w allowed on it, it means that the basic fee now being claimed by the

have expressed the view that this 10% hike when taken cumulatively
for various classes together, amounts to a much greater hike than just
10% over all.

4) The Committee also failed to observe the legal position that the powors
delegated vide G.0.Ms.No.1, Education, dated 01.01.1994 to the
Governing Body of the Schools to fix the fec is actually in contravention
of Section 7 of the Telangana Educational Institutions (Regalation of
‘Admissions and Prohibition of Capitation Fee) Act, 1988, which clearly
says that the fee has to be notified by the Government only.

ORDER:
Government of India enacted Right of Children to Free and Compulsory
Education Act, 2009, which has come into effect from 01.04.2010. This Act prohibits
screening tests for admission into classes | to Vill in schools in India (Including pre-
primary classes). The Act also prohibits collection of capitation fee trom
studentsiperents/guardians.
2. During the last few yoars there has becn a trend that private recognized schools
in the State have been admilting children into elementary classes by holding screening,
fests (Interviews! tests to children/parontsfquarcians), issuing applications for
admission'seats only to such candidates to whom they intend to give seats. Further
several complaints have been received that apart from fees, huge donations are
collected from the parents al the time of admission. Against this background this Act
prohibits holding of screening tests for admission, collection of capitation fees. instead
the admission of a child shall be to an age eppropriaie class(age 3-5 for Pro-primary
Class, age 6 for Class |, age 7 for Class Il end so on up to minimum age 13 for Class,
vil).
3, The method of selection for admission of a child to an elementary class shall be
as per the steps/ sequeniial order given in Annexure-| appended. In accordance with
these provisions of the Right of Chikiren to Free and Compulsory Education Act, 2009
the screening procedures presently in vogue in tarms of interviewsltests conducied for
‘admission to any class from Pre-primaty to Vill in any school under any management or
any Syllabus (Slate sylabus/CBSEACSE/any cther) shall be dispensed with including
Entrance test for admission to Class VI or any olher class conducted by District
‘Common Examination Board (OCEB). Any deviations in this regard wi be punishable
under the Section 13 (2) (b} of the said Act with fine which may extend to Rs. 25,000/-
for the first contravention and Rs. 50,000! for each subsequent contravening
admission.
4. Capitation fee by definition means any kind of donation or contribution or
payment ether than the fee notified by the school. This means that the school should
notify the preseribed fee to the parents/gonoral public both in notice board in at least
three prominent places in the school an¢ in public domain during the admission period
(including admission extended period) of tha current year from April 15" of the previous
year to 11" September of the current year.

It, was brought to the notice of the Government that certain private
ediicational institutions are exploiting the parents by hiking the fee indiscriminately
land some of them are also luring them with attractive names such as IIT Olympiad
/ Concept / e-Techno / e-shastra etc., and collecting exorbitant fees.
2. ‘The Government had prescribed certain rules regarding this vide G.O. 1"
read above and also issued G.0. 3 read above forming District Fee Regulatory
Committees (DFRCs), but most of the provisions of the said G.O. were struck down,
by the Hon'ble High Court, which were upheld by the Supreme Court, particularly
wherein the Govt. had given powers to the District Fee Regulatory Committees
[DFRCs} to fix the fee for the Schools.
3. ‘The 6.0. 46 read above is also under ‘stay’ by the Hon'ble High Court,
wherein the Govt. had fixed minimum and maximum fee for the School

Ww 2) In the reference 2 read zbove, the Director of School Education,
Telangana, Hyderebad has informed that at present the cost of the
construction of the buildings and value of the land have increased
enormously. The donation amount is very less in the existing G.0.Ms.162,
School Education (MC-2) Department, dt.14.11.2004 and the amount has to
be increased according to the present day market value. Number of
proposals are being received for change of school names, in the name of
the donors for which there Is resistence from the community / public, to
change the names o” reputed old schools in the favour of donors. Hence, he
requested to enhance the amount of donations for Primary Schoo's from
Rs.5.00 Lakhs to Rs.25.00 Lakhs; Upper Primary Schools from Rs.7.50 Lakhs
+t Rs,50.00 Lakhs and High Schools from Rs,10,00 Lakhs to Rs.100.00 Lakhs

‘The Commissioner & Director of School Education, Telangana, vide
reference read above has submitted proposals for the issue of Guidelines for
redueing the load of School Bags in Frimazy, Upper Primary and High Schools
because heavy School Bags are a serious threat to the health and wellbeing of
the students. ‘The load of a School Bag, as estimated in some of the districts,
‘weighs about 6 to T2 Kgs at Primary Tevel and 2 to 17 Kas at High School level
This hata severe, adverse physi] alfect on the growing children which can
cause damage to their vertebral column end knees it also causes anxiety in
thern. Moreover, in the schools which are functioning in multistoried buildings,
the children have to climb the steps. with heavy School Bags, which further
aggravates the problem and health consequences,
2. This heavy load is caused by the fact that the children bring textbooks,
guides, home work notebooks, rough work notebooks etc., to the classroom every
day. Therefore, clear Guidelines of what to bring to the schools is required. A
Survey on the School Beg load was taken up in some of the districts and based
on the Survey, an exercise has been taken up to arrive at the propoer load of the
School Bags and a Policy on home work and assignments.
1, GENERAL GUIDELINES TO REDUCE THE LOAD OF SCHOOL
BAGS:
> All the schools following the Stats Curriculum have to follow the
textbooks prescribed by the State Academic Authoriy ie, SCERT,
Government of Telangana. The mumber of textbooks in different classes
should not exceed the mumber prescribed by the SCERT for the
eorresponding class.
Schools should focus on making the children understand concepts rather
then just memorising the concepts. Freedom should be given to the
children to read, comprehend and express for themselves.
> Schools should avoid repeated éopying from tho tex: books / guide books
during and alter the school hours.
> Reading library books and participation in Games, Sports, Art & Culture
and other creative, co-curricular activities for holistic development of the
children must be encouraged.
> Feedback on the assessment and the performance of the children is a
must to improve the performance of the students and also the teachers.
‘The use of Guides and Guide type study material should be avoided and
children should be made to think, imagine and construct their own
answers,
> ‘The subject-wise Guides or Gulde type study material/workbooks are
not to be used as stipulated vide G.O.Ms.No.17, School Education
(PE-Prog.ll) Department, dated.14.05.2014. Children are expected to
write answers to the questions and other tasks given in the text
books on thelr own to be corrected by the teachers.
Strict adherence of the Academic Calendar in terms of the school timings,
‘examination schedule, nature of assessments, CCE etc. is required.
» Games and Sports in the evenings must be encoureged rather tha
‘engaging the children again in tuitions and homework only. Recreation
‘and paysical activity is a must, for a growing child and it is the right of
the children.
