out while in White’s class. said her felt White was loud, mean,
and mad at read statements her told the assistant principal
during the August 22, 2022, and August 26, 2022, meetings.
• Ms. White announced in front of the class she was having a conference
with [my name] mom.
• Ms. White graded bell work and said the grade out loud. “F.”
• Ms. White said this was her bad class.
• Ms. White was nicer when other people were in the room.
• Ms. White said she was getting bad kids out of safety patrol.
• Ms. White would sometimes call by last name.
• Ms. White asked the class if [her name] was doing work and
the class would reply.
explained that she was concerned White was operating outside of
professional conduct while in an educational setting. Also, said she
was concerned about her that White acted unethically in her role as an
ELA teacher and the safety patrol sponsor. explained her
reenrolled at LES on March 21, 2023, at the start of the fourth quarter.
said when she was informed her would be back in White’s class, it raised
concern, but she entrusted the decision of the school. explained after

her first day back, White requested her be removed from her class.
said she obviously agreed to the schedule change.

On May 3, 2023, Investigator met with witness Dr. Ann Hembrook, Area
Superintendent. Investigator explained the allegation that a parent had alleged
their was bullied/harassed by White. Hembrook reported her staff
responded to the school to support the students and staff along with the Crisis
Management Team due to Student Victim’s death. Hembrook said she was
informed on Monday, May 1, 2023, of a conversation Principal Murphy had
with the student’s family regarding an accusation of bullying by White
towards Student Victim. Investigator asked Hembrook if Murphy was aware
of the alleged bullying by White, and Hembrook stated, “No, she wasn’t.”
According to Hembrook, White was not on campus on May 1, 2023.
Hembrook said Student Victim’s family was on campus distributing fliers
about suicide prevention with White’s name on them. Hembrook said the
family was asked to move off campus when distributing the fliers. Hembrook
said White heard about the fliers being passed out and came to the campus.
When White arrived on campus, Hembrook had administration take White to
a private room. Hembrook said she went to the private room with White
because White was “very distraught” and “very loud.” While in the room,
Hembrook said White explained all year she thought there was something
wrong with Student Victim. Hembrook reported White said she had three (3)
parent-teacher conferences about Student Victim. Hembrook said White
described how she met Student Victim every day at the reception desk to
check in and see how morning had started. Investigator asked Hembrook
if that was normal for a teacher to check in with a student. Hembrook said it
was normal for a teacher to check in with a student but typically, it would be
documented with the student services manager. Hembrook said if a teacher is

concerned about a student, the teacher should report that to the student
services manager or to the administration. Hembrook said when that happens,
they have a problem-solving meeting to decide if the student needs certain
interventions. Hembrook explained that typically when you do a check-
in/check-out with a student, the student is at least on Tier 2. Hembrook said a
Tier 2 means the student is receiving extra support and is on “our radar.”
Hembrook said she had asked the student services manager (Ms. Marie-Elena
Cox) if they had any documentation. Hembrook said Cox told her nothing had
ever been reported to her all year about Student Victim. Investigator asked
Hembrook if White had made any other comments to her. Hembrook reported
White said the night before Student Victim died (April 26, 2023), she gave
homework to assist with an upcoming test. Hembrook said White told her
Student Victim was unable to complete the assignment because had gotten
in trouble and had to do extra chores at home.

On May 8, 2023, Investigator met with witness Ms. Shameka Murphy,


Principal at LES. Murphy has been the Principal at LES for the last five (5)
years. Investigator explained that Student Victim’s parents had alleged their
was bullied/harassed by White. Murphy explained White was the fifth-
grade teacher for ELA (English Language Arts). Murphy said White has three
(3) separate classes she co-teaches (trio team) along with teachers James
Oliver (Math) and Tracy Willis (Science and Social Studies). Murphy said
White has Jennifer Digiugno, a support facilitator, who stays with one of the
classes throughout the day and supports students with ESE (Exceptional
Student Education) accommodations. Murphy said Student Victim was not in
the class that Digiugno supported. Murphy reported Robin Morin, an
inclusion teacher, assisted specific students in Student Victim’s class. Murphy
explained Morin was in Student Victim’s class but not every day. Murphy

said Maggie Zurakowski, paraprofessional, started “mid-year” and supports a
student with a medical condition in one of White’s classes, which Student
Victim was not in. Murphy said Assistant Principal Marie-Elena Curty,
oversees all of fifth grade. Murphy said Curty ensures all fifth-grade students
receive instruction material, are placed in the correct reading programs, and
facilitates parental concerns between a teacher and a parent.

Investigator informed Murphy that Student Victim was involved in an


incident with a gun resulting in death on April 27, 2023. Murphy explained
that she was not aware of what occurred with the student until May 1, 2023,
when Student Victim’s parents met with her. Investigator asked Murphy if she
was aware of anything that occurred on April 27, 2023, involving Student
Victim in any of classes. Murphy stated, “No I was not informed of
anything that involved the student.” Investigator asked Murphy what the
parents told her during the meeting. Murphy said the said White had
bullied their child and now is dead. Murphy reported the said
White made Student Victim sit out during recess and was controlling over
parental conference meetings. Murphy said the parents never went into the
details about either issue. Investigator asked Murphy if she was aware of the
parent-conference meetings White had with the Johnsons. Murphy said the
only thing White said about the parent-conference meetings was her concern
about Student Victim’s academics. Investigator asked Murphy if she had any
interaction with White when she was teaching in the classroom. Murphy said
she did “walk-throughs” in White’s classroom but only observed her teaching
students. Murphy said she did not see a setting that was inappropriate during
the “walk-through.” Murphy said White had taught at LES several years ago,
left to go to another school, and returned this year (2022-2023). Murphy
described White as being “very structured” and made sure her students do

their work. Investigator asked Murphy if she was informed of any issues with
White in the classroom. Murphy said two (2) parents were “adamant” their
child be removed from White’s class. Murphy said one parent felt White made
an inappropriate comment which embarrassed the student during class and the
parent also had a concern about her child being in the safety patrol. Murphy
said the parents wanted the student to move to a different class, but LES did
not have another class to support the student, so the student received a Hope
Scholarship and moved to a different school. Murphy explained the other
parents initially had concerns with the child’s grades. Murphy said the parent
returned with concerns after White “inappropriately indirectly” referenced the
child’s parent. Murphy said they were able to change the student’s schedule
to meet the student’s needs.

On May 8, 2023, Investigator met with witness Ms. Marie-Elena Curty, an


assistant principal at LES. Curty has been an assistant principal at LES since
the 2020-2021 school year. Investigator explained that Student Victim’s
parents alleged their was bullied/harassed by White. Curty reported being
responsible for pre-K, kindergarten, fourth grade, and fifth grade. When
Investigator asked Curty when she became aware of the allegations, Curty
stated, “When the parents came in (May 1, 2023).” Curty said the only
example the parents gave was that Student Victim did not have a good
participation grade. Investigator asked Curty if she was aware of anything that
occurred in White’s class with Student Victim on April 27, 2023. Curty said
the only report she received on Student Victim this school year was regarding
an incident that occurred off-campus. Investigator asked Curty if she went into
White’s classroom, and Curty replied, “Yes.” Investigator asked Curty if she
observed White treating students rudely or embarrassing them, and Curty said,
“Absolutely not.” Investigator asked Curty if she had witnessed or heard

White telling students their grades during class. Curty said a parent made that
allegation, but she had never heard White say anything like that. Investigator
asked Curty how many students were removed from White’s classes, and
Curty said, “Two.” Curty explained that two (2) other parents had reached out
with concerns but asked for them to be left in White’s class. Investigator asked
Curty if she heard White yell at any students, and Curty said, “No.” Curty
explained that White has a loud voice but didn’t yell. Curty described White
as a phenomenal teacher.

On May 8, 2023, Investigator met with witness Ms. Marie Cox, a student
services manager. Cox has been a student services manager at LES for the last
two years. Investigator explained that Student Victim’s parents had alleged
their was bullied/harassed by White. Investigator asked Cox if Student
Victim had any disciplinary issues from White’s class. Cox said she had
disciplinary issues with Student Victim, but not from White’s class. Cox said
White reported disciplinary issues during recess to her but nothing during her
class. Investigator asked Cox about the Multi-Tiered System of Support
(MTSS) for disciplinary issues. Cox said they follow “the Three Tier system.”
Cox said if she receives multiple referrals on a student for repetitive behavior
or if a teacher feels they have managed certain behaviors in class and would
like for a student to get more support, they can request it. Cox explained a
student on Tier 2 would receive points as an incentive for good behavior. Cox
said the student’s teacher would check in on the student along with providing
counselors and a social worker to provide them with the support they need.
Investigator asked Cox if Student Victim was on the Tier system. Cox said
White did not have any students on the Tier system. Investigator asked Cox if
any students reported to her that White had treated them rudely. Cox said
recently a student (Student 33) had eloped from the school. Cox said the

student was walking down the stairs and was sliding down the railings. Cox
said White told the student was being unsafe, and needed to stop. Cox
explained the student was upset during class because a family member had
passed. Cox said the student referred back to being upset in class and White
told the student, “I don’t care how you are feeling right now, you’re being
unsafe.” Cox said the student reported what White said as being rude.
Investigator asked if there were any consequences. Cox said the student was
given consequences for eloping. Cox said she informed the administration
about what had occurred. When Investigator asked Cox if any students
reported to her White had embarrassed them during class, Cox said, “Not that
I can remember.” Investigator asked Cox if any students reported to her White
yelled at the class or at a particular student, Cox said students reported White
had yelled but she could not recall the specific occasion. Cox said White was
“a loud person.” Cox explained when a student reports something to her she
will discuss the incident with them. Cox said if it seemed like White was
getting the class under control or the student was being disrespectful causing
her to raise her voice, or the student was ignoring her requests and she raised
her voice, then I leave it at that. Cox said she has not had a student report more
than that. Cox said she also informed students if they have a “really big
concern” to let their parents know and they need to contact the assistant
principal. When Investigator asked Cox if she knew how many students
reported to her that White yelled during class, Cox stated, “Not more than five
(5).” Investigator asked Cox if any student reported to her that White was
mean. Cox said students reported incidents to her using the word “mean” but
after talking through it, the students felt she was not that mean, and White was
just correcting them. Cox could not recall a specific example and said “maybe
two” students had reported White was mean. Cox said she witnessed White
“raising her voice” to redirect a student but nothing demeaning. Investigator

asked Cox if she was aware of anything that happened to Student Victim on
April 27, 2023. Cox said since that day (April 27, 2023), a student reported
Student Victim was “writing lines” during recess and at lunch for dad as a
punishment the day before or on April 27, 2023. Cox said the student informed
her Student Victim wrote “ five hundred times.

On May 8, 2023, Investigator met with witness Ms. Maggie Zurakowski, a


paraprofessional. Investigator explained that Student Victim’s parents had
alleged their was bullied/harassed by White. Zurakowski reported serving
as the paraprofessional in White’s homeroom class, which Student Victim was
not in. Zurakowski said she spent forty-five minutes in White’s class every
day since February 2023. Prior to working with White this school year,
Zurakowski reported working with White during summer school and tutoring.
Zurakowski described White as a phenomenal teacher who was passionate
about teaching students. Zurakowski said White was a “loud teacher.”
Zurakowski denied witnessing White treat any students rudely or embarrass
them. Investigator asked Zurakowski if she heard White referring to a
student’s grade during class, and Zurakowski said, “No.” Zurakowski denied
witnessing White making mean comments to students. Investigator asked
Zurakowski if she heard White yelling at students, and Zurakowski said,
“No.” Investigator asked Zurakowski if any students reported to her that
White had treated them rudely, and Zurakowski said, “One.” Zurakowski
explained on April 25, 2023, during recess, Student 14 reported to her “She
yells a lot” and looked in the direction of White, who was with another staff
member and students. Zurakowski said she did not know whom Student 14
was talking about because did not specifically say the person was
referring to. Zurakowski explained Student 14 informed her had been gone
for a couple of weeks and “she” was mad because had not been there.

Zurakowski said she explained to Student 14 they only had a couple of weeks
left and White wanted to get everything in before the end of the year.
Zurakowski said she informed Student 14 she could take to
administration, and could report whom was talking about, but the
student walked off. Investigator asked Zurakowski if any students reported to
her that White had embarrassed them. Zurakowski said Student 26 told her
was sleeping during class and White had shaken chair causing to fall
out. Zurakowski said the student was laughing when told her what
occurred. Zurakowski reported that when she is in White’s class the students
are normally working and the classroom is quiet. Zurakowski said she has not
witnessed White yelling or belittling any students. Zurakowski said White has
“high expectations” for her students.

On May 8, 2023, Investigator met with witness Ms. Jennifer Digiugno, a


support facilitator (ESE teacher). Investigator explained that Student Victim’s
parents had alleged their was bullied/harassed by White. Digiugno
explained she is assigned to White’s homeroom class for the entirety of the
day, which Student Victim is not in. Digiugno said she has worked with White
during previous school years. Digiugno said White has clear expectations for
every student and was one of the most loving and caring people she had ever
met. Investigator asked Digiugno if she had witnessed White treat students
rudely or embarrass students during class, and Digiugno replied, “Not that I
have seen. No.” Digiugno denied witnessing White single out any students
during class by calling out a student’s grades. Digiugno said White had told
students if they do not complete their work, their grades will not reflect a
passing grade. Investigator asked Digiugno if she heard White yelling at
students during class. Digiugno described White as a “loud person” and said
at times she has heard White “raise her voice,” which Digiugno said every

teacher has done. Digiugno said White will get excited at things she is telling
her, and the students will say, “Ms. D, she’s yelling at you.” Digiugno said
she tells the students White was not yelling at her but was just excited about
what she was talking about. Digiugno denied hearing White make mean
comments towards any students. Investigator asked Digiugno if any students
had reported to her that White was rude, had embarrassed them, or yelled at
them. Digiugno said a few students reported to her White had yelled at them.
Digiugno said she talked through the conversation with the students and
explained how she viewed the conversation with the students. Digiugno said
after she had a conversation with the students they were “usually fine.”

On May 8, 2023, Investigator met with witness Ms. Robin Morin, an


inclusion teacher. Investigator explained that Student Victim’s parents had
alleged their was bullied/harassed by White. Morin said she provides ESE
services to a select few students. Morin said she is in White’s class about thirty
minutes a day, three to four times a week. Morin said she is in one of White’s
classes from 7:55 am-8:25 am. Morin said she is in the same class Student
Victim was in from 10:00 am-10:30 am. Morin described White as “very
dedicated” and puts her heart and soul into those students. Morin said White’s
teaching style was very different than how she would teach. Morin said she
was quieter and more laid back and White makes sure all the students hear
her. Morin explained if White has a problem with one student, she will address
that student in front of the class. Investigator asked Morin if White
embarrasses students when she does that, and Morin replied, “Sometimes.
Yes.” Investigator asked Morin how often she had witnessed White call out a
student during class, and Morin replied, “Once or twice a week.” When
Investigator asked Morin if she had witnessed White speak rudely to a student,
Morin stated, “I would not consider it to be rude. Because what she says is

true. What she is pointing out is just very embarrassing for the student.” Morin
denied witnessing White calling out a student’s grade. Investigator asked
Morin if she had witnessed White yelling at a particular student or the class,
and Morin replied, “Yes. Both” Morin said she has not witnessed White being
rude to Student Victim. Investigator asked Morin if she witnessed White
embarrassing Student Victim. Morin explained several weeks ago Student
Victim was falling asleep and White had Student Victim stand by the window
and complete work. Morin said that was the only thing she could recall
throughout the entire year because it recently happened. Investigator asked
Morin if any students reported to her that White yelled at them. Morin
explained all the students are aware the yelling is going on, so there is no need
to come to me to report that. Morin denied having any students report to her
that White had embarrassed them. Investigator asked Morin if she reported
her observation to the administration, and Morin said, “Not this year. No.”
Morin could not recall anything specific involving Student Victim on April
27, 2023.

On May 8, 2023, Investigator met with witness Mr. James Oliver, a teacher.
Investigator explained that White was alleged to have bullied/harassed
Student Victim. Oliver is a fifth-grade math teacher that team teaches with
White and Willis. Oliver reported Student Victim was in his homeroom class.
Investigator asked Oliver if he noticed anything with Student Victim on April
27, 2023. Oliver explained Student Victim starts with him in homeroom and
at the end of the day, he takes his class to the bus/carline. Oliver said he
observed Student Victim writing on a yellow tablet while in line on the floor.
Oliver said he asked Student Victim what was doing, and Student Victim
said had to write sentences before went home. Oliver reported Student
Victim said had gotten in trouble and had to write sentences. When

Investigator asked Oliver if Student Victim had to write sentences for the
school, Oliver stated, “No. said for home.” Oliver said the Student Victim
was smiling and did not appear upset. Oliver said he put Student Victim on
the bus and was the last person from the school to see him. Oliver explained
when Student Victim is in his class he frequently had to “redirect to pay
attention. Investigator asked Oliver if any students reported to him that White
treated them rudely or embarrassed them during class, and Oliver said, “No.”
Oliver denied any students reported to him that White called out their grades
during class. Oliver denied any students reported to him that White had yelled
at them during class. Investigator asked Oliver if he was present during a
parent-conference meeting with the Oliver said he was in the
meeting in White’s classroom with White and Willis. Oliver said the only
thing he recalled was the parents coming to an understanding that Student
Victim was not telling them everything that was going on during class.
Oliver did not recall the confronting White about an incident with
Student Victim. Oliver said he could only remember having one parent
conference meeting with the which was in White’s classroom.
Oliver described White as a “very passionate teacher.”

On May 8, 2023, Investigator met with witness Mr. Tracy Willis, a teacher.
Investigator explained that White was alleged to have bullied/harassed
Student Victim. Willis is a fifth-grade science teacher that team teaches with
Oliver and White. Investigator asked Willis if he noticed anything with
Student Victim on April 27, 2023. Willis said Student Victim “seemed
somber.” Willis said Student Victim looked like had gotten into trouble at
school. Willis said Student Victim always wanted to make people laugh
during class and at times would do it during inappropriate times.
Investigator asked Willis if any students reported that White had treated them

rudely or embarrassed them during class, and Willis said, “No sir.” Willis
denied having any students report to him that White had called their grades
out during class or that White had made a mean comment to them. Investigator
asked Willis if any students reported that White yelled at them, and Willis
said, “No.” Willis said there were times when he entered White’s classroom
and witnessed White speaking loudly to the class, but not yelling. Willis said
it was usually because the students were not doing their work. Investigator
asked Willis what he recalled about the parent-conference meeting with the
Willis said he came to the meeting in White’s room a few minutes
late. Willis said the were upset that Student Victim’s grades were so
low. Willis explained White informed them that Student Victim needed to do
work in class. Investigator asked Willis if he recalled any confrontation
with White, and Willis said, “No.” Willis said he only remembered a
discussion about Student Victim’s grades being low and if could do
anything to bring them up. Willis said White informed them she would drop
Student Victim’s lowest two grades.

On May 12, 2023, Investigator met with the alleged accused, Ms. Dawn
White, a teacher. Investigator explained that she allegedly bullied/harassed
Student Victim and other students. White reported teaching for the last seven
(7) years. White described Student Victim as her “Fresh Prince of Bel-Air.”
White said Student Victim reminded her of actor Will Smith because was
tall, handsome, charismatic, and playful. Investigator asked White if Student
Victim’s behavior during the school year made her feel like there was
something wrong with and White said, “Yes.” At the start of the school
year, White explained Student Victim immediately showed signs of needing
some accommodations (IEP/504). White said she had a parent conference
with the and suggested moving Student Victim to a different class,

which had a support facilitator (Digiugno). At the time, White said did
not want to move Student Victim. White said the next day, the school received
documentation from Student Victim’s prior school. White said the documents
showed they had tried to test for an IEP/504 but the parents refused the
testing. White reported having a second parent conference with the
where she discussed Student Victim’s lack of effort, not turning in
assignments, and sleeping during class. White reported having a third
parent conference at the request of Student Victim’s mother ( White
said Oliver and Willis were also in attendance because Student Victim was
“failing across the board.” During the meeting, White said she asked if Student
Victim reads at home. When replied, “No,” White said she informed
them, “And that is the concern.” White said she gave the parents some ideas
on how to improve Student Victim’s reading at home. White said they were
in Willis’s classroom initially, but moved to her classroom so they could see
her classroom setup. At the conclusion of the parent conference, White said
everyone was smiling and of one accord. Investigator asked if White if the
parents had asked her about an incident involving Student Victim while
was in line talking to friend, and White replied, “Not that I can recall.”
Investigator explained to White the reported she told Student
Victim, “I don’t know why you are talking because you do not know anything.
You don’t know nothing in this class. Isn’t that right kids?” White said she
recalled several incidents where Student Victim would be horse playing in
line and she told them, “Hey you guys were literally just not doing your work
but now you’re playing in line.” Investigator asked White if she made the
comment to the that Student Victim was not doing work during
class, but was going to the beach and got to eat crab legs. White said she
told the the problem was Student Victim was not completing
work but would come to class and say went to the beach that weekend.

White said she explained Student Victim had an “F” but was still out having
fun.

Investigator asked White if she provided extra support for Student Victim, and
White said, “Always. has had extra support the entire school year.” White
said she provided extra support for behavior issues and grade performance.
White said she had switched Student Victim’s seat and switched
classroom. Investigator asked White if she was meeting Student Victim at the
start of each school day, checking in. White stated, “No. Not at the
beginning of the school year. This started after the vaping situation.”
Investigator asked White if she reported any of her concerns with Student
Victim to the administration, and White said, “No. I have never even written
a referral.” Investigator asked White why she did not report her concerns
to the administration, and White said, “Because they were not severe enough
for me to report to the administration.” Investigator asked White if there was
anything she recalled with Student Victim on April 27, 2023. White said she
had given Student Victim homework to help prepare for an upcoming
test. White said Student Victim did not complete the work because had
gotten in trouble at home, and had to write sentences and do extra chores.
White said Student Victim did not tell her what the sentences were about.

Investigator asked White how the Student Victim’s class was, and White
replied, “I always say it’s the roughest class.” Investigator asked White if she
told the class that or told them they were the worst class, and White said, “Not
in those words.” White said she never told the class they are the worst class.
When Investigator asked if she made Student Victim sit out during recess,
White said, “I have made the entire class sit out. Never individually.”
White denied calling Student Victim’s grade out during class. Investigator

asked what she did when Student Victim had asked what grade was, and
White replied, “I would tell to check his portal.” White denied making
any comments about Student Victim’s grades when was not in class.
Investigator asked White if she told Student Victim was failing during
class, and White said, “No. They have access to their portal where they can
check their grades at any time.” White denied laughing about Student
Victim’s grades during her class. When Investigator asked White if she had
an idea why Student Victim would call her mean, White replied, “Absolutely.
Because does not like reading in ELA or writing.” White said she would
hold Student Victim accountable in class.

Investigator explained to White that other students provided information


describing similar conduct they had experienced. Investigator informed White
students reported when they did not complete their work, she would get mad
and yell at them, which White denied doing. White said she was a structured
teacher but did not yell at students. White said she raises her voice collectively
but not at a specific child. Investigator asked White if she yelled at students
who got answers wrong, and White said, “No. They are ten. They’re going to
get answers wrong.” When Investigator asked White why students would
report that, White stated, “Because they’re kids.” Investigator explained to
White a student reported when had head down, she called out in
class saying that was the reason had a “D” in the class, which White denied
doing. White said she had almost seventy kids and could not remember each
student’s exact grades. White said if a student was laying their head down, she
would tell them to sit up. White said she has never called out a student’s grade.
Investigator asked White if she recalled when a student asked what that smell
was, telling the student, “It’s you.” White stated, “No.” White said she spent
her own money purchasing hygiene items for students. White said that was

“insane.” Investigator asked White if she had dumped out a student’s
backpack during class. White said she had dug into backpacks several times
to help students locate paperwork. White stated, “I have never dumped it out
in a malice way at all.” Investigator explained to White that it was reported
the backpack was dumped out while she told the class, “Your backpack’s
messy.” Investigator asked White if that was something that happened, and
White stated, “Not in a malicious way. I literally said you need to get rid of
all this stuff. How are you going to find your work? You got papers from the
beginning of the school year.” White said she helped several students organize
their backpacks and binders. Investigator asked White if she woke a student
up in class causing to fall and hit head. White explained she had
“tapped” on the student’s chair, which scared the student, causing to jump
up. White said the student did not bump head. White said they both
laughed because it scared so badly. Investigator asked White if she had
yelled at students making them cry during class. White said students had cried
because they did not do their work and not because she had yelled at them.
Investigator explained to White that almost every student interviewed
reported she had yelled during class. White said she had a loud, structured
voice. White stated, “I’m not singling out or yelling at any kids to be malicious
or harmful to them.” White concluded the interview by explaining students
were interviewed after the passed out fliers in the car line accusing
her of making Student Victim take life. White said she did not think any
of the interview process was fair. White said she was a great teacher and the
data reflected that.

Findings/Conclusion
On April 27, 2023, Mr. and Ms. alleged their
committed suicide. After reflecting on previous conversations with their

they felt was bullied/harassed by Ms. Dawn White. The described
how their complained that Ms. Dawn White was mean, had embarrassed
and discussed grades during class. In a text message exchange with
sister, wrote that did not want any other student to feel how felt
and wanted to report Ms. Dawn White to the School Resource Officer.
Multiple students were interviewed who were in Ms. Dawn White’s class with
Student Victim. Multiple students described how Ms. Dawn White had
embarrassed Student Victim, laughed at low grades, and yelled at for
several reasons mostly related to student performance. One student reported
that Ms. Dawn White had picked on Student Victim since the start of the year.
While multiple students corroborated Ms. Dawn White’s treatment of Student
Victim, was not the only student who had experienced being embarrassed.
Multiple other students also described being singled out and embarrassed by
Ms. Dawn White during class. Students reported how Ms. Dawn White called
out their bad grades which embarrassed them, made comments they felt were
mean, and yelled at students for several reasons, mostly related to student
performance. When students were interviewed from Ms. Dawn White’s other
two classes, they reported similar treatment including Ms. Dawn White’s
ongoing yelling at students to the point of making them cry. Ms. Robin Morin
spent a half-hour in two of Ms. Dawn White’s classes three to four times a
week assisting several students. Ms. Robin Morin said she witnessed Ms.
Dawn White embarrassing students in class weekly. Also, Ms. Robin Morin
witnessed Ms. Dawn White yelling at students, which she said all the students
were aware occurred. Although Ms. Robin Morin witnessed unprofessional
conduct by Ms. Dawn White, she failed to report the conduct to
administration. Ms. Dawn White denied calling out any student’s grades in
class. Ms. Dawn White denied embarrassing students or yelling at students in
a malicious way. Yet, Investigator presented Ms. Dawn White with multiple

specific incidents that students provided as examples of how she had treated
them. While Ms. Dawn White denied most of the incident’s students reported,
she did recall several incidents slightly different than students reported. Ms.
Dawn White said she felt the investigation was flawed due to students being
interviewed after the passed out fliers in the car line accusing her of
making Student Victim take life. Yet, students and parents reported the
same conduct by Ms. Dawn White to staff/administration throughout the
2022-2023 school year, prior to the incident with Student Victim.
Furthermore, the administration and staff received several complaints from
students about Ms. Dawn White yelling and being mean prior to the incident
with the Student Victim. Those student reports resulted in no action taken
other than a conversation with the students who made the report. Also, several
parents of other students in Ms. Dawn White’s class reported similar conduct
by Ms. Dawn White to the administration prior to the incident with Student
Victim. Those reports resulted in students being removed from her class,
students transferring to another school, or remaining in her class. The conduct
students endured in Ms. Dawn White’s classes was unprofessional, and
egregious, and should never occur in the classroom.

In conclusion, the internal administrative investigation found that Ms. Dawn


White chronically inflicted psychological distress on multiple students by
verbally insulting, humiliating, and embarrassing students which created a
hostile educational environment. Ms. Dawn White’s actions were found to
have violated Marion County School Board’s Anti-Harassment Policy
Po3362. Also, Ms. Dawn White was found to have violated the Principals of
Professional Conduct for the Educational Profession 6A-10.081(2)(a)(1),
which states that Florida educators, “Shall make a reasonable effort to protect
the student from conditions harmful to learning and/or to the students mental

and/or physical health and/or safety.” Lastly, Ms. Dawn White’s actions were
found to have violated the Principals of Professional Conduct for the
Educational Profession 6A-10.081(2)(a)(5), which states that Florida
Educators, “Shall not intentionally expose a student to unnecessary
embarrassment or disparagement.
