1 Pursuant to Federal Rule of Civil Procedure 41(a)(1)(A), Relator Julie A.
2 Macias (“Relator”) and Defendant Alan Markie, M.D. (“Markie”), by and through
3 their respective undersigned counsel, hereby submit this Joint Stipulation of
4 Dismissal and [Proposed] Order and stipulate and agree as follows:
5 WHEREAS, Relator has entered into a written settlement agreement with
6 Defendant Markie and, in exchange for the consideration outlined in the written
7 settlement agreement, has agreed to dismiss with prejudice all claims and causes of
8 action against Defendant Markie; and
9 WHEREAS, except as provided in the written settlement agreement, Relator
10 and Defendant Markie shall bear their own costs and fees associated with this

11 action and the dismissal.

12 FURTHER, as signified by the signatures below, after review of the written
13 settlement agreement between Relator and Defendant Markie, the United States of
14 America and State of California hereby consent to the entry of a dismissal with
15 prejudice of the Relator’s claims against Defendant Markie and without prejudice
16 as to the United States of America and the State of California.
17 FURTHER, the parties understand and agree that nothing in the written
18 settlement agreement or this stipulation is intended to absolve any other defendant
19 in this action from liability.
