This LEAVE AND LICENSE AGREEMENT made on this 14th Day of

Here in after referred to as the "LICENCEE" (Which expression shall, uDless
repugnant to the context and measuring or meaning thereof, mcan and include his legal
heirs,executor's administrators and assignees).....PARTY OF THE SECOND PARÍ
WHERE AS THE licensor is the law full owner of the Premises at Sr No 40/3/2, Flat
No C-401, SwarajPride, Punewale, Pune- 411033. along with fixture, fittings, within
the local linmits of Pimpri Chinchwad Municipal Corporation and within the jurisdiction
of Sub - Registrar HaveliPune 1to 26, here in after referred as the SAID PREMISES.
The Licensee has approached the Licensor with request to permit him/her to use and
occupy the said premises with its furniture, fixture & fittings, on LEAVE AND
LICENSE basis as Residential purpose for the use Of Licensee, for a period of 11
months.

NOW THEREFORE THESE PRESENT WITNESSETH THIS AGREEMENT AND


IT IS HEREBY AGREED BY AND BETWEEN THE PARTIES HERETO AS
FOLLOWS

1) The Licensor agrees to demise up to the Licensee and the Licensee hereby accepts
the said premises, with its fixture & fittings as per Schedule A" attached to hold onto
a period of ELEVEN months with effect from 28/08/2022 to 27/07/2023 with Eleven
months in license fee, license from the day of the Licensee has been allowed the use
and occupation of the said premises.

a2) During the tenure of this License, the Licensee shall pay to the Licensor an amount
of in advance Rs.3000 /- (Rupees Three Thousand only) per month including society
maintenance charges and by way of Compensations.
3) An interest free Security Deposit of Rs.3000 /- (Rupees Three Thousand only)
paid by Cash. The Licensor will return this amount to the licensee on taking over
exclusive and peaceful re-possession of the said premises from the licensee. In case of
any loss or damage to the premises, fixtures/fittings, appropriate charges for the loss or
damage & allpending bills of electricity, etc. which are due to be paid by the licensee
as on date would be deducted out of the Security Deposit held by the Licensor and
only the balance amount shall be returnable.
4) It is agreed by the parties that the fixture/fittings and articles, more particularly
deseribed in the Schedule A" hereuder witen, which belong to the Licensor shall
continue to remain in the said premises and the Licensor has permitted the Licensee to
use the same.

S) It is agreed between the parties that at all times the judicial possession of the said
premises shall be of Licensor &the Licensee has been merely granted the License to
make use of the said premises for a limited period only.
0tis hereby agreed between the parties bereto that if the Licensee commits any
default in payments of the monthly compensations as agreed aforesaid or non -
payment of electric, bills ete. and or commits breach of any of the tems, covenant
contained in this Agreement the Licensor shall be entitled to revoke this License
forthwith and serve a notice of one month for vacation of the said premises to the
licensee.

7) The Licensee covenant with the Licensor that the obligations hereby granted shall
continue throughout the terms of this License period for the proper performance of the
terms and Conditions of this LEAVE AND LICENSE Agreement as follows:
a) The Licensee shall pay all the Charges for Electricity Bill as per meter that may be
charged in respect of the said premises But the property taxes of the said premises
shall be paid by the Licensor

b) To keep the interior of the said premises in good order and maintain it in proper
condition, as they were on the day of the occupation during the License period as
mentioned herein above.

c) Not to make any alterations to the said premises or remove any door, window or
other fixture, fittings from it.

d) Not to assign transter. sub-let or part with the posseion of the said premises or any
part thereof at any time during the continuance of this License Period.

e) Topermit the Licensor or his fanily member to enter, inspect the said premises and

fittings after giving prior notice/ intimation WALNAR

) The Licensee shall use the said premises for his residential purposes only and for no
other purposes whatsoever.

9) To deliver to the Licensor, or any one from his family member on expiry of this
License vacant exclusively and peaceful repossession of the said premises. Any löSs or
damage to the said premises fixtures, fittings for which the Licensee can rightly be hetd
responsible will be made good by the Licensee before handing over the possession of
said premises to the Licensor.

h) On expiry of this Leave & License period or earlier, if this License is terminated and
if the Licensee fails to deliver vacant & exclusive possession of the said premises,
along with fixture and fittings mentioned herein ,to the licensor the Licensor shall be
entitled to be at a liberty to enter into the said premises without hindrance and
obstructions from the Licensee and Without obstruction and without prejudice to the
Licensor rights to recover the damages from Licensee.
9. The Licensor agrees to bear, pay and discharges other liabilities in respect of all past,
present taxes, rates, cases, assessment, duties, impositions and outgoings whatsoever
charges or imposed upon the said premises.
PROVIDED ALWAYS, it is hereby agreed and declared by and between the said
parties as follows:

a) The said premises shall be used for as Residential purpose of the


Licensee and
his/her bonafied family members only.
b) The Licensee paying the compensations hereby agreed and performing the several
covenants and stipulations on his /her part contained herein shall peacefully enjoy and
hold the said premises during the limited period of this Leave &License.
c) On expiry of this License period of eleven months this Leave &License may be
renewed for further period, if mutually agreed by the said parties with an increase in
the said compensation and Security Deposit.
d) This Agreement may be terminated by written Notice of one Month by either party,
even before the expiry of the above license period.

e) In the event of any omission of written notice on the part of one party, Licensee/
Licensor, the Second party shall be compensated, in cash by the erring party for the
uncovered period of the notice at the rate of 3000/- per month.
f) The Licensee shall pay the compensation for the use & occupation of the said
premises, its fixture; it's fitting, at the rate of 3000/- per month on 10h day of each
month to The Licensor.

g) The Licensee shall follow and adhere to all the rules and regulation of the society
which are, prevalent and are comnmon to all the residents in the society Complex
JAVAL KAR
h)The said parties are making this Leave &License Agreement as provided in Section
4(14) and 13 (A2) of Bombay Rent control Act 1987 (Amended) Maharashta Rënt
Act 1999 section 55/l as amended. The Licensee shall never clainm to be a tenant and
the agreement always be treated as an Agreement of Leave &Licènse.
ENT
i) If the Licensee fails to vacate the said Remises within the stipulated period of the
License & Licensee shall evicted by the Licensor without recourse to court of law and
he/she shall be treated as Trespasser.

As per the Maharashtra Rent Control Act, Amended 200 u/s 55 any Rent agreement
must be registered as per the Section so far the Licensor requested licensee regarding
the said act and requested him to be present in Sub- Registrar Haveli No. 1to 26
offices for Registration of the Said Leave &License Agreement.
