Right to proceed of revenue sale or
compensation on acquisition
As per Section 73(1) of the Transfer of Property Act, 1882 if the mortgaged property is
sold due to the non-payment of government dues then the mortgagee shall have every
right to claim back his mortgaged money from such sale.
As per Section 73(2) of the Transfer of Property Act, 1882 if the mortgaged property is
acquired under the land acquisition act or any other act and the compensation is paid
the mortgagee can claim his debt from such compensation.
Section 73(3) says that such claims shall prevail against all other claims except those
of prior encumbrancers, and may be enforced notwithstanding that the principal money
on the mortgage has not become due.
