Extraordinary) No. 4, Date: 26.04.2017.

O R D E R:-

In the reference 1st read above, the Andhra Pradesh Official Language
Act, 1966 (A.P. Act No. 9 of 1966) provided for the adoption of Telugu and
Urdu Languages as the Languages for the official purposes of the State ,
and for the transaction of Business in the State Legislature etc., and
English Language for continuance in certain official purposes of the State and
for use in the Legislature until the State Government otherwise direct; and
the Commission on Official Languages, shall review the progress of Telugu
as Official Language, and use of Urdu Language in official matters in notified
areas in the State.

2) In the reference 2nd read above, the Andhra Pradesh Tourism, Culture
and Heritage Board Act, 2017 (A.P. Act No. 4 of 2017) provided for the
development and promotion of Tourism, development of Art and Culture, and
conservation and promotion of Heritage of Telugu People in the State of
Andhra Pradesh, and to establish an Autonomous Board and Authorities, to
achieve the above Objectives and matters committed therewith or incidental
thereto.

3) Accordingly, the following Notification shall be published in an Extra-


ordinary issue of the Andhra Pradesh Gazette, Dt.18-07-2018.

NOTIFICATION

In exercise of the powers conferred under sections 6, 10 (1) (b) and 42


of The Andhra Pradesh Tourism, Culture and Heritage Board Act, 2017 (A.P.
Act No. 4 of 2017), the Government of Andhra Pradesh hereby, makes the
following rules.

PART-I

(1) Short title, extent and commencement. -

(1) These Rules may be called the Telugu Language Development


Authority of Andhra Pradesh (Constitution) Rules, 2018.
(2) It extend to the whole of the State of Andhra Pradesh.
(3) It shall come into force with effect from 18.07.2018 i.e. Date of
Gazette Publication.

2) Definitions

1. In these Rules, unless the context otherwise requires, —

(i) “Authority” means the Telugu Language Development Authority


of Andhra Pradesh established under section 6 of the Act;

(ii) “Chairman” means the Chairman of the Authority;

(iii) “Erstwhile Department” means Department of Official


Language;

(iv) “Fund” means the Telugu Language Development Fund


established under Rule- 8;

(v) "Projects and Programmes" means the Annual Projects


Programmes approved by the Authority, for development and
promotion of Telugu Language in the State; and

2. The words and expressions used but not defined in these rules shall
have same meanings assigned to them in the Act.

PART-II

TELUGU LANGUAGE DEVELOPMENT AUTHORITY

3) Constitution of the Telugu Language Development Authority of Andhra


Pradesh.

(1) In accordance with the powers vested under section 6 of the Act,
the State Government hereby constitutes a body to be called the
‘Telugu Language Development Authority of Andhra Pradesh’,
herein after called as the ‘Authority’ for the State, which shall be a
body corporate by the name aforesaid, having perpetual
succession and a common seal, with power to acquire, hold and
dispose of property, both movable and immovable and to contract
and by the said name sue and be sued.

(2) The Authority shall consist of —


a. Chairman;
b. Secretaries to Government dealing with General
Administration, Law, Labour, Culture & Tourism and
Education Departments.

c. Up to four experts having special knowledge or practical


experience in the fields of Telugu literature, administration
and law as members.

d. Chief Executive Officer of Andhra Pradesh State Creativity


and Culture Commission;

e. Chief Executive Officer and Member-Secretary

(3) The Chairman and Members shall be nominated by the Government


on the recommendations of a three (3) members search committee
appointed by the Government consisting of Members having special
knowledge or practical experience in the field of Telugu language,
literature and administration.

(4) The composition and reconstitution of Authority resulting due to


vacancies/absence of its members and proceedings shall be as per
First Schedule of the Act.

(5) Subject to the general superintendence and control of the Authority


the management of the affairs of the Authority shall vest in the
Chief Executive Officer.

(6) The Authority shall make required regulations with approval of the
Board/Government and standing orders to achieve the object of
the Act.

(7) In case of a vacancy of Chairman, the Secretary / Principal


Secretary / Special Chief Secretary to Government dealing with
Tourism & Culture shall act as the Chairman of the Authority.

(8) Subject to the direction and delegation of the powers by the


Authority, Chief Executive Officer may exercise any power or do
any act or thing which may be exercised or done by the Authority.

4) Appointment of Sectoral Committees — Under section 7 of the said


Act, the Authority is authorised to appoint the following Committees
consisting of such members as it thinks fit:-
1. Committee on Telugu Official Language Implementation;
2. Committee on Telugu Language Development with focus on
Education;

3. Committee on e-Telugu Development;


4. Committee on Translations and Publications; and
5. Committee on International Telugu Development

PART-III
FUNCTIONS OF THE AUTHORITY

5) Functions of the Authority; —

1) The functions of the Authority under section 11 shall be the following:-


(i) General
(a) To prepare every year projects and programmes for the
development of Telugu Language and obtain approval of
Government with or without modifications;

(ii) Official Language Implementation

(a) To identify the hurdles in the implementation of Telugu as the


official language and to take suitable measures to solve them;
(b) To convert all the forms used by citizens to access public services
into Telugu and create professionally designed forms;

(c) To convert all the registers, process flow charts, manuals and
publications into easy to understand Telugu in all public offices;

(d) To coordinate with High Court and other courts in the State to
deliver their judgements in Telugu;
(e) To organise training programmes, workshops, exhibitions and
seminars which facilitate the use of Telugu for public servants;

(f) To prescribe and review from time to time the syllabus and
system of Telugu examinations conducted for testing public
servants.

(g) To ensure that the Regional Language, as being used in the


forms, display boards, notices and name plates in the Central
Government establishments such as Airports, Banks, Post Offices
and such other offices and undertakings which have a public
interface, is in accordance with the language policy of the Central
Government;

(h) To take decisions on the matters of preparation, revision, printing


and distribution of reference books on administration, to
implement the same, to monitor the progress in this field, and to
suggest necessary measures;

(i) To encourage that Government business right from preparation of


note file to introduction of bills in the State Legislature should be
carried out in Telugu;

(j) To encourage that the correspondence in administration right


from Village Secretariat is done in Telugu;

(k) To ensure that implementation of Telugu as Official Language is


reviewed periodically as a subject at all levels right from divisional
level to State level;

(l) To prepare an action plan and implement to create a “word bank”


in Telugu to substitute technical, administrative and legal
terminology available in other languages;

(m) To develop and publish glossary of administrative terms in Telugu


for use by departments;

(n) To ensure name plates, boards, flexies, banners, and other


advertisement material are primarily written in Telugu and to
initiate necessary panel action against the defaulters; and

(o) To ensure that all boards of Government offices and foundation /


inauguration plaques are legibly written in Telugu and to initiate
action to punish the defaulters.

(iii) Telugu Language Development

Education
(a) To take action to secure priority for, and promotion of Telugu in
the field of education and cultural activities;

(b) To examine the standards of Telugu text books and give


instructions to rectify the errors, if any;

(c) To verify the learning levels of students up to intermediate or


equivalent;

(d) To motivate students and parents, and convince them to opt for
Telugu during the first 12 years of schooling;

(e) To translate works, written or digital, across the world which


changed the course of mankind in the fields of philosophy,
science, mathematics, engineering, medicine, economics, history,
arts and such other fields;

(f) To prescribe syllabus, prepare literature and digital content, and


organize Telugu teaching courses for non Telugu persons;

(g) To ensure that Telugu lessons prescribed for students are of


proper standards both in content and language;

(h) To improve and/or publish lexicon relating to various professions


such as medicine, engineering, science, law, philosophy and so
on;

(i) To identify all original Telugu words used by poets of different


periods in their literature and introduce them back into popular
use;

(j) To coordinate with Andhra Pradesh Creativity and Culture


Commission to propagate the classic nature, lyrical beauty and
uniqueness of Telugu Language;

(k) To prepare action plans to motivate youth towards adoption of


Telugu Language by conducting seminars, workshops and
competitions;

(l) To encourage research on Telugu Language, Culture and


Heritage;

(m) To coordinate with Government of India institutions; and

(n) To conduct World Telugu Conference every two years and make
the Conference a Forum for discussing all aspects of Telugu
Language Culture and Heritage;

(iv) e-Telugu Development

(a) To promote creation of digital content in Telugu in the fields of


philosophy, science, mathematics, engineering, medicine,
economics, architecture, history, arts and such other fields;

(b) To facilitate implementation of Telugu on the internet, and in


popular websites and information technology applications;

(c) To provide online courses teaching Telugu language;


(d) To publish all Telugu classics on the Authority website;
(e) To digitalise all inscriptions and palm leaf manuscripts and publish
on the Authority website;
(f) To introduce Unicode in all Government correspondences and
preserve all information in Unicode; and

(g) To coordinate with Information Technology (IT) companies and


facilitate availability of all popular IT tools in Telugu language;
(v) (A) Translation and Publication
(a) To coordinate with all departments to take up translations of
glossaries, administrative terminology and other information of
departments to facilitate implementation of Telugu as official
language;
(b) To publish and preserve the dictionaries, lexicons and to translate
them along with other research books on Telugu culture and
heritage available in other languages;

(c) To ensure that translations are done using simple terms


understandable to common man;

(d) To formulate translation guidelines in order to ensure that official


correspondence is done in Telugu; and

(e) To encourage and publish books and articles on the advantages


of using mother tongue as official language and medium of
instruction through stories, poems, plays etc.

(B) Promotion

(a) To publish publicity material such as posters, handbills, user


manuals, digital content;

(b) To create awareness among employees and public on use of


mother tongue;

(c) To facilitate implementation of Telugu in user manuals for various


hardware equipment manufactured in the State;

(d) To facilitate communication, oral or written, in Telugu in the


airlines, trains and busses operating in the State; and

(e) To facilitate creation of new and innovative Telugu fonts;

(C) International Telugu Development

a) To liaison with other State Governments to facilitate Telugu teaching in


their respective states Telugu minorities;

b) To liaison with Hindi speaking states to implement Telugu as third


language in their States;

c) To liaison with Official Language Commission of Government of India


and extend its jurisdiction to all Indian languages incorporated in eighth
schedule of the Constitution of India without confining to Hindi;

d) To protect Telugu language in the border mandals from invasion by


other languages of neighboring States by formulating special
schemes/programs; and

e) To liaison with other state Governments to sort out any academic or


administrative problem that may arise regarding Telugu language; and

(2) In addition to the functions of the Authority under sub rule (1), the
Authority may undertake such other functions as the Government may
assign to the Authority and in so doing the Authority shall be deemed
to be fulfilling the purposes of the Act and the provisions of the Act
shall apply to the Authority in respect of such functions.

(3) Nothing in this rule shall be construed as imposing on the Authority,


directly or indirectly, any form of duty or liability enforceable by
proceedings before any court.

PART IV
POWERS OF THE AUTHORITY

6) Powers of the Authority:- (1) Under Section 13 of the said Act, the
Authority may exercise one or more of the following powers,

(a) To issue directions to departments and review the action taken on


implementation of Telugu in a time bound manner duly considering
the technical, financial and capacity building constraints;
(b) To seek and obtain information relating to implementation of
Telugu from any officer of the Government or Legislature or High
Court and such officer shall be bound to furnish the information
sought by the Authority;

(c) To advise the State Government regarding implementation of its


projects and programmes;

(d) To record any violation or dereliction of duty and to advise the


appointing authority for imposing a penalty on any public servant;

(e) To impose and collect penalties, as prescribed under the rules;

(f) To prescribe and review syllabus and system of Telugu


examinations conducted for testing public servants;

(g) To issue directions to Central Government establishments on use of


Telugu in areas having interface with public;

(h) To review and protect the status of Telugu medium institutions


and their continuation;

(i) To set up required offices at the State level and District level;

(j) To issue directions on implementation of Telugu as first language


up to intermediate or equivalent education;

(k) To verify the learning levels of students up to intermediate or


equivalent;

(l) To ensure teaching of Telugu Language as a subject in all the


semesters up to degree;

(m) To ensure teaching of Telugu Language in all the technical


courses like Medicine, Engineering and Law;

(n) To ensure teaching of Telugu Language as a subject in all English


medium institutions;

(o) To ensure primary education is provided in all Government


institutions in Telugu medium; and

(p) To co-ordinate with project works of centre for Telugu Classical


Language of Government of India.

CHAPTER V
PROVISIONS RELATING TO STAFF

7) Appointment of staff— (1) No personnel shall be appointed


through manpower outsourcing agencies for carrying out services which
can be procured through service contracts such as housekeeping,
security, hospitality and such other services.

FINANCIAL PROVISIONS

8) Establishment and administration of Telugu Language


Development Fund—

a. There shall be established a fund to be called the Telugu


Language Development Fund, with a seed capital of Twenty
Five Crore Rupees, which shall, subject to the directions of
the Government, be controlled and administered by the
Authority.

b. Except as otherwise directed by the Government all money


credited to the Fund shall be invested only in a single
Scheduled bank.

c. A specified percentage out of tax collections specified by


Government, may be paid to the Fund;

d. Government Corporations are hereby authorized to give


grants to the Fund at their discretion, not exceeding fifteen
percent of their surplus;

e. The private portion of the Fund shall be raised from the


donations and other conveyances including funds, materials,
property, and services, by gratuitous title;

f. For the purposes of income tax and corporate tax, the Fund
shall be treated as that belonging to Government.

g. Chief Executive Officer shall be responsible for day to day


administration of the Fund.

9) Delegation of financial powers– Under section-26 of the Act,


delegation of powers of administrative sanction of all expenditure from
the Fund for the Chief Executive Officer shall be up to ten lakh rupees,
subject to any revision by the Board/Government from time to time.

PART-VII
MISCELLANEOUS PROVISIONS

10) Offences and penalties.–

(1) Any person who owns an enterprise does not cause his
establishment to display its name board in Telugu shall be
punishable with a fine of up to fifty thousand rupees, and in
case the person continues to commit the same offence for two
times shall in addition to the fine be punishable with an
imprisonment for a period not exceeding three (3) months;

(2) Any head of Government Department or agency who being


responsible for preparation of foundation or inauguration
plaques of Government functions in Telugu as prescribed by the
Government and does not do so shall be punishable with a fine
of up to ten thousand rupees;

(3) Any head of Government Department or agency who does not


use Telugu official language for his correspondence between
departments or with public as prescribed by the Government
shall be punishable with a fine of up to five thousand rupees;

(4) Any head of Government Department who does not review


implementation of Telugu as official language as prescribed by
the Government shall be punishable a fine of up to five
thousand rupees;

(5) Any public servant who does not use Telugu as official language
for his interaction with the public as prescribed by the
Government, shall be punishable with a fine of up to ten
thousand rupees;

(6) Any person who owning an educational institution does not


implement Telugu syllabus or Telugu as a medium of instruction
as prescribed by the Government shall be punishable with a
fine of up to fifty thousand rupees or to an imprisonment for a
period not exceeding six (6) months.

11) Transitional provisions–The provisions set out in the Third Schedule of


the Act with respect to the transfer of assets, liabilities, functions and
employees of the erstwhile department shall have effect.

4) These Rules issue with the concurrence of Finance (FMU-GAD.II)
