AFFIDAVIT UNDER SECTION 65B OF THE
INDIAN EVIDENCE ACT, 1872
I, Nisha Vijay, Daughter of Bishwanath Vijay, Wife of Vishal Rajput,
aged about 26 years, permanent resident of 100, Diamond Harbour Road, Khidderpore, Kolkata- 700023, and current resident of Shreeram Apartment, 2nd Building, 1st Floor, Flat No.F2, Kolkata-700055, do hereby solemnly affirm and state as under:
I, the deponent above named do hereby solemnly affirm and state on
oath as under:-
1. That I am the deponent in the aforesaid case and hence, is well
aware of the facts and circumstances of the case and is competent to file this present affidavit. 2. That as part of the evidence at this stage, I am filing a pen-drive along with its transcript. 3. That I am submitting recorded videos and screenshots of Whatsapp conversation before the Learned Court as electronic evidence. 4. That I, hereby file recorded videos and screenshots of Whatsapp conversation in a pen-drive and the transcript of the conversations and the content of the videos as verbatim. Pen-drive and its transcript are filed as part of this affidavit and marked as Annexures 1 and 2. 5. That I confirm that the digital video files and screenshots of Whatsapp conversation in the pen-drive are the copies to the originally recorded digital video files and screenshots of Whatsapp conversation in the original recording device, which I have used for recording. 6. That I further confirm that the contents of the transcript are absolutely identical and verbatim as the digital video files and screenshots of Whatsapp conversation in the pen-drive and the originally recorded digital video files and screenshots of Whatsapp conversation in the original recording device. 7. That, I am making this present affidavit to certify that: 1) The digital video files and screenshots of Whatsapp conversation in the pen-drive are the copies of the originally recorded digital video files and screenshots of Whatsapp conversation in the original recording device.
2) The contents of the transcript are absolutely identical and
verbatim to the digital video files and screenshots of Whatsapp conversation in the pen-drive and to the originally recorded digital video files and screenshots of Whatsapp conversation in the original recording device.
8. That this affidavit, therefore, in the facts and circumstances of the
case, is sufficient in compliance with Section 65B of the Evidence Act. The digital audio file has been copied from my recording device, therefore, can be treated as a certified copy. The annexed Pen-drive and the transcript, therefore, are in compliance with the provisions.
DEPONENT
VERIFICATION I, Nisha Vijay, the deponent, do hereby solemnly affirm and verify that the contents of paragraphs no. 1, 2, 3, 4, 5, 6, 7and 8 are true to my personal knowledge which all I believe to be true, no material has been concealed in it and no part of the affidavit is false.
