MEMORANDUM OF DEPOSIT OF TITLE DEEDS

This Memorandum of deposit of title deeds executed on this


day
of March 2024 by 1) Mr.M.V.ARUMUGHAM (Aadhaar No.8421 1194
0985) [PAN : AJBPA5263B] S/o.AR.Muthappan 2) Mrs.M.Vijayal
(Aadhaar No. 7705 3088 2860) [PAN : AKGPV4053L ] W/o.
AR.Muthappan both residing at No.24/91, Kumaran Illam, EB Central Office
Near, Mettur Dam – 636 401 Hereinafter called ‘the security owner/s’
which term shall wherever the context mean and include her/his /his heirs,
executors, administrators, legal representatives, successors and assigns.

IN FAVOUR OF

BANK OF INDIA, a body corporate constituted under Banking Companies


(Acquisition and Transfer of Undertaking) Act 1970 having its registered
office at Star House, Plot No. C-5, G Block, Bandra - Kurla Complex, Bandra
(East), Mumbai — 51 and Branch office among other placed at BANK OF
INDIA, SAIBABA COLONY BRANCH, No.181, S.R.Complex, Raja
Annamalai Road, Saibaba Colony, Coimbatore -641 011 (Hereinafter referred
to as "THE BANK" which expression shall unless excluded by or repugnant
to the context, be deemed to include its successors and assigns (hereinafter
called as the Mortgagee)

WHEREAS 1) Mr.M.V.ARUMUGHAM S/o. AR.Muthappan 2) Mrs. M.Vijayal

W/o. AR.Muthappan have been sanctioned to HOUSING LOAN of

Rs.27,00,000/- (Rupees Twenty Seven Lakhs Only) by the above said

bank.

WHEREAS the security owner/s has/ have agreed that the repayment of the

said loan and advances of HOUSING LOAN of Rs.27,00,000/- (Rupees

Twenty Seven Lakhs Only) to 1) Mr.M.V.ARUMUGHAM S/o.

AR.Muthappan 2) Mrs. M.Vijayal W/o. AR.Muthappan shall be secured by

deposit of title deeds of immovable properties belonging to her/his as

security.

NOW THIS MEMORANDUM OF DEPOSIT OF TITLE DEEDS WITNESSETH:

THAT in consideration a sum of Rs.27,00,000/- (Rupees Thirty Laksh


Only) to 1) Mr.M.V.ARUMUGHAM S/o. AR.Muthappan 2) Mrs.
M.Vijayal W/o. AR.Muthappan agreed to be received by the borrowers from

the Bank and as security for the repayment of the said sum to the borrowers
together with interest and other monies thereon that may become due and
payable, the security owner/s has/have deposited on 12-03-2024 with the
Bank its Branch Office at BANK OF INDIA, Saibabacolony BRANCH the
title deeds more fully described in Schedule I with an intention to create an
equitable mortgage by deposit of title deeds of the property described in
schedule II to secure the loans and advances of said sum to the borrowers
due and owing by the borrowers including interest, penal interest,
commitment charges, cost, charges and other monies that may become due
and payable from time to time by them to the Bank.

The security owner/s confirms that the said properties belong to


her/him absolutely and no one else has any interest therein. The said
properties are under her/his sole occupation.

The security owner/s declares that the documents mentioned in


Schedule I and deposited with the Bank are the only documents of title of
the security owner relating to her/him and that there are no other
documents of title to the Schedule properties. There are no claims from
revenue / tax authorities and that there are no attachments in respect of the
properties. The security owner is in actual possession of the properties
mentioned in Schedule II tinder and is not subject to any agreement for sale
or otherwise.

The security owner/s further confirms that any renewal, interchange,


realignment, re schedulement of any / all of the credit facilities under the
aforesaid Credit Limit shall not affect the said equitable mortgage and they
are equitably mortgaged by way of deposit of title deeds within the meaning
of Section 58 (F) of the Transfer of Property Act 1882.

The loan is granted for the agricultural purpose, hence this document
is exempted from the stamp duty as per the orders of G.O.M.S.73/2006
dated 22.07.2006.

Coimbatore North Taluk, Chinnavedampatti Village, A land measuring
10.16 ½ acres in SF No. 293/1A, 295, 296/1, 296/2 & 296/3 of was
developed into a Layout of Housing Sites by name “VIP Urban Centre” and
was approved by the Director of Country Planning Chennai vide DTCP No.

16/2016, In this Site No. 79

Boundaries:

The above property is situated at S.F. No. 295 /1A1A1 as per patta
No.1997 of Chinnavedapatti Village, within the limits of Coimbatore
Corporation.
