MAIN ASSIGNMENT – 30% of Course Grade


Due: November 22, 2022 turned in during class

Instructions

1. You will provide answers in your assignment to the questions provided in the following
section.

2. Pay attention to bad grammar, spacing and formatting etc. Marks will be reduced
accordingly. Ensure also your content is understandable.

3. This is an individual based assignment, you may collaborate together however individual
paper’s must be submitted, and they must not be the same – it must be your own
individual work submission. Each person will be given a zero if your paper submission is
found to be the same as another individual.

4. No plagiarism. If you cut and paste any words that are not your own you must put
quotation marks before and after the words. Then you must footnote right after the last
quotation mark.

You can do this in MS Word by pressing Reference, AB Insert Footnote. It will


automatically put a little number up and drop you to the bottom of the page where you
then insert where you got the information from. If you got it from one of my handouts,
just state, DS Handout No. (then insert the information: (chapter PowerPoint number and
slide number where it came from). If you are cutting and pasting it from anywhere else
you must insert the https:// address from the top of the page where you got it from.

I do not want to see a list of sources at the end of the assignment paper. If you get any
idea from anywhere, and you re-write it, you place a footnote as well stating the
following: “paraphrased from: (then insert the https: address).

5. Use a 12 point FONT: Arial, Calibri or Tahoma. Double space and line everything up to
the left column alignment.

6. Do not use bullets (black dots) when listing items, instead use numbers or letters.

Introduce a list with a sentence that ends with a colon, (two dots) ( : ), then after each
numbered or lettered item you use a semi-colon (; ) until the last item on the list then you
use a period. (.). Use subtitles where appropriate to help organize topics under
headings.

Assignment

Case Facts

Angelina Jolie works at the Roses Are Us Warehouse. She and 4 other workers in her unit,
Hallie Berry, Britney Speers, Lindsay Logan and Myley Cyrus are given orders of roses and they
assemble them with ribbons, place them in boxes, package them into other shipping boxes and
then place them on a pallet for shipping via truck delivery. The warehouse has a security
camera at the loading dock.

The truck is driven by Ellen DeGeneres. DeGeneres has the job of delivering the items and
unloading them at place of delivery but not loading them.

The Manager/owner of the business other than these 5 employees is Brad Yogurt Jr.

The work day is Monday through Friday 7:00 am to 5:00 pm.

On a Friday afternoon Brad rushed in at 3:30 pm and told the unit of Angelina, Hallie, Britney,
Lindsay and Myley they had a rush job and they needed to get 200 orders out for a special
event that night and if they needed to work over-time to get the job done, then no problem.
He said the event started at 7:00 pm and the roses had to get out to the event no later than 6:00
pm for set up and the event was about an hour away by truck and needed to be done as soon
as possible so Ellen could get going as it would be rush hour and she needed all the time she
could get on the road to the delivery point.

On hearing the order, Ellen got all nervous and said there is no way she could avoid rush hour
and she needed to get going as quick as was possible. Brad went back in his office.

The ladies are all friendly with one another. They would regularly hug each other, hold hands,
laugh, pinch each other, mess each others hair, sometimes grab each others arms and legs
jokingly.

Ellen did not like this and complained to Brad twice that the ladies were engaged in appropriate
sexual conduct that was against her religion and she felt they were all sinful and should not
touch one another and did not dress appropriately as she felt their clothes were too revealing.

The other ladies felt Ellen was very odd and ignored her and occasionally laughed at her and
made faces or blew her a kiss or made funny noises when Ellen would give them dirty looks.
At lunch Ellen would not eat with them and sat at a different table reading the bible and
sometimes would try lecture to them about their sins but they would ignore her or just laugh.

As the ladies handled the order and prepared it, Ellen was pacing and chain smoking in the
open air loading dock complaining they must work faster and not fool around and make jokes.

Lindsay was giggling with Myley and at one point they stopped to compare manicures and talk
about whose hands were softer comparing hands and Ellen started screaming “You must work
much faster”.

At one point Angelina and Britney started comparing arm muscles and began arm wrestling and
Ellen ran over and said they must stop goofing around.

Then Halle got a rose thorn in her hand that slipped under her glove and Angelina was trying to
remove it. Ellen started yelling again, so Myley moved over in front of her and told her “shut up
we are almost done…lighten up you bitch…we are tired of you screaming at us.”

Ellen screamed back and there was a pushing match. Ellen fell backwords off the loading dock
on to her backside but did not appear seriously hurt, but was embarrassed and screamed “I am
suing all of you…you will be fired, I am making a report.”

Ellen pulled herself together and surprisingly the order was completed and delivered.

On Monday morning Bradley Yogurt found a 10 page letter on his desk from Ellen claiming she
was attacked and wanted all the ladies fired accusing them of being violent lesbian radicals
discriminating against her religion, making the workplace toxic and impossible to work in due to
their sexual behaviour and accusing them of attacking her.

Questions to Address

Your answers to these questions should be thoroughly researched and provide very clear
answers and include relevant examples or cited statutes and/or case laws to demonstrate your
application of your learning and the answers you have written:

A. What are Bradley Yogurt’s legal obligations in regards to the complaint?


B. What kind of investigation should he be doing, if any?
C. Does the fact there is nothing written in the personnel files before this incident mean
anything?
D. Who should Bradley speak with, and what does he ask them?
E. Explain how Bradley should deal with the matter. How does he define it. Has there
been workplace harassment, sexual harassment, issues of work incompetence,
disciplinary matters or criminal matters and if so by who, who is to blame and what
should be done to resolve any issues you identify in this case study?
F. Referring to the Employment Standards Act and assuming the employees are all
making $20.00 per hour, given the work hours, are they entitled to receive overtime
pay and if so how much and how many hours do they have to work in a day?
G. How much time do the workers get for lunch and coffee breaks?
H. Assuming Ellen is injured at work in this situation, who is liable, how/why?
I. List any relevant employment law statutes relating to the details of this case. For
each, list the corresponding regulation or rule of the statute that is related to the
case.
