RELEASE DEED
  THIS DEED OF RELEASE is made and entered into at
    Bhayander on this 10th day September of 2024;
                        BETWEEN:
(1) MR. MAYURESH DILIP BAGWE (Son of Late Shri. Dilip
Shankar Bagwe), (33.33%) Aadhar no. 3893 0323 2884,
aged 25 years; an adult, Indian inhabitant, having address at
B/107, Sneh Apt Co-operative Housing Society Ltd, Shree
Siddhivinayak Marg, Bhayander West, Thane, Maharashtra –
401101 and (2) MR. SOURABHA DILIP BAGWE (Son of Late
Shri. Dilip Shankar Bagwe), (33.33%) Aadhar no. 6952 4493
4395, aged 21 years; an adult, Indian inhabitant, having
address at B/107, Sneh Apt Co-operative Housing Society Ltd,
Shree   Siddhivinayak   Marg,   Bhayander     West,    Thane,
Maharashtra – 401101; hereinafter referred to as “THE
RELEASERS” (which expression shall, unless repugnant to
the context, mean and include their heirs, executors and
administrators and assigns) OF THE ONE PART.

SMT. DARSHANA DILIP BAGWE (Wife of Late Shri. Dilip
Shankar Bagwe), (33.34%) Aadhar no. 7398 6857 0072,
aged 47 years, an adult, Indian inhabitant having address at
B/107, Sneh Apt Co-operative Housing Society Ltd, Shree
Siddhivinayak Marg, Bhayander West, Thane, Maharashtra –
401101, hereinafter referred to as “THE RELEASEE” (which
expression shall, unless repugnant to the context, mean and
include his heirs, executors and administrators and assigns)
OF THE OTHER PART.
WHEREAS by and under an Agreement For Sale Dated 05th
March       2002       entered     into     between     M/s.      S.I.
CONSTRUCTIONS, and MR.                  DILIP   SHANKAR     BAGWE
hereinafter referred to as “THE PURCHASER” acquired the said
premises being Flat No. 107, admeasuring area 25.27
Square meters (Built - Up) on the First Floor of B Wing,
Sneh    Apt        Co-operative    Housing       Society    Limited
situated      at   Shree    Siddhivinayak       Marg,   Bhayander
West, Thane 401101, hereinafter referred to as “THE SAID
PREMISES”, on ownership basis on payment of FULL & FINAL
sale consideration therefore mentioned therein and took
possession thereof and same has been registered with sub
registrar office Thane-7, 1075-2002 Dated 05/03/2002.
AND WHEREAS MR. DILIP SHANKAR BAGWE was the
100% Owner & member of Sneh Apt Co-operative Housing
Society Limited, a co-operative housing society registered
under   the    provisions    of   the     Maharashtra   Co-operative
Societies      Act,     1960       bearing       registration      no.
TNA/(TNA)/HSG/(TC)/14930 of 2003-04, dated 08-09-
2003 and is also in possession and occupation of Flat No
107 admeasuring area 25.27 square meter (Built-up)
on the First floor of the B Wing, situated on the plot of

land bearing Old Survey No. 673, New Survey No.
259,Hissa No 06 District and sub district of Thane.
AND WHEREAS Late MR. DILIP SHANKAR BAGWE has
expired on 11/03/2024 vide his death certificate issued by
Department of Health Municipal Corporation of Greater
Mumbai A ward bearing Registration No. D-2024:27-
90258-000409, dated 30/03/2024 leaving behind the only
legal heirs, and legal representatives which were governed.

AND WHEREAS except us the said deceased member has
not left behind any other legal heir, legal representatives,
claimant of his estate except us are the only legal heir’s
claimant of his estate.
AND WHEREAS that the RELEASERS are desirous to fully
relinquish, surrender, alienate their individual undivided
shares rights, title and interest and claim in the said schedule
property without any monetary consideration to and in favour
of the party of other part i.e., SMT. DARSHANA DILIP
BAGWE.
AND WHEREAS that the parties hereto had due deliberations
and discussions and as a consequence thereof, they have
arrived at and understanding which they have decided to
reduce into writing being these presents.

NOW THIS INDENTURE WITNESSETH that the RELEASERS
herein do hereby release, renounce, relinquish, transfer,
convey, surrender, assign all their 100% undivided rights,
title, interest, shares, claims, demands of whatsoever nature
to and in respect of the said Flat No. 107, admeasuring
area 25.27     Square meters (Built - Up) on the First
Floor of B Wing, Sneh Apt Co-operative Housing
Society Limited situated at Shree Siddhivinayak Marg,
Bhayander West, Thane 401101 as described in the
schedule hereunder written, to and unto the RELEASEE out of
natural love and affection and without any monetary
consideration.
1. The RELEASERS forever do hereby covenant and declare
  that they have not created any charge, hypothecation,
  mortgage, alienation, lien, transfer, conveyance, surrender,
  release, relinquish etc. of whatsoever nature in respect to
  their 100% undivided right, title, interest, shares, claim,
  demand in the said Premises And the RELEASERS further
  declare that, the RELEASERS have now full right and
  absolute authority to release, renounce, relinquish, convey,
  transfer, surrender, assign their 100% undivided right, title,
  interest, shares, claim, demand in respect to the said
  Premises to and in favor of the RELEASEE herein.
2. The RELEASERS do hereby declare that, the RELEASERS will
  not here in future do any such act whereby their 100%
  undivided right, title and interest which is intended to be
  conveyed, transferred, assign under this deed to and in the
  name of RELEASEE thereby affecting the right, title, interest
  of the RELEASEE adversely.
3. The RELEASERS hereby declare that, the Releasee is herein
  future on execution of this deed is entitled to deal with

  and/or dispose the said and the undivided right, title,
  interest, shares, claim, demand of the RELEASERS in
  respect of the said Premises which is hereby conveyed,
  transferred, relinquished, renounced in the name of the
  release in the manner the RELEASEE may deem fit and
  proper.
4. The RELEASERS further declare that the 100% undivided
  ownership rights of the RELEASERS to and in respect of the
  said Premises is free from all encumbrances and the title of
  the RELEASERS to and in respect of the said is clear and
  marketable and free all encumbrances.
5. The RELEASERS do hereby confirm that the RELEASEE is
  entitled to transfer in his absolute name at the costs of the
  RELEASEE, the said Premises and claim and enjoy actual,
  absolute, physical, exclusive and legal possession and
  ownership of the said Premises and shall become absolute
  lawful and true owner and to the exclusion of the
  RELEASERS hereof and that now the RELEASERS shall
  ceased to have any undivided right, title, interest, shares,
  demand, claim of whatsoever nature in respect of the said
  Premises.
6. The RELEASERS do hereby agree to execute such other and
  further deed or deeds or agreements as may be required to
  complete and clarify any doubts as regards their release,
  renouncement,     relinquishment,     surrender,    transfer,
  assignment etc. to and in respect of the said Premises or
  such other writing or assurances as may be required by the
  release from time to time.
7. The RELEASERS further do hereby covenant, confirm and
  declare that, the RELEASERS will not take any action and/or

  take any such manner whatsoever the ownership rights and
  the quiet and peaceful use, occupation and possession of
  the said Premises intended to be herein conveyed,
  transferred, relinquished, surrendered, assigned to the
  RELEASEE herein.
8. The RELEASERS severally, finally and forever do and hereby
  covenant, state and declare that, now they ceased to have
  right, title, interest, claim, demand, share, charge lien
  mortgage etc. of whatsoever nature in or upon said
  Premises here in future after execution of these presents.
9. The RELEASERS finally and forever do hereby covenant
  state and declare that, they have released, renounced
  relinquished, surrendered, transferred, conveyed assigned
  etc. their 100% undivided right, title, interest, shares, claim
  demand to and in respect of the said Premises in favour of
  the RELEASEE absolutely forever.
10. That the RELEASEE on execution of this release deed,
  approach to the concerned authorities, Revenue Records,
  Electricity Department, Rationing Authority or any other
  Government or Semi Government or any Competent
  Authority as an when necessary /required for effective
  Transfer/ change of name in favour of the RELEASEE and
  the Releasers shall sign and grant necessary no objection
  certificate for the effective transferring the said Premises in
  the name of the RELEASEE i.e. SMT. DARSHANA DILIP
  BAGWE

the releasers are releasing their 66.66% undivided

of the Releasee to become 100% owner) on the
First Floor of B Wing, Sneh Apt Co-operative
Housing      Society   Limited    situated    at    Shree
Siddhivinayak     Marg,    Bhayander      West,    Thane
401101; Constructed on all that piece or parcel of land or
ground lying being and situate at village Bhayander and
Taluka and District of Thane within the limits of Mira-
Bhayander Council and in the Registration district and
Sub-district of Thane and bearing Old Survey No. 673,
New Survey No. 259,Hissa No 06 District and sub
District of thane and within the limits of Mira Bhayander
Municipal Corporation (hereinafter referred to as the Said
Premises).

West, Thane - 401101; Constructed on the land bearing Old Survey
No. 673, New Survey No. 259 Hissa No 06, of Village – Bhayander
the Releasee SMT. DARSHANA DILIP BAGWE (Wife of Late Shri. Dilip
Shankar Bagwe) quiet, vacant and peaceful physical possession today.
