Trust Deed for The Gwaro Family Trust.
TRUST DEED
This Trust Deed is made on this 22 Day of November 2024, by and between:
1. Settlor:
Barnabas Gwaro Obaga, holder of ID No. 1643632, of sound mind and free will,
(hereinafter referred to as the "Settlor"), who transfers certain properties into the Trust as
described herein.
2. Trustees:
Ronald Mogere Gwaro, ID: 22713554, Walter Nyareru Gwaro, ID: 24780145, Gilbert
Ogao Gwaro, ID [Insert ID], and Alex Omechi Gwaro, ID 28699014. (collectively
referred to as "the Trustees"), who agree to manage the Trust and its assets in accordance
with this Trust Deed and the applicable laws of Kenya.
3. Beneficiaries:
The following individuals are designated as the primary beneficiaries of the Trust:
o Cecilia Kwamboka Gwaro, ID [Insert ID],
o Eric Atinda Orang’I - on behalf of the Family of Evans Orang’i Gwaro
(Deceased), ID 37922142,
o Ronald Mogere Gwaro, ID: 22713554,
o Walter Nyareru Gwaro, ID:24780145
o Gilbert Ogao Gwaro, ID [Insert ID],
o Alex Omechi Gwaro, ID 28699014
Additionally, any other dependents as determined in accordance with the terms of this
Trust Deed.
RECITALS
WHEREAS, the Settlor is the sole owner of the property and wishes to establish a Trust to
ensure its orderly management and distribution;
WHEREAS, the Trustees agree to hold, manage, and distribute the Trust property as per the
terms and objectives of this Trust;
NOW, THEREFORE, THIS DEED WITNESSES AS FOLLOWS:
1. Name of the Trust
The Trust shall be known as “The Gwaro Family Trust.”
2. Trust Property
The Settlor hereby transfers the following assets to the Trustees to hold in trust for the
Beneficiaries:
Nyansiongo Riamokogoti Farm, Title Deed No. [Insert Title Deed Number], solely
owned by the Settlor.
Any other property owned by the Settlor, as may be explicitly identified in writing and
added to the Trust from time to time.
3. Purpose of the Trust
The objectives of the Trust are:
1. To preserve and grow the wealth of the family for future generations.
2. To ensure the equitable distribution of the Trust property among the Beneficiaries.
3. To provide for the education, healthcare, and general well-being of the Beneficiaries.
4. Powers and Duties of the Trustees
The Trustees shall have the following powers and responsibilities:
1. Management: The Trustees shall manage the Trust property prudently to maximize
benefits for the Beneficiaries.
2. Distributions: The Trustees may distribute income or capital from the Trust to the
Beneficiaries as needed for their education, healthcare, or welfare.
3. Sale or Disposal: Trustees may sell or dispose of Trust property with the unanimous
agreement of all Trustees and in accordance with the Trust’s objectives.
4. Investment: Trustees may invest Trust funds in low-risk, income-generating
opportunities for the benefit of the Beneficiaries.
5. Rules Governing Beneficiaries
1. Each Beneficiary listed above is entitled to one residential plot (40 feet by 60 feet) within
Nyansiongo Riamokogoti Farm.
2. Beneficiaries shall not use the property for commercial purposes or sell it without Trustee
approval.
3. A designated family burial site within the Trust property shall be reserved for the
Beneficiaries and their immediate family members.
6. Amendments and Termination
1. The terms of this Trust may only be amended with the unanimous consent of the Settlor
(if alive) and the Trustees.
2. The Trust shall terminate upon the unanimous agreement of all adult Beneficiaries or
upon the expiration of its term as stated herein.
7. Governing Law
This Trust Deed shall be governed and interpreted under the laws of the Republic of Kenya.
8. Execution
IN WITNESS WHEREOF, the Settlor, Trustees, and Beneficiaries have executed this Deed as of
the date first above written.
