AFFIDAVIT OF OWNERSHIP WITH WAIVER/ QUITCLAIM AND AUTHORITY TO
DEMOLISH STRUCTURE
I, RENCEL K. ARNUCO, Filipino, of legal age, and a resident of Villa Sta Maria,
Barangay Sta. Maria, Zamboanga City, Philippines, after having been sworn to in
accordance with law, do hereby depose and state that:
1. Ownership of the Structure
I am the legal owner of a structure and improvements, TYPE OF STRUCTURE/
IMPROVEMENTS: ____________________________________________________ which is
situated in Villa Sta. Maria, Barangay of Sta. Maria, Zamboanga City,
Philippines.
2. Affected by the Flood Control Project: DPWH CONTRACT ID NO. 24JA0012
construction of FLOOD CONTROL STRUCTURE located at TUMAGA RIVER (Sta.
Maria Section, Zamboanga City, Zamboanga Del Sur).
The aforementioned structure and its improvements are located within an
area that is being affected by the construction of the Flood Control Project in
Sta. Maria Section, Zamboanga City. As a result of this project, the structure is
subject to removal, and subsequent demolition.
3. Offer to Purchase by the City Government
I received a formal notice from the City Government of Zamboanga City
offering to purchase my structure and improvements in the amount of
_________________________________________ (PHP___________________). This offer
was made as compensation for the removal and subsequent demolition of my
property due to the ongoing Flood Control Project by DPWH CONTRACT ID NO.
24JA0012. City Government will pay a 70 percent down payment upon signing
of this affidavit, Special Power of Attorney, and the Acknowledgement Receipt
and the remaining balance of 30 percent will be paid upon the completion of
the demolition of the structure.
4. Waiver and Quitclaim
I hereby WAIVE AND QUITCLAIM any and all rights, claims, and interest I
may have over the structure and improvements. I acknowledge that the
purchase price offered by the City Government of Zamboanga City is fair and
adequate compensation for the improvements made on the property.
5. Authority to Demolish
In connection with the ongoing construction of the Flood Control Project by
DPWH CONTRACT ID NO. 24JA0012, I hereby give my full consent and
authority to the City Government of Zamboanga City, its agents, and/ or
contractors, to demolish the structure and remove any improvements found
thereon. Without any further obligation to me except for the agreed
compensation of PHP _______________________________________.
6. Indemnification
I further agree to hold the City Government of Zamboanga City free and
harmless from any liability or claims arising from the demolition of the
structure and the removal of improvements. I acknowledge that this waiver
and authority to demolish shall be binding upon me, my heirs, successors, and
assigns.
