CONTRACT OF ENGAGEMENT OF CONSULTANT IN MINISTRY OF SOCIAL JUSTICE AND IW. ENT OF SOCIAL JUSTICE AND WI IN’ ‘This Contract of engagement is made on 9th Februat 2015 Between (i) ‘The President of India (through the Ministry of Social Justice and Empowerment D/o Social Justice & Empowerment having its office at Shastri Bhawan, New Delhi, West Block, R-K. Puram, New Delhi and Jeevan Prakash Building, Barakhamba Road, New Delhi (hereinafter called “ the Ministry”) (i) Mr. Deepak , S/o Shri Naresh Kumar, R/o WZ-66, Om Vihar, Phase- 1, Uttam Nagar, Delhi-59 (hereinafter called Shri Deepak) Whereas the Ministry desires to engage Shri Deepak , R/o WZ-66, Om Vihar, Phase-1, Uttam Nagar, Delhi-59 as full time Assistant on contract basis for a period of | year from 9-2-2015 to 8-2-2016 ‘And whereas Shri Deepak has agreed to such engagement upon and subject to the following terms and conditions of the contract. i) During the period of contract, Shri Deepak shall perform the duty as Assistant in the DBT cell of the Ministry of Social Justice & Empowerment (Department of Social Justice & Empowerment) During the validity of this contract, while on duty, Shri Deepak shall (j) observe punctuality and discipline (ji) attend office on all working days and, if necessary, on holidays. If required he will have to work even beyond normal office hours. i) Shri Deepak will be entitled to draw a consolidated remuneration of an amount Rs. 27000/- (Rupees Twenty Seven thousand only). No other allowances and benefits will be admissible. No remuneration shall be payable to him, on account of working on holidays and /or outside office hours. iv) This Contract is terminable by the Ministry at any point of if the performance of Shri Deepak is not found satisfactory. 1 without prior notice ¥) Shri Deepak also reserves his right of terminating this contract by giving the Ministry ‘one month’s notice in writing or payment of one month’s remuneration in lieu thereof.vi) The Contract can be terminated at any time, at the discretion of the Department of Social Justice & Empowerment with a prior notice of one month vii) Shri Deepak will have no right to claim =~ any _—_additional benefit/compensation/absorption/regularization of service in the Ministry during or after the period of engagement under any provisions viii) The remuneration payable to Shri Deepak shall be calculated on the basis of the attendance certified by his controlling Officer. If Shri Deepak does not attend office on any working day, the remuneration would be worked out by applying the following formula:- ‘Number of working days on which office hi X_remunerati ‘Number of working days in the month ix) Ina matter of any disputes, between the parties regarding the terms and conditions of contract and execution of thereof, the matter shall be referred to the Arbitrator (s) as may be decided by the Secretary, Ministry of Social Justice & Empowerment, Department of Social Justice under the Arbitration and Conciliation Act, 1996. Shri Deepak, shall not question the decision of the Arbitrator (s) on the ground that the Arbitrator (s) is/are government servant (5). The decision of the Arbitrator(s) shall be final and binding on the parties. The place of Arbitration will be New Delhi only. X) The engagement of Shri Deepak will be upto 8.2.2016. However, depending on the requirement of the Ministry and the performance of the person engaged, the period of engagement can be extended. In case the vacant post in DBT cell/SCD gets filled up by regular employees, the services of Shri Deepak will be terminated.
