When President Xi Jinping heard the 2020 duty visit report of the then Chief Executive Carrie
Lam, he stressed that the significant turnaround from chaos to governance in Hong Kong has once
more demonstrated that in order to ensure that the implementation of stable and long-lasting “One
Country, Two Systems”, it is necessary to adhere to the principle of “patriots administrating Hong
Kong”; and only in this way the Central Government’s full authority over the Special
Administrative Region can be effectively implemented, the constitutional order established by the
“Constitution” and the “Basic Law” can be effectively safeguarded, various deep-rooted problems
can be effectively resolved, and Hong Kong can achieve long-term peace and stability.

The HKSAR’s political structure is an executive-led system headed by the Chief Executive. The
executive, the legislature and the judiciary each perform their respective roles under this system
in accordance with the “Basic Law”…The HKSAR Government is responsible for the formulation
of policies and the introduction of bills, which are then referred to the Legislative Council for
enactment of laws when necessary, and then to the government for implementation. As for bills
introduced by members of the Legislative Council that involve government policies, they must
obtain the written consent of the Chief Executive. It is clear that under the political structure
established by the “Basic Law”, the executive and the legislature are interrelated in the
performance of their duties, but the executive has the primary authority to introduce bills. Under
the “Basic Law”, the courts of the SAR are empowered to exercise judicial power, which includes
the power of final adjudication, independently.

This year, the Legislative Council convened 33 meetings, reviewed 25 government bills and passed
17 of them. 33 motions were proposed by members; among them, the “Copyright (Amendment)
Bill 2022”, which was reviewed twice in the past, was stalled by some members by filibustering.
The government proposed it again this year, and the bill was reviewed and passed earlier, so that
Hong Kong’s copyright regulation can keep up with the actual environment and needs. Even so, it
remains to be seen whether the new Legislative Council will have sufficient oversight of the
government. In particular, since Hong Kong is executive-led and under the principle of “patriots
administering Hong Kong”, if the Legislative Council’s functions are interpreted to be “in line with
the government”, and Members are compliant, then the monitoring will not be sufficient.

The more controversial issue of this year is the Light Public House Policy (LPH). The disclosure
was not made until the Chief Executive delivered the Policy Address, and the relevant financial
details were only revealed by the government at the panel stage, and they were vague. During the
discussion, members were more unanimous in raising objections, prompting the government to
provide more detailed financial and site selection information for further discussion at a later date.
This is a typical example of the government’s executive-led approach to guide legislators to
“cooperate” with the government. This time, legislators have performed their monitoring role and
functions properly, and hopefully, after this incident, they will remain vigilant when interacting with
the government and scrutinizing policies and funding, so as not to let the government easily muddle
through.

In November 2022, OpenAI, a US tech start-up, launched an AI-powered chat application program
called ChatGPT, which has quickly become popular worldwide. ChatGPT is capable of learning,
reading text and data, and understanding the grammatical rules and structures of different languages
including English, Chinese, French and Japanese. It generates sentences that follow language logic and
can converse with users in an unfettered way, answer questions, and even write programs and articles
upon request.
More and more enterprises and organisations are adopting ChatGPT and providing it with data to
handle customers’ inquiries and service requests 24/7, making it more convenient for customers to get
the information they need and enhancing their satisfaction.
Some commentators believe that ChatGPT can take over some of the repetitive or simple paperwork
tasks in enterprises and organisations, and can help with data research and analysis, enabling
employees to focus more on important tasks such as proposing ideas and strategic planning, to improve
their operational efficiency.

In 2023, a job search website ResumeBuilder.com surveyed 1 000 US business leaders and found that
ChatGPT has been introduced into 49% of the enterprises for writing programs, providing customer
services, writing minutes of meetings or document summaries, etc. Some respondents indicated that
they were planning to introduce ChatGPT to their enterprises. In addition, 48% of the respondents
expressed that the situation of ChatGPT replacing employees had already occurred in their enterprises.

The following chart shows how much money could be saved for the respondents’ enterprises using
ChatGPT.

Cybersecurity experts warned that when users upload internal documents of companies to AI
application programs like ChatGPT for analysis, the data may be stored in the program’s big data, and
then learned and applied elsewhere. Some financial institutions in Japan, such as Sumitomo Mitsui
Banking Corporation and Mitsubishi UFJ Financial Group, restrain employees from using ChatGPT
for work to prevent inappropriate use by employees and the disclosure of important privacy involving
customers and financial transactions.
In addition, the CEO of the company that developed ChatGPT admitted that the program has the
shortcoming of “bias”. When outdated and erroneous data, or unverified and biased arguments, are
input during the training period, the answers generated by the program may be unusable and may even
contain offensive or discriminatory words. It is like children being exposed to grammatically wrong
sentences or harmful thoughts from a young age. There could be deviation in their speeches when they
become adults.
