TOPIC: NHRC&SHRC
NATIONAL HUMAN RIGHTS COMMISSION OF INDIA
Introduction:
National Human Rights Commission of India is a statuatory public body which
has been functioning since 12 OCTOBER 1993. NHRC is responsible for
protection and as well as promotion of the huma rights as rights relating to Right
to life,Liberty,Equality and Dignity of an individual which are guaranteed by the
constituition

Functions and Powers of NHRC

[Link] holds the power to investigate grievances related to the violation of


human rights either suo moto or after receiving a petition.

[Link] has the power to interfere in any judicial proceedings involving any allegation
of violation of human rights.

[Link] can visit any jail or other government-controlled facility to see the prisoners'
living conditions and make recommendations on them.

[Link] can review the protections provided for in the constitution or any human rights
protection legislation and can recommend effective remedial steps.

[Link] also undertakes and promotes research in the field of human rights. It
works to spread human rights literacy among various sections of society and
promotes awareness of the safeguards available for the protection of these rights
through publications, media, seminars, and other means

[Link] has the powers of a civil court and can grant interim relief.

[Link] also has the authority to recommend payment of compensation or damages.

[Link] can recommend to both the central and state governments to take suitable
steps to prevent the violation of Human Rights.

[Link] submits its annual report to the President of India who causes it to be laid
before each House of Parliament.

Limitations of NHRC
[Link] cannot take any action against violation of Human rights by private
parties

[Link] Recommendations made by the NHRC are not binding.

[Link] cannot penalize the authorities that don’t implement its recommended
orders.

[Link] NHRC has limited jurisdiction over cases related to armed forces

[Link] NHRC cannot hold jurisdiction in the following cases:

- Cases older than one year.

- Cases that are anonymous, pseudonymous, or vague.

- Frivolous cases.

- Cases pertaining to service matters.

STRUCTURE OF NHRC
NHRC has a chairperson and 7 members out of which it has

i Chairman-Retired Chief Justice of India

ii 2Members-Retired judge of supreme court and Retired judge of any


high court of India respectively

iii 2 members who have practical experience in the field of human rights

iv Ex officio members who are the chair persons of National commision of


minorities,scheduled castes,scheduled tribes,women

So these are a brief idea about the powers functions and structure of NATIONAL
HUMAN RIGHTS COMISSION(NHRC)

STATE HUMAN RIGHTS COMMISSION OF INDIA

Introduction:
State human rights commission is the human rights commission at the state level.
A State Human Rights Commission can inquire into violation of human rights
related to subjects covered under state list and concurrent list in the seventh
schedule of the Indian constitution

Functions of SHRC
1· The SHRC shall enquire into violation of human rights in respect of matters
specified in the state and concurrent lists.

2· Its objectives and duties are the same as NHRC, but confined only to the state.
It has a chairman and two members.

3· It has the power of a civil court and can take cognizance of cases if received or
in suo motu.

4· It can also recommend compensation to victims.

STRUCTURE OF SHRC
It has chairman and two members.

[Link] should be a serving or retired judge of HC or district judge with 7


years experience and a person of knowledge or practical experience in field of
human rights.
