Draft a Mortgage Deed (English Deed) between Shri ABC


Shri XYZ
THIS DEED OF MORTGAGE made and executed at Pune this day of 20
BETWEEN

Shri ABC, age 50 years, Occupation: Business, resident of House No. 333 Kothrud. Pune
411038, hereinafter called the MORTGAGOR, (which expression shall, unless repugnant to the
context, mean and include his heirs, executors, administrators and assigns) OF THE ONE PART
AND

Shri XYZ, age 55 years, Occupation: Business, resident of 444 Guruwar Peth, Pune-411002
hereinafter called the MORTGAGEE, (which expression shall, unless repugnant to the contexXt,
mean and include his heirs, executors, administrators and assigns) OF THE OTHER PART.
WHEREAS, the Mortgagor is absolutely seized and possessed or is otherwise well and
sufficiently entitled to an absolute estate of inheritance or an estate equivalent thereto free from
encumbrances to the lands, hereditaments of the revenue village Kothrud, Taluka Haveli, District
Pune, fully mentioned and described in the Schedule written hereunder.
AND WHEREAS, the Mortgagor having occasion to borrow a sum of ?
Six Lakhs Only) approached the Mortgagee which the Mortgagee has 6,00,000/- (Rupees
on having repayment thereof with interest at 6 per cent per agreed to lend and advance
annum and secred by a conveyance
by way of mortgage of the said property.
NOW, THIS INDENTURE WITNESSETH as follows:
1 That, in consideration of the sum of 6,00,000 (Rupees Six
to the said Mortgagor by the said Lakhs Only) this day paid
Mortgagee (the receipt whereof the said Mortgagor
hereby acknowledges), the Mortgagor hereby agrees with the covenant to pay to
Mortgagee on the day of 20 the sum of 6,00,000/- (Rupees Six the
Only) with interest thereon in the meantime at Lakhs
the rate of 6 per cent per annum
computed from the date of this deed such interest to be paid monthly and
on the 15th of every current month. every month
2. That, for the consideration aforesaid the said
hereby grant, transfer convey unto and to theMortgagor
as the beneficial owner, do
use
bearing Plot No. 100of the revenue Kothrud Taluka of the said Mortgagee, property
further details in the schedule written hereunder, TO Haveli, District Pune, described in
HAVE AND TO HOLD the same
absolutely and FOR EVER PROVIDED ALWAYS that if the MortgagÍr shall pay or
cause to be paid the sum of 6,00,000/- (Rupees Six
Lakhs Only) with interest thereon.

3. That, the Mortgagor do hereby covenant unto the Mortgagee that the Mortgagor has

indefeasible title to grant, convey, transfer, assign and assure the same unto and to the
use of the Mortgagee in the manner hereinbefore indicated and
further the Mortgagor
and all persons having lawfully or equitably any estate or interest in the same shall at all
times hereafter during the continuance of the security do execute or
perform or cause to
be done, executed and performed all such further or other acts, deeds and
things as may
be reasonably required for further and more perfectly assuring the same unto and in
favour of the Mortgagee.
4. That, if the Mortgagor commits any default in payment of the principal amount on the
due date or any three instalments of interest, whether they have been demanded or not it
shall be_lawful for the Mortgagee to institute a suit for sale and to have a Receiver
appointed over the mortgaged property.
THE SCHEDULE OF THE PROPERTY ABOVE REFERRED TO
Allthat piece and parceDof land situate within the Registration Division and District Pune,
Sub-Division and Taluka Haveli, within the local limits of the Pune Municipal Corporation.
revenue village Kothrud, bearing property bearing Plot No. 100 out of Survey No. 300, of the
revenue Kothrud, Taluka Haveli, District Pune, admeasuring about 1,200 sq. ft., and bounded by
as follows:
On or towards the East Plot No. 101,
On or towards the South Plot No. 102,
On or towards the West Plot No. 103, and
On or towards the North Nullah.
IN WITNESS WHEREOF the parties hereto have signed hereunder at Pune the date first
