Marites versus ABC Law Firm Inc.
Case Overview:
In the case of Marites v. ABC Law Firm Inc., the plaintiff, Ms. Marites, filed a lawsuit against
ABC Law Firm Inc., alleging negligence in the performance of duties by their legal secretary. Ms.
Marites claimed that as a result of the legal secretary's failure to manage and file legal documents
properly, she suffered financial losses and emotional distress.
Facts of the Case:
Ms. Marites hired ABC Law Firm Inc.to represent her in a personal injury case. As part of
their agreement, the legal secretary at ABC Law Firm Inc. was responsible for managing and filing
all legal documents related to Ms. Marites's case. However, several critical documents, including
witness statements and medical records, were not filed on time or were misplaced.
1. Did the legal secretary demonstrate accuracy and attention to detail in document
management? Did the legal secretary fulfill their duty to manage legal documents
efficiently? and why?
No, she failed to demonstrate the accuracy and attention of being a legal secretary,
because she misplaced and not filed on time the documents such as witness
statement and medical records. Legal secretary didn’t fulfill her duty and it reflects
a failure to meet the professional standard to be a legal secretary managing
important documents.
2. How did communication breakdowns affect the client's perception of the legal
representation?
This lack of communication will destroy the trust and it will lead to realized that her
case was not being prioritized that make her feel she neglect.
3. How did the failure to manage documents impact the progression of the case?
The failure to managements properly resulting that the case will be in critical delays
because of the missing legal documents, as a result it will lost the opportunities to
present the evidence and it will give emotional stress and unnecessary financial.
