AFFIDAVIT OF ADVERSE CLAIM
I, ERLINDA GRACIOSA CAJOLES, Filipino of legal age, widow and
a resident of Barangay San Pedro, Dumingag, Zamboanga del Sur,
Philippines, after having been sworn to in accordance with law depose and
say:
That I am the surviving legal spouse of RITO CAJOLES (deceased)
who was a Vendee of a portion of parcel of land containing an area of SIX
HUNDRED SIX (606) SQUARE METERS, more or less, located at Barangay
San Pedro, Dumungag, Zamboanga Del Sur, Island of Mindanao;
That the aforesaid portion (Six Hundred Six Square Meters), of
parcels of land is covered by mother title particularly Transfer Certificate
of Title No. T-12,247, containing a total area of ONE THOUSAND TWO
HUNDRED TWELVE (1,212) SQUARE METERS, more or less;
That I purchased the aforesaid portion of land consisting of an area
of Six Hundred Six (606) Square Meters, more or less from the spouses
EVANGELISTA TORREFIEL and NATIVIDAD DUCO-TORREFIEL;
That after the execution of the Absolute of Deed of Sale, my
husband during his lifetime was not able to immediately process the transfer
and titling of the aforesaid portion of parcel of land considering that the
owner’s duplicate copy of Transfer Certificate of Title No. T-12,247, was not
delivered despite repeated demands so that my late husband can process
the relocation survey and for the issuance of new certificate of title covering
the total area of Six Hundred Six (606) Square Meters, more or less.
Hence, this affidavit of Adverse Claim;
That I have not caused the conveyance of said parcel of land to
anyone including our relatives;
That unless an adverse claim is annotated on the afore-described
Transfer Certificate of Title No. T-12,247, I, ERLINDA GRACIOSA CAJOLES,
being the surviving legal spouse of the Vendee Rito Cajoles is in danger of
being defrauded and deprived of my just and valid right over the afore-
described parcel of land and, as such, I executing this Affidavit in support of
my request for the annotation of an adverse claim over the parcel of land
described herein.
FURTHER AFFIANT SAYETH NAUGHT.
IN WITNESS WHEREOF, I have hereunto affixed my hand this 11th day
