HUMBLE PETITION UNDER SECTION 13-B OF HINDU MARRIAGES ACT, 1955


MOST RESPECTFULLY SHEWETH

The Petitioner No.1 is a Hindu by religion whereas the Petitioner no.2 is also
Hindu by religion. The Petitioners are permanent resident of Maharashtra
and they both are domiciled in India.

1. Both the Petitioners state the Petitioner no.1 then a spinster and the
Petitioner no.2 the then a bachelor got married on 02/06/2005 at
“Samshuddin Baba Hall, Old Belapur Road, Kalwa Naka,
Thane:- 400 605”according to Hindu vedic rites and ceremonies. The
Petitioners states that their marriage is not registered with the
registrar of marriages and therefore the marriage certificate is not
annexed herewith the Petition. Hereto marked and annexed as
Exhibit “A” colly is the “Marriage invitation card” and Marriage
photograph” and Exhibit “B” colly is the “Photocopy of the
Aadhar cards” of both the Petitioners and Affidavit of the
brother in law of the Petitioner No.2 affirming the residential
address of the Petitioner No.2 and original light bill of the
House of the brother in law of the Petitioner No.2.

2. The Petitioners state that, they do not belong to Schedule tribe


community.

3. The Petitioners state that out of the wedlock there are two issues i.e
daughter born on 14/06/2006 who was subsequently named as
“Shravani” and is at present 14 years of age and son born on
25/04/2009 who was subsequently named as “Sai”, who is at present
10 years of age. The Petitioners states that, both the children are
minor and presently in the care and custody of the Petitioner No.1
(Mother).

4. The Petitioners state that after the marriage both of them stayed and
cohabited at B-Wing, Saidham, Apartment Room No. 803, Near
Dadoji Konddev Stadium Thane (W): - 400 601 till 1 st January
2019 and thereafter the Petitioner No.1 shifted at Room
No.505, Sai Nidhi Apartment, Tekadi Bunglow, Panchpakhadi,
Thane: - 400 602.

5. The Petitioners state that there has been no co-habitaion between both
the parties as husband and wife, since 1st January 2019 i.e. from
more than 1 year and therefore they are deemed to be separated as
husband and wife.

6. Both the parties started staying separately at their respective address


mentioned in the cause title since 1st January 2019 and the said
period is more than ONE YEAR as mandated under the provisions of
the Hindu Marriage Act, 1955.

7. The Petitioners state that there have been persistent disputes between
both of them. Both of them tried their level best to resolve their
disputes in order to make their marriage work. However, they both
realized their liking, taste of life, temperament, ideas, ideologies,
thinking, attitude, intellectual reaction, capacities, feelings, mood,
habit, nature and life are so different from each other that it was
difficult for them to stay and co-habit together and to lead a healthy
family /married life.

8. The Petitioners state that their parents, relatives and friends have tried
level best to have reconciliation for a happy domesticity between both,
but unfortunately they have been unable to bring out the same.

9. The Petitioners state that they thus are not in a position to live
together as husband and wife. Under these circumstances both the
Petitioners have mutually decided to dissolve their marriage by a
decree of divorce by mutual consent.

10. The Petitioners state that both of them by mutual consent have
unequivocally agreed, decided and resolved to dissolve their marriage
which was solemnized on 02/06/2005 on following terms: -

CONSENT TERMS
a) Both the parties will withdraw all the allegations leveled if any against
each other.

b) Both the parties had undergone mediation before the Hon’ble


Additonal District Judge, Thane Shri.R.V. Tamhanekar Saheb, wherein it
was agreed and recorded between both the parties that, the Petitioner
No. 2, who is the owner of the flat having address as “B-Wing,
Saidham, Apartment, Room No. 803, Near Dadoji Konddev
Stadium, Thane (W): - 400 601” shall sell off the said flat and out of
the total sale proceeds handover to the Petitioner No.1 an amount of
Rs. 12,000,00/- (Rupees Twelve Lakhs Only) in total i.e Rs.
5,00,000/- (Rupees Five Lakhs Only) towards her permanent
alimony and maintenance and Rs. 5,00,000/- (Rupees Five Lakhs
Only) towards the educational and maintenance expenses of minor
children VIZ. Shravani Jitendra Adsule and Sai Jitendra Adsule and
Rs.2,00,000/- (Rupees Two Lakhs Only) for the marriage expenses
of the daughter. The Petitioner No.1 shall open a fixed deposit amount
of Rs.2,00,000/- (Rupees Two Lakhs Only) in the name of minor
daughter Shravani Jitendra Adsule in any Nationalised Bank and both
the Petitioners shall remain the guardian to the said account. The said
amount of Rs.2, 00, 000/- (Rupees Two Lakhs Only) shall be solely and
strictly used by the Petitioners for the marriage expenses of the
daughter.

c) The Petitioner No.2 has accordingly sold off the above mentioned flat
and has accordingly paid an amount of Rs. 5, 00, 000/- (Rupees
Five Lakhs Only) to the Petitioner No.1 Vide “Right Time Gross
Settlement’ (RTGS) medium on 11/03/2020 through the account of
Mr. Jayesh Vishnu Kamble held in “The Thane District Central
Co-op Bank Ltd, Kopari Branch bearing account No.
004000300006392 bearing UTR NO. TDCBH20071000541 in the
Hon’ble court the then Chief Judicial Magistrate Shri. Rajendra Tambe
Saheb.

d) The Petitioner No.2 has also handed over a “Pay Order” of Rs.
5,00,000/- (Rupees Five Lakhs Only). bearing No. 006703 dated
11/12/2020 drawn on “The Thane District Central Co-op. Bank
Ltd, Kopari Colony Thane Branch of the Petitioner No.1 (Jagruti
Jitendra Adsule) through the account of the Petitioner No. 2
held in the same bank bearing No.030/6568 on 12/12/2020 in
the Lok adalat for the educational and maintenance expenses of
minor children VIZ. Shravani Jitendra Adsule and Sai Jitendra Adsule.

e) The Petitioner No.2 has also handed over a “Demand Draft” of an


amount of Rs. 2, 00, 000/-(Rupees Two Lakhs Only) to the
Petitioner No.1 Bearing No.212429 dated 10/12/2020 drawn on
“State Bank of India” Thane Main branch standing in the name of
minor daughter Shravani Jitendra Adsule on 12/12/2020 in the Lok
adalat and the Petitioner No.1 undertakes to open a fixed deposit
account in the name of minor daughter Shravani Jitendra Adsule within
a period of one (1) month commencing from 14/12/2020. Hereto
marked and annexed as Exhibit “C” colly is the Photocopy of
the receipt of the amount received by the Petitioner No.1 on
11/03/2020 and Photocopy of the Receipt of the Pay order of
Rs. 5,00,000/- (Rupees Five Lakhs Only). bearing No. 006703
dated 11/12/2020 drawn on “The Thane District Central Co-op.
Bank Ltd, Kopari Colony Thane Branch of the Petitioner No.1
(Jagruti Jitendra Adsule) through the account of the Petitioner
No. 2 held in the same bank bearing No.030/6568 on
12/12/2020 in the Lok adalat and receipt of the “Demand Draft”
Bearing No.212429 dated 10/12/2020 drawn on “State Bank of
India” Thane Main branch standing in the name of minor daughter
Shravani Jitendra Adsule on 12/12/2020 in the Lok adalat.

f) Both the parties do hereby agree that, apart from the above agree
terms in clause (B) if the Petitioner No.2 wishes and wants to purchase
a policy/medi claim in the name of children, the Petitioner No.1 shall
co-operate the Petitioner No.2 by providing required documents.

g) Both the parties do hereby agree and record that, the permanent
physical custody of minor children shall remain with the Petitioner No.1
(Mother) and the Petitioner No.2 (Father) and his relatives shall be
free to avail the access/visitation rights of minor children for four days
in the month preferably on Saturday and Sunday.
h) The Petitioner No.2 shall pick up the minor children at 10.00 A.M. from
the house of the Petitioner No.1 and shall bring/drop back the children
again at 5. P.M. to the house of the Petitioner No.1.

i) The Petitioner No.2 shall avail the overnight access of the minor
children on any Saturday. The Petitioner No.2 shall pick up the minor
children from the house of the Petitioner No.1 at 5 P.M and drop back
the children at 10 A.M on the next day.

j) In case of the change of the residential address of the Petitioner No.1,


she shall intimate the Petitioner No.2 about the same in advance.

k) The Petitioner No.2 shall be free to avail the access of the minor
children apart from the Saturday and Sunday but the Petitioner No.2
shall intimate the Petitioner No.1 about the same in advance.

l) The Petitioner No.2 shall be free to avail the access of minor children
during school holidays i.e. summer vacation, ganpati, Christmas
vacation. The Petitioner No.2 shall be free to avail the Birthday access
of minor children. The Petitioner No.2 shall intimate the Petitioner No.1
about the same and shall also consider the convenience of minor
children.

m) The Petitioner No.2 shall be free to attend the school functions,


parents meeting, birthday functions and other religious ceremonies of
minor children. The Petitioner No.2 shall be free to visit the
School/college of minor children as and when required and update
himself about the progress of children. The Petitioner No.2 shall be free
communicate/contact the minor child vide social media, mobile phone
etc. The Petitioner No.1 shall not object/hinder the access/visitation
rights of the Petitioner No.2. The Petitioner No.2 shall be free to take
part in the important decisions in respect of the minor children like
marriages, education, career, extracurricular activities.

n) In case of the Change of the school/college of the children, the


Petitioner No.1 shall consult with the Petitioner No.2.

o) The Petitioner No.2 and his relatives shall be free to have the
telephonic access of minor children as and when required and
accordingly the Petitioner No.1 shall provide the Petitioner No.1 with
necessary Mobile number.

p) Both the parties do hereby agree and record that, name of the minor
children as recorded in the birth records of Municipal
corporation/school etc shall remain the same i.e Shravani Jitendra
Adsule of minor daughter and Sai Jitendra Adsule of minor son.

q) The Petitioner No.1 do hereby state and record that, she has filed a
withdrawal Purshis and the Hon’ble court in Lokadalat after considering
the same has allowed the Petitioner No.1 to withdraw the complaint
filed against the Petitioner No.2 under the provisions of “The Protection
of Women from Domestic Violence Act, 2005” bearing DV case
No.496/2018 which was pending on the file of Chief Judicial Magistrate,
Thane and Regular Civil Suit bearing No. RCS/814/2019 which was
pending on the file of Civil Judge Senior Division Shri.K.G. Chaudhari
Saheb after receiving full payment towards the satisfaction of the
agreed amount as per Clause (B).

r) Both the parties do hereby agree and record that, they would not claim
any right, title and interest in the movable and immovable properties
of each other in any manner whatsoever.

s) Both the parties do hereby agree and record that there are no
exchanges pending between them.
t) Both the parties do hereby agree and record that they both will not
disparage and abuse each other in Media, social networking site,
society etc.
u) Both the parties do hereby agree record and declare that both shall not
interfere in each other’s life in any manner whatsoever hereafter.

v) Both the parties’ states that the consent for dissolution of marriage has
not been obtained by force, fraud, coercion or undue influence and the
same is of their own freewill and volition.
w) Both the parties’ states that both of them shall not file any litigation
either civil or criminal in respect of any claim of whatsoever nature
against each other hereafter.
11. Both the parties’ state that there has not been any unnecessary or
improper delay in filling this Petition.

12. Both the parties’ do hereby declare and confirm that this Petition
preferred by them is not in collusion with each other.

13. Both the parties’ do hereby declare and confirm that there is no
coercion, force, fraud, undue influence, misrepresentation etc. in filing
of the present Petition and the present Petition is filed by their free
consent.

14. That there is no collusion or connivance between the parties in filing of


this Petition.

15. That the marriage was solemnized between the Petitioners at


“Samshuddin Baba Hall, Old Belapur Road, Kalwa Naka, Thane :-
400 605” and they both lastly stayed and cohabited together at B-
Wing, Saidham, Apartment, Room No. 803, Near Dadoji Konddev
Stadium, Thane (W): - 400 601 till 1 st January 2019 and the Petitioner
No.1 is a residing at Room No.505, Sai Nidhi Apartment, Tekadi
Bunglow, Panchpakhadi, Thane: - 400 602 which is within the
jurisdiction of this Hon’ble court. Hence, this Hon’ble Court has
jurisdiction to entertain and try this Petition.

16. Both the Petitioners states that there are no other proceedings
pending with respect to the marriage in dispute in any other
court in India.

17. Both the Petitioners states that they have paid the requisite court fee
of Rs. 100/- on this Petition as required under the court fees act.

18. Both the Petitioners therefore pray that

a) that this Hon’ble Court be pleased to dissolve the marriage


between the Petitioners solemnized on 02/06/2005 by the
Decree of Divorce by mutual consent under Section 13-B of “The
Hindu Marriages Act, 1955 and the consent terms be made part
of the Decree;
b) Such other and further reliefs as this Hon’ble Court may deem fit
and proper in the nature and circumstances of the case.

And for this act of kindness the Petitioners shall be duty bound and
ever pray for.
