24 : Deed of Adoption
         Mr.Arya married Miss.Bharathi Devi in 2004 and they were leading a happy
life. But, even after 20years of their wedlock they couldn’t bear the children. The
Doctors opined that there will not be any chances in future of their getting a child.
So, both decided to adopt the son of their close relative Mr.Kumar and Mrs.Shalini
Kumar. Both the Natural parents agreed to give their son into adoption to
Mr. & Mrs.Arya by performing all the Hindu rituals and executing a deed. Draft a
Deed of Adoption.
                        DEED OF ADOPTION
     THIS DEED OF ADOPTION is made and executed on this the
Seventeenth Day of May Two Thousand Eleven (17.05.2011), at
Bangalore,
BETWEEN:
SRI. Mahajan Sharma
S/o. Pooranmal Sharma,
Aged about 40 years,
Residing at Dharampur,
Gopalnagar,
Uttar Dinajpur District,
West Bengal,
Hereinafter referred to as the “ADOPTIVE FATHER” (which expression
wherever it so requires shall mean and include his heirs, legal
representatives, administrators and assigns etc.,) of the FIRST PART,
AND:
SRI. SIDDAPPA
S/o. Tariappa,
Aged about 45 years,
Residing at Chikkabidarakal Village,
Dasanapura Hobli,
Bangalore North Taluk,
Hereinafter referred to as the “NATURAL FATHER” (which expression
wherever it so requires shall mean and include his heirs, legal
representatives, administrators and assigns etc.,) of the OTHER PART.
      WHEREAS, the Adoptive Father was married to Smt. Sharada
Sharma, aged about 34 years, and the Adoptive Father has no
children out of the said wedlock and there is no likelihood of having
any children, by virtue of their age and Doctors opinion. That the
Marriage between the Adoptive father and his wife has happened long
back and there is no chance of any child to be born to Smt. Sharada
Sharma. The Adoptive Father has despaired and do fully believe that
he shall have no children in his marital life. Therefore the Adoptive
Father is desirous of adopting a son and with the said object has
approached the Natural father and in turn the Natural father has
agreed to give his son named Master Krishna, who is aged 6 (Six)
months, i.e., born on 19.11.2010, in adoption to the said Adoptive
Father.
      WHEREAS the wife of the Adoptive Father Smt.Sharada Sharma
was duly consulted before the above adoption was made and she has
consented to the same and in token of such consent, she has affixed
her signature hereunto.
      WHEREAS the wife of the Natural Father Smt. Gowramma
(Natural Mother) also was duly consulted before the above adoption
was made and she has consented to the same and in token of such
consent, she has affixed her signature hereunto.
NOW THIS DEED OF ADOPTION WITNESSES AS UNDER:
1. That the Natural Father and Adoptive Father have performed the
Datta Homa in respect of the Adoption of the child with the customary
rituals and ceremonies prevailed in the family, in the Temple of Sree
Lakshminarayana and Sree Anjaneya, situated at Mysore Bank Circle,
K.G.Road, Bangalore on 17.05.2011 in front of their relatives and
friends gathered.
2. That the Adopted Son by virtue of this Adoption determines and
severs all his rights and liabilities in the family of his Natural Parents
and acquires all the rights and liabilities of a Natural born son in the
family of his Adoptive Father.
3. That both the Adoptive Father and the Natural Father are
Hindus by religion and that the Adoptive Father has not adopted any
children prior to the present adoption.
4. That the said Adoption is as per the mutual consent of both the
Father and mother of the Natural Parents and similarly is that of
mutual consent of the Adoptive Father and his wife Smt. Sharada
Sharma.
5. That the Natural Father has actually handed over the adoptive
child Master Krishna and the Adoptive Father has duly accepted the
boy.
6. That the Adoptive Father and the Natural Father have capacity
to take in adoption and give in adoption of the said child.
7. That the contents of this Deed is read over to the parties herein
in the language known to them and the parties having understood the
same have affixed their respective signatures to this Deed, having
found the same to be true and correct.
      IN WITNESS WHEREOF the said Sri. Mahajan Sharma
(Adoptive Father), wife of Adoptive Father Smt. Sharada Sharma and
the said Sri. Siddappa (the Natural Father) and his wife Smt.
Gowramma have hereunto signed these presents in the presence of all
friends and relatives gathered, two of whom have at the request of the
parties and in their presence signed as witnesses on the day, month
and year first herein above mentioned.
